A Native Title Information Talk Delivered at Fernvale Futures on 22 February 2014. Tim Wishart Slide 1 I acknowledge and offer my respect to the country on which we meet and to the Traditional Owners of this country and to their Old People and Elders. The organisation for which I work, Queensland South Native Title Services is a native title service provider recognised and funded by the Federal Government under the Native Title Act (1993). Slide 2 The area for which QSNTS has statutory recognition under the Native Title Act covers an area spanning Queensland, along the New South Wales border from the Coral Sea to the South Australian border, north to about 250 kilometres north of Mt Isa and running diagonally south eastwards to the coast, marginally south of Sarina. Slide 3 I ought to say that views and opinions expressed are mine and are not necessarily reflective of corporate views or policy of QSNTS. In this conversation I will refer to the Native Title Act as ‘the Act’. But in the consciousness of Queensland Aboriginal and Torres Strait Islander society, the expression “the Act” is often a reference to The Aboriginal Protection and Restrictions of the Sale of Opium Act 1897. That legislation was an Act of the Queensland Parliament. As a result of dispersal, malnutrition, use of opium and diseases, all a consequence of European incursion into traditional lands coupled with the attempted genocide that came with that incursion, it was widely believed in Queensland that Aborigines were members of a 'dying race'. In 1894 pressure from some quarters of the community saw the Queensland Government commission Archibald Meston to look at what had conveniently, for the colonising power, become the plight of Aboriginal people. -

View metadata, citation and similar papers at core.ac.uk brought to you by CORE provided by University of Southern Queensland ePrints [2005] ANZLH E-Journal Traditional law and Indigenous Resistance at Moreton Bay 1842-1855 LIBBY CONNORS* On the morning of 5 January 1855 when the British settlers of Moreton Bay publicly executed the Dalla-Djindubari man, Dundalli, they made sure that every member of the Brisbane town police was on duty alongside a detachment of native police under their British officer, Lieutenant Irving. Dundalli had been kept in chains and in solitary for the seven months of his confinement in Brisbane Gaol. Clearly the British, including the judge who condemned him, Sir Roger Therry, were in awe of him. The authorities insisted that these precautions were necessary because they feared escape or rescue by his people, a large number of whom had gathered in the scrub opposite the gaol to witness the hanging. Of the ten public executions in Brisbane between 1839 and 1859, including six of Indigenous men, none had excited this much interest from both the European and Indigenous communities.1 British satisfaction over Dundalli’s death is all the more puzzling when the evidence concerning his involvement in the murders for which he was condemned is examined. Dundalli was accused of the murders of Mary Shannon and her employer the pastoralist Andrew Gregor in October 1846, the sawyer William Waller in September 1847 and wounding with intent the lay missionary John Hausmann in 1845. In the first two cases the only witnesses were Mary Shannon’s five year old daughter and a “half- caste” boy living with Gregor whose age was uncertain but described as about ten or eleven years old. -

Some Queensland Memoir Writer^. Presidential Address, by F. W. S. CUMBRAE-STEWART, B.A., B.O.L. At Annual Meeting of the Historical Society of Queensland, Friday, 30th August, 1918. Five years have passed since the inaugural meeting of this Society was held under the chairmanship of His Excellency, Sir William Macgregor, then Governor of Queensland and patron of the Society. During the time which has elapsed much history has been made, and the events which have shaken the world have not been favourable to quiet historical research, and I think that the Society must be congratulated on having maintained its existence in spite of so much that has hindered its work. Other difficulties overshadowed us. Before the first year had passed several of our members had died, and Sir William Macgregor had completed his useful and unstinted official service to the Empire. His retirement from the Governorship of Queensland removed him from us to his native;land. None of us who were privileged to be present will forget that morning when, on 15th July, 1914, he said farewell to us. Then came the war, which the wise had foretold, but the foolish ones had thought- was impossible. At one time the question of suspending the Society's operations was considered, but it was decided to carry on. When Sir Wm. Macgregor's successor arrived, he gave very ready and material help by taking the Society under his patronage. There are Others who have passed from our midst whose places we can never fill. Each year has added its toll. -

1 Life and Death on the Percy Isles, 1854 Rowland, Michael
“BY SAVAGE HANDS HIS STEPS WERE STAYED!”1 LIFE AND DEATH ON THE PERCY ISLES, 1854 ROWLAND, MICHAEL J.2 In October 1854, the ketch Vision arrived at Middle Percy Island off Mackay on the central Queens- land coast. The botanist Walter Hill, naturalist Frederick Strange and crew members went ashore. Hill went off with three Aboriginal people while the crew stayed behind with six others. When Hill returned, he found the crew except Dalaipi (an Aboriginal crew member) dead. Nine Aboriginal people were later captured and sent to Sydney to be tried for the killings. They appeared before the Water Police Court in Sydney before the court ordered they be sent back to the Percy Isles, though they appear not to have made it beyond Port Curtis. The death of Strange was widely reported in newspapers across Australia and was portrayed as a clash between the “heroic explorer and scientist” and the “untutored savage”. The events on the Percy Isles and further contacts on islands off the coast of central Queensland occurred from a time of limited hostile contact through a period of growing shipping movement, to a time of more substantial and lethal contact involving the Native Police. Contact events on the central Queensland coast reviewed here provide insights into reasons for initial limited hostilities on the offshore islands prior to increasing hostile and lethal conflict on mainland coastal and inland frontiers. The material has not been previously submitted, either in whole or in part, for a degree at this or any other university. T. Smith ABSTRACT Aspects of a hypothetical model of Aboriginal subsistence and settlement on Bribie Island, Southeast Queensland were tested by a technological analysis of stone artefacts. The original model posited movement over the island north-south along the remnant Pleistocene dune system, with limited west-east movement where swamps did not present a barrier. It also posited that groups coalesced and dispersed in response to varying stimuli; and that the two largest sites were semi-permanent residential areas as well as major import points for stone. As stone does not naturally occur on Bribie Island raw materials (and perhaps finished artefacts) were imported. A number of assumptions were made concerning the nature of spatial patterning of artefacts and raw materials relative to hypothesised import points. These included correlations between distance from import points and raw material variability, reliability of raw material, variability in artefact technical categories, and relative artefact size. Analysis results refuted these assumptions. No patterns relating to the import of raw materials and/or artefacts were revealed. -

I don’t think Terry needs any further introduction to you, and I’m sure this is going to be a fascinating session. Maroochy Barambah and Ade Kukoyi have been known to me and Brian for many years. In fact I actually first met Maroochy in New York when she was studying opera singing there. The film in which she starred, Black River, had actually just won the Paris Opera Film of the Year Award. The commentator for this session will be Professor Susy Frankel from New Zealand, who’s been very much involved with indigenous IP issues in New Zealand. Terry, over to you. DR TERRY CUTLER Thank you Anne. It gives me huge pleasure to chair this session. At the beginning of our conference we had a very moving welcome to country. Then we tend to proceed to marginalise, or make very unwelcome, any discussion that isn’t within an Anglo-Saxon, or a Commonwealth Club framework. I think one of the great gaps in public policy discussion in Australia is our neglect of this whole area of traditional knowledge and the role of indigenous people in intellectual property discussions. Zach’s Ceremony Film Premier Awareness & Fundraiser 19 MARCH 2017 Elder and Country Acknowledgement Introduction Waddamulli, Good Evening. I have it on very good authority that in order to engage with you all as an audience, and hopefully share ideas, observations and experiences, I must first offer you all something of myself. This sharing of myself, has not always been a comfortable reality for me. Life sometimes provides hard and damaging lessons about trust. My former reluctance has been borne of circumstances which elicit a response: Fool me once - shame on you, Fool me twice – shame on me. I have no doubts that I do not stand alone in this context. Tonight, I offer a story, some knowledge and something of myself. I am Linda, I am an Aboriginal Woman, I am a Birrigubba Mother, I am a learner, and I am a contributor. My recent family heritage is evidenced in the official colonial documentation dating back to 1845. Our family presence was first “officially” recorded in Kamilaroi Country (NSW), and further built upon by six (6) generations of family and cultural connection to the Whitsunday Coast North Queensland – Birragubba Country. My people, have of course, enjoyed an undocumented existence for many thousands of years prior to being “accounted for” in the Colonial/Eurocentric record books. Acknowledgement It is appropriate that I now take a formal moment in acknowledgment of the cultural authorities that provide for our safe gathering here this evening. That cultural authority rests, completely, with the traditional peoples of (that which is now) the greater Brisbane area: The Turrbal Peoples north of the Brisbane River, The Jaggera & Ugarapul Peoples south of the Brisbane River, The Manangahalli, to the south east, The Minjerriba of Stradbroke Island, The Ngugi of Moreton Island, and West across the mountains to the Undanbi.
