RECOUNT OFFICE OF PRESIDENT OF THE NOVEMBER 8,2016 GENERAL ELECTION THURSDAY, DECEMBER 1, 2016

County Clerk Kimberly Bushey, called the meeting ofthe Walworth County Board of Canvass to order at 9:01 a.m. She stated the purpose of this meeting is a State Ordered Recount for the Office of President of the United States. She said the Public Notice was posted in three public locations on or before November 30, 2016 at 8:00 a.m.

Bushey submitted: Public Notice as Exhibit #1. (Incorporated herein) Elections Commission Order for Recount as Exhibit #2. (Incorporated herein)

Bushey introduced Joseph Rezek as the Republican Member of the Board of Canvass and Janis Anton as the Democratic Member of the Board of Canvass. She thanked everyone present for volunteering and reminded everyone to complete an Oath and W-2 Form and the forms were collected. Bushey briefly explained the rules of the meeting.

Michael Cotter, Corporation Counsel, requested that all Candidate Representatives sign in with him.

Bushey announced there would be multiple functions occurring simultaneously. There will be two tabulation tables, multiple poll book reconciliation tables, and reconciling will be conducted out ahead of this process. There were no objections.

County Clerk Bushey made a motion that the Board of Canvass utilize the electronic voting equipment and hand count ballots at their discretion, seconded by Janis Anton. Motion carried 3-0.

Bushey verified the tamper evident seal number on the Memory Card box as 45346130.

Bushey announced when reviewing the used absentee envelopes, they are looking for: 1) Signature ofthe Voter 2) Signature ofthe Witness 3) Address ofthe Witness 4) Initials ofthe Clerk acknowledging the Photo ill requirement had been met.

Bushey asked Michael Cotter, of Corporation Counsel, to contact the Wisconsin Election Commission (WEC) if anything should happen to those envelopes without the initials ofthe Clerk indicating they saw Photo ill. Cotter stated per the WEC there was nothing that needed to be done.

There were no rejected absentee envelopes. There were no provision ballots.

Both Poll Books were fully reconciled. There were 2222 Regular Voters and 775 Absentee Voters There were 775 Absentee Ballot Envelopes There were 775 Absentee Ballots

Bushey announced there was one absentee envelope without the address of witness - need to draw down 1 ballot. Anton stated the ballot should not have been counted the evening ofthe election. There were no objections. Drawing down by one will reduce the number of ballots and voters by one and will reduce the number of absentee ballots and voters by one. (2221)(774 absentee voters) Draw down reduced Clinton by 1.

The Board of Canvass reviewed the properly remade absentee ballot. Sue Kitzman then ran the absentee ballots through the electronic voting equipment.

Mary Gilding, the Jill Stein Representative, formed an objection: "The election night results ofNovember 8th for President count is erroneous with the count ofthe recount on December 1sl of Sugar Creek." No action was taken.

Anton made a motion to run the ballots through the electronic voting machine. Ifthe machine is operating properly and the numbers match, we will move on. If not, we will look through the ballots, second by Rezek. Motion carried 3-0.

Bushey announced that notification was received by the Wisconsin Election Commission that all candidates were properly served and notified for the recount.

The Board of Canvass reviewed 8 hand counted ballots that might be difficult for the machine to read with 5 votes going for Trump, 2 for Clinton and 1 for Johnson.

The Board of Canvass determined there was one properly duplicated ballot and the ballot was processed through the election machine.

Tabulators separated ballots that may not be properly counted by the machine for review and hand counting by the Board of Canvass.

There was 1 absentee ballot that was hand counted. The ballot was a no vote for President. It increased the number of cards cast by 1.

OS Tape is not the final record because we have the additional hand counted ballots. There were 869 OS ballots plus 3 hand counted ballots for a total of 872 cards cast.

Bushey announced the new seal numbers located on the self-sealing bags were not being recorded at this time and asked if there were any objections. There were none.

Items ofNote: There was one absentee envelope missing the signature of the elector and the signature of the witness. The ballot was completed in person at the Town Hall. Michael Cotter, Corporation Counsel, contacted the Wisconsin Election Commission (WEC) who stated it was up to the Board of Canvass to make the decision as to whether or not they should count the ballot as a draw down, as this was different than a Clerk failing to initial. The State recommended the Board not to disenfranchise any of the ballots, as it is not a large enough violation. County Clerk Bushey made a motion to count the ballot, second by Rezek. Discussion then focused on the requirements of initials and signatures on absentee envelopes. Mary Gilding, the Jill Stein Representative, and MariSue, the Hillary Clinton Representative, fonned an objection: They were both concerned that the absentee envelope was issued at the Town Hall where the Clerk or Clerk's representative failed to witness it. Motion carried 3-0.

Mary Gilding, the Jill Stein Representative, fonned an objection: There were many absentee envelopes that did not have the initials of the clerk indicating that photo identification was shown. Bushey stated this situation occurred earlier in the day and no further action was required.

County Clerk Bushey made a motion to recess until 8:30 a.m. on Friday, December 2, 2016, second by Rezek. Motion carried 3-0.

FRIDAY, DECEMBER 2,2016

County Clerk Bushey announced that one Village of Bloomfield ballot was found under the electronic voting machine at the end of the evening (December 1, 2016), when cleaning up. The ballot was properly bagged and secured after hours last evening, when it was discovered.

Bushey announced new infonnation regarding observer rules requiring action of the Board of Canvass and asked Michael Cotter, of Corporation Counsel, to speak on this. Cotter said he received guidance from the Wisconsin Election Commission (WEC) to check the Photo ill of all candidate observers. The question was "Can out-of-state observers act as primary or secondary observers". The State's recommendation was to allow out-of-state observers to act as primary and secondary observers for Wisconsin. County Clerk Bushey made a motion to allow out-of-state candidate observers to act as primary or secondary observers for the campaign and to serve as primary and secondary observers, second by Rezek. Discussion focused on out of state "designated" primary and secondary candidate representatives. Only the primary candidate is allowed to address the Board. Motion carried 3-0.

Bushey referred to the notes taken on Thursday, December 1, 2016 and stated: The Board of Canvass inspected all of the absentee envelopes and there were a Total of740.

She stated the clerk forgot to sign as a witness and write in the address. Buchanan swore that this was a clerical error and the absentee ballot and absentee envelope are valid. Couoty Clerk Busbey made a motion to count Absentee Envelope/Ballot No. 264, second by Rezek. Motion carried 3-0.

There were no rejected absentee envelopes, no provisional ballots, and no original ballots that were duplicated.

She said they are missionaries in Hungary with the intention of moving back to the address, one became ill and had to remain in Hungary. They are still registered in the Town of East Troy. The addresses could not be ascertained by reviewing the outside of the envelope. County Clerk Bushey made a motion to deem the two absentee envelopes (for absentee voters #815 and #816) rejected and draw down from the possible absentees in Wards 2-3 in the Town of East Troy, second by Anton. Motion carried 2-1 (Rezek was in opposition). Absentee envelopes #815 and #816 were deemed rejected and properly inserted into a Certificate of Rejected Absentee Ballots Envelope and marked TET2-3 - Exhibit #1. (Incorporated herein) This reduced the used absentee envelopes by 2 and reduced the absentee ballots by 2.

There were 2 used absentee envelopes with incomplete addresses missing the City and State. The Board of Canvass could ascertain by the face of the envelope what the proper municipality was.

Bushey announced the ballots would be hand counted.

The Board of Canvass reviewed and verified the 4 remade duplicate ballots were properly remade.

Bushey executed a draw down from possible absentees. The absentee ballots were placed in a box and two ballots were drawn. County Clerk Bushey made a motion that a write-in ballot for Trump for President and Nehlen for Vice President be counted as a vote for Trump, second by Rezek. Motion carried 3-0.

There were no rejected absentee envelopes and no provisional ballots.

No draw down was necessary since there are fewer absentee ballots than voters and the total ballots don't exceed the number of voters.

An write-in ballot was brought to the attention of the Board of Canvass, which was a write-in for Donald Trump and Ben Carson as a ticket. This ballot was counted as a vote for Donald Trump.

Items ofNote: Bushey stated there were 27 absentee envelopes where the clerk did not fill in the voter's address. They have been signed and witnessed and the voter's name is on it, with Doris' signature. Bushey reiterated that the only time it is rejected if it is missing the signature of a voter or a witness, or the address of the witness. Bushey determined that the witnesses are special voting deputies at a nursing home. The same two people were witnessing all of the signatures. Trump Representative, Chris Goebel, requested that the signatures on the remaining absentee ballots with purple post it notes affixed be checked to compare the similarity of the

The Board of Canvass surmised they were nursing home voters, and spot checked three for the address which was 270 Ridge, which is the Golden Years Nursing Home. Bushey stated that on Election Day, there were 2 provisional ballots in the Village of Walworth. PV 1 was counted, but PV 2 (nonrehabilitated ballot) was not counted and rejected because the person did not come back with the information necessary to complete the ballot.

There were 9 recreated ballots, of which 8 were properly recreated and 1 was not. The original Ballot #1 was marked as Exhibit No. V-Wal #3. The recreated Ballot #1 was marked as Exhibit V-Wal #4. #1 was not properly recreated and should have been a no vote for President of the United States.

Clerk Bushey reviewed four irregular absentee envelopes that were brought to her attention due to lack of the municipal clerk's initials on the absentee envelopes for Photo ill. Clerk Bushey asked the candidate representatives if there were any objections to count these absentee ballots. There were no objections.

There were four ballots with the initials ofV.M. These ballots were marked as Exhibits LGl, LG2, LG3 and LG4. City of Lake Geneva Clerk Sabrina Waswo indicated that there is no one in her office that would have issued an absentee ballot with the initials of V.M. Clerk Waswo indicated there was a poll worker with the initials of V.M. County Clerk Bushey made a motion that Exhibits LGI through LG4 with only one set of initials be treated as election day ballots not absentee ballots, second by Rezek. Motion carried 3-0. No objections from candidate representatives.

It was noted that some of the absentee ballots have three sets of initials on them. These absentee ballots were completed at a nursing home and have three sets of initials because the City Clerk and two deputies initialed. The County Clerk was notified of the abnormality by City of Lake Geneva Clerk Sabrina Waswo.

The Board of Canvass reviewed the duplicated ballots. There were 17 properly duplicated ballots.

There was a regular ballot with no initials. This ballot was marked as Exhibit LG5. Anton requested that the Board of Canvass act on this exhibit after counts were completed. After counts were completed, County Clerk Bushey made a motion that Exhibit LG5 be considered a regular ballot and counted as a regular ballot, second by Anton. Motion carried 3-0.

It was determined that there were 597 absentee ballots and there were 596 absentee ballot envelopes. County Clerk Bushey made a motion that one absentee ballot be drawn down and marked as an exhibit and the count be reduced by that ballot, second by Rezek. Motion carried 3-0. Draw down occurred with Rezek drawing one absentee ballot from box. That ballot was a vote for Donald Trump. Clerk Bushey marked that ballot as Exhibit LG6 and stated the count for Donald Trump will be reduced by 1.

When calling numbers for candidates. Donald Trump was 914 and as a result of the draw down, the total votes for Donald Trump is now 913.

By consensus, the Board of Canvass is going to the note the problem and keep these ballots separate until the remaining ballots were counted for these wards. After the ballots were counted, the consensus of the Board of Canvass is to note the ballots without initials as an irregularity. The City of Whitewater was aware of the problem and noted it on the Inspector's Statement. Stein Candidate Representative, Jim Buckingham, and Trump Candidate Representative, Chris Goebel, objected to the validity of these ballots as to the lack of procedure. No action was taken.

There were 332 absentee ballots identified, which is one more than absentee voters as indicated on the poll list.

Wards 3 and 4 Inspector's statement confirms 276 absentee voters. County Clerk Bushey noted that on election night, ballots cast were 1078 + 2; the City Clerk accidentally ran the result tapes before the two final voters cast their ballots. Their votes didn't go through machine but were hand counted and placed on the tally sheet. County Clerk Bushey manually entered them after the election and prior to reporting results. The reconciliation count showed 1081 on the poll book, and the clerk reconciled to 1080. See CWW 3-4, Exhibit 1 (explanation from Clerk-Incorporated herein).

County Clerk Kimberly Bushey reconvened the Walworth County Board of Canvass at 8:32a.m. on December 6, 2016.

County Clerk Bushey reported on an email she received from Town of Walworth Clerk Marie Baker, expressing her concern over a shortage of one absentee envelope. The shortage was previously identified by the Board of Canvass and included in the Items of Note section in the minutes for the Town of Walworth.

The Board proofed the data entry from the December 5, 2016 session of the Board of Canvass, which included the City of Whitewater Wards 3-4, 7 and 8-9. The data was verified as correct.

County Clerk Bushey asked the Board of Canvass if they wanted to recheck the individual entries for each day, or proof only the changes on the aggregate report. Board consensus was to proof the changes from December 5, and re-verify the changes to the original reported results, since they had proofed entries each day. After the proofing, Bushey will verify the numbers on the computer and run a final report with signatures for the Board of Canvass and today's (December 6) time stamp. The final aggregate report will have the original reported results (November 15, 2016) time stamp appended to it.

When the final report and minutes of the recount procedure are completed, they will be forwarded to the Wisconsin Election Commission.

County Clerk Bushey read the changes from the original reported results. There were a total of 67 net changes, which were made during the course of the recount process. She noted that 53 of the 67 changes to write-ins and registered write-ins was the result of improperly completed write-ins which the voting machines didn't register (i.e., an "oval" which wasn't fully filled in, more than one oval was marked, or the oval wasn't marked at all). The Board of Canvass compared the final report to the original reported results and confirmed that the final numbers were accurate.

Bushey reminded the group that on December 1, six reporting units were counted by machine. The remaining 36 units were hand counted.

Walworth County Deputy Corporation Counsel Michael Cotter said the final reports will be forwarded to the State of Wisconsin, who then computes the data. When the final recount minutes are complete and approved by the Board of Canvass, they will be sent to the State. Cotter suggested that the minutes be posted on the County's website on the County Clerk's page after approval.

The Board of Canvass will meet at a date in the near future to review and approve the minutes of the recount process.

Board of Canvass Member, Janis Anton, made a motion to adjourn, second by Board of Canvass Member, Joseph Rezek. Motion carried 3-0.

On November, 29, 2016, the Wisconsin Elections Commission received confirmation that 53,499,689 was received from Jill Stein in payment of the estimate provided on November 28, 2016.

IT IS ORDERED THAT:

1. A recount be conducted of all the votes cast for the office of President of the United States at the General Election held on November 8, 2016, in all counties in Wisconsin.

2. The Board of Canvassers of each County shall convene at 9:00 a.m. on Thursday, December 1, 2016 to begin the recount.

3. The Board of Canvassers of each County shall conduct the recount using the ballot count method selected per Wis. Stat. § 5.90( 1) unless otherwise ordered by a court per Wis. Stat. § 5.90(2).

4. The recount shall be conducted using the procedures established by the Wisconsin Elections Commission's Recount Manual (November 2016) and the November 30,2016 webinar presentation, which are incorporated into this Order by reference herein. If necessary, the Wisconsin Elections Commission will issue supplemental directions regarding the procedures to be used by the county canvassing boards and communicate those directions to County Clerks via its website.

5. Each County Clerk shall post a notice of the Board of Canvassers' public meeting, pursuant to the Open Meetings Law, including any dates or times that the Board adjourns or reconvenes. Clerk's office went through the poll book and created a spread sheet of numbers used/voter names and determined that absentee ballots for the following people were NOT written in supplemental poll book as they should have been: CAIN, Joa Del; BINGHAM, Nicholas John; HENKLE, Annie; KLEINHANS, Alyssia; LEONARD, Chanler; LINDHOLM, Brandon; MEYER, Rebekah; MITCHELL, Justin; PEDERSEN, Erika; QUICK, Robert; SHEW, Emile; VALADEZ, Abisua; WEBBER, Derek; WRIGHT, Wesley; and YONTZ, Matthew. (15 voters). This would account for the difference in reconciling the poll book for absentees (261 absentee voters) 'Is. the absentee log and the Inspector's Statement, which both indicate 276 absentee voters.
