Abstract Incidents at sea between warships and military aircraft often involve more than provocative actions – they may be aggressive and can sometimes result in death and destruction. In view of the low threshold of a resort to armed force by one State against another that would bring an international armed conflict into existence, it is rather difficult to determine whether incidents at sea remain below that threshold. Similar, albeit less difficult problems arise with regard to forceful measures taken by States against foreign merchant vessels. Here it is important to clearly distinguish between law enforcement at sea and the exercise of belligerent rights. Abstract: This accident summary report discusses the August 5, 2008, accident involving a Sikorsky S-61N helicopter, N612AZ, which impacted trees and terrain during the initial climb after takeoff from Helispot 44 (H-44), located at an elevation of about 6,000 feet in mountainous terrain near Weaverville, California. The pilot-in-command, the safety crewmember, and seven firefighters were fatally injured; the copilot and three firefighters were seriously injured. Impact forces and a postcrash fire destroyed the helicopter, which was being operated by the U.S. Forest Service (USFS) as a public flight to transport firefighters from H-44 to another helispot. The USFS had contracted with Carson Helicopters, Inc. (CHI), of Grants Pass, Oregon, for the services of the helicopter, which was registered to CHI and leased to Carson Helicopter Services, Inc. -

07_PEDROZO MASTER.DOCX (DO NOT DELETE) 7/3/2012 3:30 PM The U.S.-China Incidents at Sea Agreement: A Recipe for Disaster Pete Pedrozo* INTRODUCTION On May 25, 1968, after making several close passes of the USS Essex, a Soviet Tu-16 Badger bomber crashed into the Norwegian Sea as it was attempting another pass, killing the entire crew.1 Two weeks earlier, Soviet warships had collided with the USS Walker in the Sea of Japan after the U.S. destroyer maneuvered to prohibit the Soviet ships from disrupting flight operations on board the USS Hornet.2 These incident culminated nearly a decade of dangerous incidents between U.S. and Soviet naval forces – close passes by low-flying aircraft, intentional shouldering (bumping) of surface ships, threatening maneuvers, and mock surface and air attacks against U.S. naval vessels – and laid the groundwork for the negotiation and signing of the Incidents at Sea (INCSEA) Agreement by the governments of the United States and the U.S.S.R. in 1972. INCSEA was signed in Moscow by then Secretary of the Navy John Warner and Soviet Admiral Sergei Gorshkov, and, for the next forty years, it all but eliminated unsafe and unprofessional aerobatics and ship handling when U.S. and Soviet (later Russian) forces operated in close proximity to one another on the high seas. A Protocol extending the prohibition on simulated attacks to nonmilitary ships was signed in 1973.3 That same year, nearly 150 U.S. and Soviet warships deployed to the Eastern Mediterranean in an effort to support their respective allies during the Yom Kippur War. -
