Approval of minutes from the January 25, 2021 Common Council meeting. Motion by Kohl, seconded by Reekie, to approve the minutes of the January 25, 2021 Common Council meeting. Motion carried 7-0. 6. Mayor’s Business: None 7. Announcements: None 8. Administrator’s Report:  The Sustainability Task Force meeting will be held on February 15th.  Joint Review Board meeting will be held on February 23rd.  There will be a public informational meeting about the public park going in the site of the former New Century/Sugar Creak School sites on February 25th.  Upcoming Public Hearings: o Costco Precise Implementation Plan (PIP) o Prairie Oaks General Development Plan (GDP) o TID 9 o Amendment to Section 14-1-70(u)(9) of the Subdivision Ordinance  Alternate side parking is in effect until April 1st. Parking is prohibited from 1:00 a.m. to 6:00 a.m. on the even-numbered side of any public street on the odd-numbered calendar days, and on the odd-numbered side of the public street on the even numbered calendar days except as otherwise posted.  The Sustainability Task Force is meeting on a monthly basis to discuss sustainability

in the City. The first few meetings have included presentation from Department Head’s and Alliant Energy. The City has also launched a website to help the public find more information about being sustainable: https://www.ci.verona.wi.us/737/Sustainable-Verona  The Tourism Commission continues to meet on an as needed basis. Room tax collections have decreased significantly due to the pandemic. The Chamber is continuing to work with Discover Wisconsin on a promotional show to focus on the Verona area which is funded with room tax dollars.  The City recently received notice that the Verona Area School District (VASD) will not be entering into a Police Service Liaison Officer (PSLO) contract for the 2020-2021 school year. The VASD made the decision to finish the year without the PSLO and that is their choice. With or without an agreement, the Police Department is always willing to assist the VASD with any emergency or non-emergency needs or requests. The Verona Area High School is part of our community and we will respond to help them in the same manner as we would for any other community member(s). While we don’t have an agreement, the City remains available and willing to discuss a new PSLO agreement when the VASD is ready.  TID 6 – City Staff is exploring the feasibility of starting the closure of TID 6 which includes lands in Liberty Business Park and the Verona Technology Park. As part of closure review, Staff is looking to extend the TID to use tax increment to create an affordable housing. Once Staff has completed the analysis, a recommendation will be brought forward to the Common Council.  TID 9 – City Staff is working with Ehlers on a project plan amendment for Tax Incremental District No. 9. This amend involves extending the existing TID boundaries to include the redevelopment of the New Century/Sugar Creek School property. This amendment will move forward in February and March.  City Staff continues to work on development agreements for Costco, Whispering Coves, and Morningside Boulevard. Staff anticipates some of these agreements moving forward in the near future. Staff also anticipates new phases for Kettle Creek North and the Woods at Cathedral Point being requested in 2021.  As a reminder, the City post development projects on the City’s website and the link is below. Non-residential projects that are currently under construction include Epic, MillipoerSignma, KSW Construction, Cleary Building Corporation, and Oakmont Senior Living. Single-family building permits are being issued in Hometown Grove, Kettle Creek North, and the Woods at Cathedral Point. To date, the City has issued ten (10) permits for new homes. In 2020, the City had issued one (1) permit in the same period.  The City is in the process of recruiting for a new City Clerk, the application deadline is February 14th. Both the City Administrator and Human Resources Coordinator are working together on this recruitment. Details of the recruiting process are being coordinated with the Chairperson of the Personnel Committee and will be shared

with the Common Council in the near future. The City has received between twenty and thirty applications to date.  There is an election on February 16th and the only item on the ballot is the State Superintendent of Public Instruction. Absentee ballots were mailed out on January 26th and sent out daily as requested. As of Feb. 5th, the City has mailed out 962 ballots and received back 114 ballots. In person voting is available from Feb 2nd through February 12th. All of the information can be found on the City’s website and additional information can be directed to the Deputy City Clerk. 9. Engineer’s Report: Alderperson Evan Touchett arrived. Eastside Interceptor  Traffic Control o Bruce Street is currently open to traffic. o Bruce Street will be closed again in the spring to complete permanent roadway construction and restoration. o Ice Age Trail is detoured to South Main Street to Military Ridge State Trail.  Tunneling o Tunnel/pounding operations are continuing to progress. o Depending on site conditions encountered, the interceptor sewer casing and pipe will be complete in the next couple of weeks. o Crews will then move to the force main crossing and begin tunneling operations. This will take about a month or so to complete. o A mailing was sent to adjacent properties on December 18, 2020.  Pipe installation o Gravity Sewer and MMSD Force Main are currently being installed between Bruce Street and South Main Street and are anticipated to reach South Main Street in the next couple of weeks. o Crews will complete the local connection just south of South Main Street, crossing Badger Mill Creek. o After the creek crossing and temporary creek restoration, crews will begin pipe installations on the north side of South Main Street and work toward Melody Circle connection area. o Dewatering and pipe preparation operations are planned in the next couple of weeks, north of South Main Street to the Melody Circle connection area, ahead of starting pipe installation.  Clearing o The remainder of the clearing north of South Main Street has been completed or will be completed shortly. Once clearing is completed, silt fence installation will immediately follow.  Dane County work o Majority of the work will take place next summer.

Major Design Projects  Lincoln Street Stormwater Facility Design: The 100% design documents are finalized. The project will be advertised for bids on February 4th and 11th, 2021, with bid opening of February 24, 2021. The Public Information Meeting for the project has been scheduled for February 24, 2021 at 5:30 p.m. via Zoom. A mailing was sent out to adjacent property owners the week of February 5, 2021 notifying them of the Public Information Meeting. The Verona Press is anticipating an article in the February 11th release after an interview with project staff on February 2nd. As the project nears the start of construction, project staff will engage the Verona Press to release an article on the project.  N. Main Street Water Main Replacement Design: The 100% design documents are finalized. The project will be advertised for bids on February 4th and 11th, 2021 with bid opening of February 24, 2021. Jacobson met with VASD staff on January 26, 2021 to present the project overview and details. Construction is set to occur in mid-June to mid-August to minimize impacts to VASD operations. The date of the Public Information Meeting is not set yet but is anticipated to occur in early March. Also, as the project nears the start of construction, project staff will engage the Verona Press to release an article on the project. In-house Design Projects  2021 Asphaltic Street Rehabilitation Project: The 2021 Asphaltic Street Rehabilitation Project will consist of repaving Locust Drive from the 18/151 bridge to Bruce Street and Prairie Heights Drive from Locust Drive to CTH M. The project will include pavement surface mill and overlay, as well as spot replacement of curb and gutter, spot replacement of concrete sidewalk, and spot driveway replacement. The plans and specifications are completed and will be advertised for bids on February 4th and 11th, 2021 with a bid opening of February 24, 2021. The date of the Public Information is not set yet but is anticipated to occur in early

April. As the project nears the start of construction, project staff will engage the Verona Press to release an article.  2021 Pavement Surface Treatment Project o The 2021 Pavement Surface Treatment Project will consist of a granite chip seal for the following streets: . Plan Commission (1) Discussion & Possible Action: Resolution No. 21-003 approving a conditional use permit to allow a drive-thru COVID-19 testing site located at 509 West Verona Avenue The Plan Commission held the required public hearing on February 1, 2021 and discussed the project. The Plan Commission voted 7-0 to recommend approval of the conditional use permit with the following conditions: 1. Traffic on the site shall be one-way for both the entrance and the exit. Traffic shall exit through the eastern most driveway and all traffic shall enter at the wester most driveway. Motion by Kohl, seconded by Kemp, to approve Resolution No. 21-003 approving a conditional use permit to allow a drive-thru COVID-19 testing site located at 509 West Verona Avenue. Motion carried 8-0. (2) Discussion & Possible Action: Resolution No. 21-004 approving a certified survey map to create two (2) lots at 841, 905, and 927 North Main Street The proposed certified survey map would create two (2) lots from the existing three (3) lots at 841, 905, and 927 North Main Street. The Plan Commission voted 7-0 to recommend approval of the certified survey map to create two (2) lots at 841, 905, and 927 North Main Street.

Sustainability Task Force (1) Discussion and Possible Action: Resolution No. 21-005 supporting the City of Verona becoming a supporter of the Dane County Climate Action Plan in an effort to reduce greenhouse gas emissions as a region The proposed Resolution would make the City a supporter of the Dane County Climate Action Plan (CAP). The 2020 CAP was created to provide a science-based strategy to reduce greenhouse gas emissions and address ways the climate is already changing. As a supporter, the City will have access to ideas, technology, and pros/cons to strategies on how to reduce climate change from other supporters.

The Sustainability Task Force discussed the Resolution on January 27th and voted 6-0 to recommend approval of the Resolution supporting the City of Verona becoming a supporter of the Dane County Climate Action Plan. Motion by Ryan, seconded by Reekie, to approve Resolution No. 21-005 supporting the City of Verona becoming a supporter of the Dane County Climate Action Plan in

Elections

An election was held on February 16th, the only item on the ballot was the State Superintendent of Public Instruction. A total of 990 people voted in the City, 568 people voted absentee and 422 voted in-person at the polls.

City Clerk The application deadline for the vacant City Clerk position has been extended. The position will remain posted until filled and Staff will provide a first review of applications on March 1st. Staff is extended the deadline in hopes of received additional qualified applicants. Staff did make some minor changes to the position description in hopes of obtaining more applicants. Both the City Administrator and Human Resources Coordinator are working together on this recruitment. Details of the recruiting process are being coordinated with the Chairperson of the Personnel Committee and will be shared with the Common Council in the near future. CONSTRUCTION PROJECTS

EASTSIDE INTERCEPTOR Project includes construction of a new City‐owned sanitary interceptor and Madison Metropolitan Sewerage District (MMSD) Force Main.

 Traffic Control o Bruce Street is currently open to traffic. o Bruce Street will be closed again in the spring to complete permanent roadway construction and restoration. o Ice Age Trail is detoured to S. Main Street to Military Ridge State Trail.  Tunneling o Tunneling/pounding operations are continuing to progress under S. Main Street. o The interceptor sewer casing and pipe has been completed. See Figure 1 for completed casing and pipe installation. o Crews are moving to the force main crossing and beginning tunneling operations. Main Street and working in the Badger Mill Creek horseshoe area. This work is anticipated to last a couple of weeks. o Crews will then resume MMSD Force Main installation. 1. They will first complete the remaining portion south of S. Main Street. 2. Next, they will complete the segment north of S. Main Street through the Badger Mill Creek horseshoe area. 3. Finally, when the tunneling is completed under Main Street, the force main will be connected to previously placed force main. o Dewatering and pipe preparation operations are planned ahead of pipe installations from the Badger Mill Creek horseshoe area to the Lincoln Street Bridge area.  Dane County Work o Majority of the work will take place this summer (2021).  Neighborhood Information Meeting o Was held on January 13, 2021 by project staff and was well attended. o The presentation and figures are posted on project website.

MAJOR DESIGN PROJECTS

LINCOLN STREET STORMWATER FACILITY DESIGN The project is currently out to bid with the bid opening scheduled on February 24th, 2021. The Public Information Meeting for the project has been scheduled for February 24, 2021 at 5:30 p.m. via Zoom. A mailing was sent out to adjacent property owners the week of February 5th, 2021 notifying them of the Public Information Meeting.

A front page “below the fold” article appeared in the February 11th, 2021 edition of the Verona Press. The Headline was “Pond of a different ‘magnitude’ ”.

A mandatory Pre‐bid meeting was held on February 16th, 2021. Representatives from eight different contractors attended the meeting.

BADGER MILL CREEK RESTORATION DESIGN Mr. Walker and Mr. Jacobson meet virtually with Trout Unlimited on February 4, 2021 to discuss the project and what input and/or assistance that they can provide.

Mr. Jacobson had a kickoff meeting with the design consultant on February 8, 2021. Mr. Jacobson and the design consultant met with WDNR staff on February 18, 2021 to discuss the project goals, challenges, permit requirements, and what WDNR envisions for the stream that can be incorporated into the design.

Next steps are to take the information from the above meetings and prepare preliminary plans. Once preliminary plans are prepared, staff will post information on a project website. The public will be able to provide comments on the preliminary plans. Updates on this project will be provided at the monthly neighborhood meetings for the interceptor project.

CTH M / CTH PB INTERSECTION DESIGN Design consultant has been engaged by project staff to commence with the engineering plans. Field survey has been substantially completed.

2021 CONCRETE STREET REHABILITATION PROJECT The 2021 Concrete Street Rehabilitation Project will consist of repairing and replacing deteriorated concrete pavement on West Verona Avenue from Westridge Parkway to Epic Lane. Finance Committee

1. Discussion and Possible Action Re: Resolution No. 21-006 approving a Tax Increment District (TID) Affordable Housing Extension The proposed resolution will extend tax incremental District (TID) #6 for 1-year, allowing the City to use the last year of increment to improve the City’s housing stock. State Statute requires at least 75% of the final increment to benefit affordable housing with the remaining portion to be used to improve housing stock. The City does have the ability to use 100% of the funds towards affordable housing if the City chooses to do so in the future.

If the resolution is approved, the life of TID #6 will be extended for 12-months to use the final year’s increment collected in 2022 from the 2021 tax roll to benefit affordable housing.

This item requires a roll call vote.

Public Safety and Welfare Committee

1. Discussion and Possible Action Re: Ordinance No. 21-973 amending Section 10-1-12 of the Code of Ordinances reducing the speed limit on Whalen Road The proposed Ordinance amendment will reduce the speed limit on Whalen Road between Old County Highway PB and Liberty Drive to 25mph. The speed limit east of Liberty Drive to a point 1,315 feet east will be will be 35 mph. The speed limit east of the point will be 45mph. Whalen Road has shared jurisdiction with the Town of Verona. Tentatively, the Town will change the speed limits to match the City’s changes on March 2nd.

2. Discussion and Possible Action Re: An application for a combination “Class B” Intoxicating Liquor and Class “B” Fermented Malt Beverages license from N+1 Coffee and Beer Bar, LLC, d/b/a N+1 Coffee and Beer, 507 Bruce Street, Suite 101, Verona, WI 53593, Jessica Laufenberg, Agent N+1 Coffee and Beer Bar, LLC currently carries Class “B” Fermented Malt Beverage and Class “C” Wine licenses. If this application is approved, the Class “C” Wine license will be replaced by a “Class B” Intoxicating Liquor license, which will allow for the service of any intoxicating liquor (vs. wine only). The current licenses will be surrendered to the City before the new licenses will be issued.

3. Discussion and Possible Action Re: A liquor license premise amendment for N+1 Coffee and Beer Bar located at 507 Bruce Street The property already has a 16’x50’ concrete patio. The applicant will be adding an enclosed fencing and entry area. The fencing would begin from the left side of the entry door to the café (if looking at the building). There would be a one-way swinging door to enter the fenced patio area. On the opposite end of the fenced patio area (east side) there would be a second one-way swinging door for emergency exit. Video monitoring of the patio area would be set up in 4 locations (shown by X in the site plan). A conditional use permit was approved for the premise area in 2018 and the conditions from the 2018 conditional use permit are included as conditions for the premise amendment. The 2018 conditions were:

1. The outdoor patio fencing shall be a minimum of 48 inches tall. 2. Alcohol consumption shall be limited to the fenced area around the outdoor patio or inside the building. All areas where alcohol is consumed shall be monitored by Staff. 3. The fence and gate for the outdoor patio shall comply with the requirements from the Police Department and Building Inspector. 4. The exit for the patio shall be labeled as an “exit only”. 5. The use of the outdoor seating rea is permitted to operate from 7:00 a.m. to 10:00 p.m. seven (7) days per week. 6. The Applicant shall obtain all necessary alcohol licensees and operate in conformance to the requirements of the licensees.

Public Works/Sewer and Water Committee

1. Discussion & Possible Action: Change order no. 1 for Project ID 2018-108 Eastside Interceptor Replacement Change order no. 1 for the eastside interceptor project is for a reduction in work associated with Project B. Project B is all Dane County prepared and financed work. Dane County staff has reviewed and signed the change order per the Intergovernmental Agreement. The City of Verona is the lead on the project and owner of the contract with the contractor.

• Reduction of invasive species removal area within project limits. • Change in unit price due to density of works zones and level of efforts.

The contract notes are as follows: • Contract award value = $7,761,804.60 • Change order No. 1 = ($31,620.00) (deduct) • Contract value after incorporating this change order = $7,730,184.60

2. Discussion & Possible Action: Change order no. 2 for Project ID 2018-108 Eastside Interceptor Replacement Change order no. 2 for the eastside interceptor project is for addition work required to facilitate construction of the sanitary sewers in Bruce Street, re-mobilization for clearing operations, and additional erosion control best management practices to be used throughout construction.

Work changes are noted as follows:

 Window an existing 12-inch water main over the proposed force main, water main was deeper than anticipated based upon records in this area. Work also included adding a 12-inch valve.  Replace a 34 inch x 53 inch storm sewer apron endwall, the existing endwall was cracked. This was a material costs only.  Added additional erosion control measure to be used in the field above anticipated plan erosion control measures included with the bid. This provides field staff more resources to be used in the field to fit site conditions.  Re-mobilization and de-mobilization of clearing and grubbing equipment for the land just north of S. Main Street that was not acquired until January 2021.

The contract notes are as follows:  Contract award value = $7,761,804.60  Previous change orders = $31,620.00 (deduct)  Change order No. 2 = $37,925.00 (add)  Contract value after incorporating this change order = $7,768,109.60

3. Discussion & Possible Action Re: Resolution R-21-007, Accepting Public Improvements adjacent to Verona Area High School The public improvements have been substantially completed as of September 24, 2020. Punch list items have been addressed and staff recommends the City of Verona accept the newly constructed portions of the listed streets and/or intersections below and the associated water main and storm water infrastructure.

Sustainability Task Force

1. Discussion and Possible Action Re: Resolution No. 21-008 establishing a City designee to comment on dockets before the Public Service Commission of Wisconsin The proposed resolution would allow the Mayor to comment on dockets before the Public Service Commission of Wisconsin (PSC). This will allow comments to be submitted to the PSC without calling special meetings for the Common Council to discuss the City’s position on dockets before the PSC. By approving the resolution, the Mayor can file public comments on behalf of the City in support of renewable energy projects and other dockets before the PSC that further the goals of the 2019 Sustainability resolution.

The Sustainability Task Force discussed the resolution on February 15, 2021 and voted 5-0 to recommend approval.

Tax Incremental District (TID) Affordable Housing Extension Resolution City of Verona Tax Incremental District 6 Resolution No. _____

WHEREAS, the City of Verona created TID 6 on May 8, 2000, and successfully completed implementation of the project plan and sufficient increment was collected or will be collected in 2021 from the 2020 tax roll to pay off its aggregate project costs; and

WHEREAS, state law requires termination of a TID after all project costs have been paid, and state law (sec. 66.1105(6)(g), Wis. Stats.) does allow extension of a TID up to one year, using the last year of tax increment to improve the City’s housing stock; and

WHEREAS, at least seventy-five (75) percent of the final increment must benefit affordable housing with the remaining portion used to improve housing stock; and

THEREFORE BE IT RESOLVED, that the City of Verona hereby extends the life of TID 6 for twelve (12) months to use the final year’s increment collected in 2022 from the 2021 tax roll to benefit affordable housing; and

BE IT FURTHER RESOLVED, the City of Verona shall use the final increment to improve housing quality and affordability by paying at least seventy-five (75) percent of the increment collected in 2022 to assist affordable housing projects that have been awarded low-income tax credits from the Wisconsin Housing and Economic Development Authority or to assist other affordable housing projects that satisfy the requirements of the Wisconsin Statutes, and shall use any remaining amount to improve housing stock; and

BE IT FURTHER RESOLVED, that the City of Verona Clerk shall notify the Wisconsin Department of Revenue by providing a copy of this resolution.

3801.0112 (CO.02.01) = Conflict with existing 12-in Water Main and new 24-in Force Main at the Bruce Street Crossing (near Sta 602+50) per field offset measurements during installation. Portion of existing water main was required to be off set over new force main by approx. 1.1-ft to achieve 6-in of separation between off set existing water main and new force main. Pricing included new water main and fittings required to offset water main. Receipt of material attached and crew time per rate sheet was tracked (see attached).

3803.0112 (CO.02.02) = A new water valve and box was required and installed as part of adding Item 3801.01 (CO.02.01). See above discussion.

2522.2634 (CO.02.03) = At SE quadrant of Bruce Street and Badger Mill Creek an existing apron endwall and some associated storm sewer pipe was removed and replaced at Minger’s expense to facilitate new gravity sewer installation. The existing apron endwall was previously damaged prior to removal and Staff requested that the endwall be replaced. Price is material costs only – see attached price.

1628.7504 (CO.02.04) = During project erosion control inspection by City Staff, Dane County, and WDNR temporary ditch checks were needed in addition to plan erosion control. These will be utilized at silt fence reliefs, in ditch drainage areas, down stream and up stream of culverts, as well as other areas deemed necessary. Price submitted includes 3-in to 6-in clear stone and to be installed per Stone Velocity Check as detailed in the plan details. Unit price justified due to the location of the temporary ditch checks and limited access to these area. Material is required to be tracked and hauled using loader or skidsteer for installation. Added item quantity is an estimate for final plan quantity. Quantity paid will be based on field measurements.

CO.02.05 = Acquisition of property through the proposed work zone from approximate Station 621+50 to approximate Station 623+50 was not completed during initial clearing and grubbing operations. Clearing and grubbing subcontractor required to re- mobilize to the site to complete this area once property was acquired. Price based on the required equipment costs to be delivered to the site and then to be removed from the site (see attached).

A RESOULTION ACCEPTING PUBLIC IMPROVEMENTS ADJACENT TO

VERONA AREA HIGH SCHOOL

WHEREAS, the Common Council approved a development agreement for the public improvements at the Verona Area High School that was dated May 7, 2018 and recorded under document 5414123 on June 5, 2018.

WHEREAS, the contractor for the public improvements project adjacent to the Verona Area High School has substantially completed the work as of September 24, 2020; and

WHEREAS, the Public Works Department has reviewed the status of the public improvements and recommends the City of Verona accept the newly constructed portions of the listed streets and/or intersections below and the associated water main and storm water infrastructure; and

Public Improvement locations:

1. Stewart’s Woods Road (and bridge) 2. Wildcat Way (and bridge) 3. W. Verona Avenue (between West End Circle and Nine Mound) 4. Westridge Parkway sidewalk 5. S. Nine Mound (between W. Verona Avenue and Stewart’s Woods Road) 6. West End Circle (between Wall Street and Wildcat Way) 7. Wall Street 8. Intersection improvements, traffic signals and lighting at intersection of W. Verona Avenue and West End Circle 9. Intersection improvements, traffic signals and lighting at intersection of W. Verona Avenue and Nine Mound Road 10. CITY DESIGNEE TO COMMENT ON DOCKETS BEFORE THE PUBLIC SERVICE COMMISSION OF WISCONSIN

WHEREAS, the City of Verona (City) recognizes that climate change is at a critical stage that is increasingly impacting human health and well-being, ecosystems, and our economy, and that the City can help lead the way to carbon neutrality for our residents and businesses; and,

WHEREAS, the City should strive to obtain its energy from renewable energy technologies and resources at a reasonable cost; and,

WHEREAS, achieving these energy goals will require concerted action from individuals and the community, in urban and rural areas county-wide, from local and state governments, and from businesses and utilities; and,

WHEREAS, the City will continue to support and add to the to-do list in the 2019 Sustainability Resolution to make our community more resilient and combat climate change; and,

WHEREAS, the City recognizes that it is in the City’s best interest to support renewable energy projects in dockets before the Public Service Commission of Wisconsin (Commission) and to support other dockets before the Commission that further the goals in the 2019 Sustainability Resolution; and

WHEREAS, the City can support the renewable energy projects and other dockets before the Commission that further the goals in the 2019 Sustainability Resolution through the filing of public comments; and

WHERAS, the City recognizes the importance of participating in Commission dockets but also recognizes that the City of Verona Common Council will not have time to meet to discuss the City’s position on all dockets before the Commission; and

WHEREAS, it is the City’s best interest to designate one person to file public comments on behalf of the City in support of the renewable energy projects and other dockets before the Commission that further the goals in the 2019 Sustainability Resolution; and

Whereas, on February 15, 2021 the City of Verona Sustainability Task Force reviewed the Resolution for a City designee to comment on dockets before the Public Service Commission of Wisconsin and voted 5-0 to recommend approval; and

NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Verona authorizes the City of Verona Mayor to file public comments on behalf of the City in support of the renewable energy projects and other dockets before the Commission that further the goals in the 2019 Sustainability Resolution.
