Shapiro By Yitzchok Stroh Professor Marc Shapiro’s latest work, Changing the Immutable, contains considerable interesting and pertinent information for the student of Jewish history. As stated on the cover, the author attempts to reveal how the (Jewish) orthodox ‘establishment’ silences both past and present dissenting voices through “Orthodox Judaism Rewriting Its History.” I don’t intend this to be a review of the entire work (that would take a lot more time and space), however I did want to share some of my frustration here, because I sense that the author’s bias affected his objectivity, and I am afraid that many a reader will be left with an impression that in many ways does not reflect the reality of this complex topic. In this article, I would like to examine one passage of Shapiro’s work to illustrate this point. In chapter eight, entitled, “Is the truth really that important?” Shapiro writes: Because my purpose in this chapter is to chart the outer limits of what has been viewed as acceptable when it comes to falsehood and deception. I will be focusing on the more ‘liberal’ positions. My aim is to show just how far some rabbinic decisors were willing to go in sanctioning deviations from the truth. One must bear in mind, however, that there are often views in opposition to the ones I shall be examining. Perhaps this knowledge can serve as a counterweight to the shock that many readers will experience upon learning of some of the positions I will mention. -

Justice in Afghanistan Rebuilding Judicial Competence After the Generation of War Livingston Armytage* This article describes the challenge of rebuilding judicial competence in the courts of Afghanistan after almost thirty years of war. It outlines the principal findings of a national research study undertaken for the Supreme Court in early 2006.1 In two parts, the article analyses the deficiencies in the quality, competence and professionalism of the judiciary as a direct legacy of the degradation of the in- stitutional and human capacity (A.), and outlines initiatives to develop long-term education and training strategies to rebuild these capacities (B.). A. Assessment The organization and jurisdiction of the courts of Afghanistan is governed by the Afghanistan Constitution adopted on 4 January 2004 and by the subsequent Law of the Organization and Authority of the Courts of Islamic Republic of Af- ghanistan (Law of the Courts) adopted in April of 2005.2 Chapter VII of the Con- stitution sets forth that the judicial branch is an independent organ of the state. PHILO AND THE NAMES OF GOD By A. MARMORSTEIN,Jews College, London IN A recent work on the allegorical exegesis of Philo of Alexandria' Philo's views and teachings as to the Hebrew names of God are once more discussed and analyzed. The author repeats and shares the old opinion, elaborated and propagated by Zacharias Frankel and others that Philo was more or less ignorant of the Hebrew tongue. Philo's treat- ment of the divine names is put in the first line of witnesses to corroborate this literary verdict. This question touches wider and more important problems than the narrow ques- tion whether Philo knew Hebrew, or not,2 and if the former is the case how far his knowledge, and if the latter is true how far his ignorance went. For the theologians generally some important historical and theological problems, for Jewish theology especially, besides these, literary and relig- ious questions as to the date and origin of religious concep- tions, and the antiquity and value of our sources are involved. Philo is criticized for having no idea2 of the equivalent names used by the LXX for the Tetragrammaton and Elohim respectively. The former is translated KVptOS, the latter 4hos. This omission is the more serious since the distinction between these two names is one of Philo's chief doctrines. We are referred to a remark made by Z. Juvenile Code
In the Name of Allah, the most merciful and the most compassionate Juvenile Code 1 Preamble Article 1 1. This Code, in compliance with the International Conventions protecting human rights and in particular the interests of children, dictates provisions indicating measures and procedures applicable to those in conflict with the law, at risk, and in need of care and protection. Article 2 1. Objectives of this Code are: 1) Prevention and social readjustment of children in conflict with law. 2) Re-educating children whose behaviour cannot be corrected through parental care or ordinary educational measures. 3) Encouraging and supervising public welfare institutions and social services to provide care and protection for children in need. Article 3 1. In each capital Province a Juvenile Primary Court is established. 2. The Primary Juvenile Court, having jurisdiction on the territory of the Province, is competent to handle all the cases of children in conflict with the law, at risk, and in need of care and protection. 3. Appeals and complaints against the decisions of the Primary Court are considered by the Provincial Court located in the same venue. Article 4 1. The juvenile Primary Court is composed of three judges: one of them being the President of the Court. 2. In addition to the qualifications required by the Law of Jurisdiction and Organization of Courts of Afghanistan, the judges of the juvenile Court shall have specific aptitude and experience in dealing with the children problems. 3. The juvenile Court is assisted by administrative staff. Article 5 1. In each capital Province the office of the juvenile prosecutor, having competence to perform the activities laid down in this Code, is established. -

Rabbi Immanuel Bernstein 2019 / 5779 MESHECH CHOCHMAH Parshas Bechukosai Miracles and Nature םאִ בְ ּחֻקֹּתַי תֵ ּלֵכּו... וְ נָתַתִ ּי גִשְׁמֵ יכֶם בְּעִתָ ּם If you will follow My decrees …I will provide your rains in their time (26:3-4) Our parsha opens with the Torah’s promises of blessings if the Jewish people fulfil its mitzvos. We note that the Torah does not say that if we fulfil the mitzvos then Hashem will perform miracles for us. Rather, the blessings are expressed within the bounds of nature, such as rains in their time. This teaches us a profound lesson regarding the way in which Hashem wishes to bestow His blessing on the world. Although there are times when Hashem has performed miracles for the Jewish people, these do not represent the ideal way that He wishes to run the world. Rather, it is the rules of nature, ordained by Hashem, that contain within them the capacity to provide for the needs of all life-forms. If the Jewish people follow the Torah, then the medium of nature will be maximized to produce plenty and fulfil all their needs. THE ROLE OF MIRACLES A direct corollary of this idea is the crucial recognition that the laws of nature are not programed in advance to produce a set amount depending on natural input alone. Rather they are constantly being governed by Divine supervision in response to the spiritual level of the Jewish people, based on which Hashem will decide how much blessing to bestow within those laws. Thus, the midrash states1 that in the generation of R’ Shimon ben Shatach – one in which people were extremely righteous – the rains fell consistently on Friday nights, a time when people are at home and no inconvenience was caused by the rain. -
