Chair McIff called the meeting to order at 4:10 p.m.

H.B. 13 Offender Registry Review (Rep. J. Draxler)

Rep. Draxler presented the bill to the committee.

MOTION: Rep. Brown moved to amend the bill as follows:

1. Page 1, Lines 18 through 20: 18 C unlawful sexual conduct with a 16 or 17 year old; or 19 C unlawful sexual activity with a minor; { or 20 C a misdemeanor violation of voyeurism; }

2. Page 16, Lines 466 through 469: 466 (a) the offender was convicted of: 467 (i) Section 76-5- { 40 } 401 , unlawful sexual activity with a minor; 468 (ii) Section 76-5-401.2, unlawful sexual conduct with a 16 or 17 year old; or 469 (iii) { a misdemeanor violation of Section 76-9-702.7, voyeurism } any House Judiciary Standing Committee January 24, 2012 Page 2

offense substantially equivalent to an offense listed in Subsection (a)(i) or (a)(ii) and is required to register under Subsection (1)(p)(ii), or (1)(p)(iv) ;

The motion passed unanimously, with Rep. Cox, Rep. Herrod, and Rep. Christensen absent for the vote.

MOTION: Rep. Cox moved to pass the bill out favorably as amended. The motion passed with Rep. Herrod, Rep. Ivory, Rep. Snow, and Rep. Wilson voting in opposition.

H.B. 17 Sex Offender Registry Chapter (Rep. J. Draxler)

Rep. Draxler explained the bill to the committee.

MOTION: Rep. Snow moved to replace H.B. 17 with 1st Substitute H.B. 17. The motion passed unanimously.

MOTION: Rep. Herrod moved to pass out 1st Substitute H.B. 17 with a favorable recommendation. The motion passed unanimously.

Chair McIff relinquished the chair to Vice Chair Christensen.

H.B. 38 Competency to Stand Trial Amendments (Rep. K. McIff)

Chair McIff presented the bill to the committee.

MOTION: Rep. Snow moved to pass the bill out favorably. The motion passed unanimously.

MOTION: Rep. Ivory moved to pass the bill out favorably. The motion passed unanimously.

H.B. 57 Age Difference in Sexual Offenses (Rep. R. Greenwood)

MOTION: Rep. Brown moved to adjourn the meeting. The motion passed unanimously.
