AN ORDINANCE APPROVING A TEMPORARY USE PERMIT FOR TWO BROTHERS , CO. – FOR THE LOVE OF HOPS FESTIVAL (30W315 CALUMET AVENUE)

WHEREAS, Two Brothers Brewing Company (“Two Brothers”) desires to conduct the “For the Love of Hops” festival in the parking lot adjacent to the Two Brothers Tap House located at 30W315 Calumet Avenue in the City (“Property”) on Saturday, July 28, 2018 from 12:00 p.m. to 10:30 p.m. (“Event”); and

WHEREAS, Two Brothers submitted an application to the City of Warrenville for a temporary use permit ("Temporary Use Permit") to allow the Event on the Property in accordance with Sections 1.D.4 and 1.D.5 of the City of Warrenville Zoning Ordinance (“Zoning Ordinance”); and

WHEREAS, pursuant to Section 1.D.4 of the Zoning Ordinance, temporary use permits may be issued administratively by the Director of Community and Economic Development for temporary events satisfying certain criteria, including that the event be conducted between 8:00 a.m. and 8:30 p.m. Sunday through Thursday and between 8:00 a.m. and 10:30 p.m. Friday through Saturday; and

WHEREAS, pursuant to Section 1.D.5 of the Zoning Ordinance, temporary use permits may be issued for other uses by the City Council; and

WHEREAS, Two Brothers’ application was referred to the Plan Commission of the City of Warrenville ("Plan Commission"); and

WHEREAS, at its regularly scheduled meeting on May 24, 2018, the Plan Commission heard testimony and received evidence with respect to Two Brother’s application and unanimously recommended approval of the Temporary Use Permit subject to certain conditions; and

WHEREAS, pursuant to the City’s home rule powers, the Mayor and the City Council have determined that it is in the best interest of the City and the public to approve the Temporary Use Permit in accordance with the provisions of this Ordinance;

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF WARRENVILLE, DU PAGE COUNTY, , AS FOLLOWS:

SECTION 1: Recitals. The recitals listed above are incorporated in this Ordinance as if fully set forth in this Ordinance.

SECTION 2: Temporary Use Permit. Subject to and contingent upon the conditions, restrictions, limitations and provisions set forth in Section 3 of this Ordinance, the City Council approves the Temporary Use Permit for Two Brothers to allow the Event on the Property.

SECTION 3: Conditions. The Temporary Use Permit approved in Section 2 of this Ordinance shall be, and is hereby, expressly subject to and contingent upon the following conditions, restrictions, limitations, and provisions:

1 A. Compliance with Application Documents. The Event must be conducted in accordance with the following Application Documents:

1. The Temporary Use Permit Application, signed by Allison Fowler on behalf of Two Brothers, and dated May 8, 2018 (“Temporary Use Permit Application”);

2. The Event Map, submitted by Two Brothers as part of the Temporary Use Permit Application; and

3. The Temporary Use Permit Addendum, submitted by Two Brothers as part of the Temporary Use Permit Application.

B. Fence and Tent Permit. Two Brothers shall apply for and receive a building permit to install a temporary fence and tent structures.

C. License. Two Brothers shall apply for and receive a Class “D” Liquor License for the sale and service of during the Event.

D. Vehicular and Pedestrian Access. Parking lot drive aisles, fire access routes, pedestrian walkways, and handicapped parking spaces must not be obstructed at any time during the Event.

E. Signs. All signage associated with the Event shall meet the requirements of the Sign Ordinance of the City of Warrenville.

F. Permitted Sound Level Requirements. Two Brothers must comply with the Permitted Sound Level Requirements set forth in Section 9.B of the Zoning Ordinance.

G. Refuse Removal. Two Brothers shall police and promptly remove all trash from the Event area and the surrounding neighborhood.

SECTION 4: EFFECTIVE DATE. This Ordinance shall be in full force and effect upon its passage, approval, and publication in the manner provided by law.

Calumet Avenue and Talbot Avenue, commonly known as 30W315 Calumet Avenue (the "Subject Property"). Due to serving alcohol at the event, a formal Temporary Use Permit approval by City Council is required in accordance with Section 1.D.4 Temporary Events of the Warrenville Zoning Ordinance.

ANALYSIS The submitted documents are the basis for the review comments included in this report. Copies of the submitted documents have been distributed to the Plan Commission/Zoning Board of Appeals with the May 24, 2018, agenda packets and are available on the City 5/24/18 CDD STAFF REPORT: TWO BROTHERS BREWING CO. website at http://il-warrenville.civicplus.com/DocumentCenter/View/8499 As proposed, the beer festival would be held in the parking lot on the west side of the building. The festival area would be enclosed with a fence and include two food tents and three beer tents. Live music would be played during the event. Packaged beer will also be sold inside the building, but not allowed inside the festival. A portion of the proceeds will be donated to Giant Steps of Lisle. Per the Applicant, approximately 3,000 visitors are expected throughout the day. Parking for the event would be accommodated on adjacent public streets and private parking lots on nearby properties. The Applicant obtained permission from the owner of MH Electric Motor and Control, to utilize their parking lot at 30W250 Calumet Avenue. The Applicant is working on securing additional parking lots. The Fire Protection District has reviewed the application and provided the review comments in Memo dated May 16, 2018. The Fire Protection District does not have concerns regarding the event. Upon consultation with various City departments, staff does not anticipate any significant traffic problems or unsafe parking situations would be created as a result of the proposed temporary event, provided that the event is conducted in accordance with the conditions outlined in this report. Based on the above-noted findings, staff recommends approval of the requested Temporary Use Permit subject to the conditions outlined in the Conclusion section of this staff report. According to the Warrenville Zoning Ordinance, the Plan Commission makes recommendations to the City Council on temporary use permit requests.

CONCLUSION: Based on the above-noted findings, staff recommends the Plan Commission recommends the City Council grant conditional approval of the requested Temporary Use Permit, which would allow Two Brothers Tap House to conduct a “For the Love of Hops” festival event in the parking lot located at 30W315 Calumet Avenue on Saturday, July 28, 2018 between 12:00 p.m. and 10:30 p.m. as described in the submitted Application, subject to the following conditions:

1. The event shall be conducted in accordance with the map and information provided with the application materials. 2. Parking lot drive aisles, fire access, pedestrian walkways and handicapped spaces shall not be obstructed. 3. All signage associated with the event shall meet the requirements of the Warrenville Sign Ordinance Regulations. 4. 5. The Applicant shall apply for and receive a building permit to install a temporary fence and tent structures. 6. The Applicant shall apply for and receive a Class “D” Liquor License for the beer sale/serving during the event. 7. The Applicant shall police and promptly remove all trash from the event area and surrounding neighborhood.
