    OREGON's Juridical Small Sacrifices US Top Model Case of Professional Judicial Ethics regarding (Elizabeth) Diane Downs Synopsis by Franz Kurz (March 2016) This case is riddled with judicial misconduct and legal error. To date the facts of this case have not come to light in an unbiased court of law. This synopsis provides oversight to this claim. 1) State's procedures, and involved authorities a) Code of Professional Conduct: According to Article IV of the Oregon Constitution, the Governor appoints vacancies in Circuit Court Judges, Court of Appeals Judges, Supreme Court Justices, Justices of the Peace, and District Attorneys. As early as three weeks after the crime (May 1983) in which one child died and Ms. Downs, although having been shot herself, took her injured children to the hospital, Juvenile Court Judge Gregory Foote took these children from Diane Downs and their grandparents and placed them in questionable state care. There they stayed until a year later that self- same Judge Foote had been transferred to the Criminal Court and thereupon took on that criminal case as his first case on his new job, although it represented a conflict of interest, and a violation of the legal integrity of a civilized country. Own annotation: From the notorious People's Court (Volksgerichtshof) in German’s past: With almost no exceptions, cases in the People's Court had predetermined guilty verdicts. Considering the fact that Judge Gregory Foote meets the requirements of the above judicial code, he should have disqualify himself of this case but did not. First, the files of 100 women were examined at a probation office to look for those with a history of dependent, abusive, or dysfunctional relationships with men. In the files where such a pattern was discovered, it was noted whether or not the woman's criminal activity had a connection to the relationship. The second research method used was a voluntary survey administered to 30 female offenders. Third, three criminal justice professionals who work with female offenders were interviewed. The results of the information gathered from the files indicated that 30 of the 100 women had a tendency toward dependent romantic relationships; of these 30 cases, 21 demonstrated a connection between the criminal behavior and romantic relationships.

Once facilitator Brenda Rocklin has finalized the workgroup’s recommendations we will officially receive them at the next regular scheduled Board meeting. This will start the process of evaluating and studying the recommendations. Mark asked if there would be some feedback loop to the workgroup as the Board gets the recommendations and if there is any process in reporting back to the workgroup. Steven said not in an official capacity, depending on where the people have articulated their interest. Changes in the victim notification process will be ongoing and people will be involved as we progress. Candace asked about the media’s coverage of the workgroup. Nancy reported that there was interest at first, but that it has dropped off. Once the report is released, interest may pick up. Corrections Population Forecast: The October 2008 forecast projected a population increase of 2-3% in the incarceration population and similar growth in the PPS supervision population; however, this will be adjusted after the November election to accommodate any sentencing policy changes.
