13 We'll move on to item number 3. That's public

14 comment. I do have one request to speak from

15 Ms. Marilyn Brainard.

16 MS. MARILYN BRAINARD: Good evening,

17 Commissioners. My name is Marilyn Brainard.

18 And I'm just here very briefly to applaud the

19 planning of the Pioneer Meadows project. That's number

20 10 on your agenda. But I don't really feel that I need

21 to stay for that. I just wanted to say, as a former

22 Parks and Recreation Commissioner for this fine City

23 many years ago, I think, it's wonderful that you are

24 combining the parks, that you are having two instead of

25 three smaller parks in the planning year's plan. I

1 think, it speaks very well.

2 I live in Wingfield Springs. And we have, I

3 happen to live by the largest one of our neighborhood

4 parks, Pelican Park. But the rest of them are small

5 parks. And I think that our youth deserve especially,

6 and the adults do, but the youth, team activities.

7 That's, you know, what that they really enjoy. And it's

8 not possible in our very small neighborhood park.

9 So, I think, it's a much better use of the

10 land. And I certainly hope no one would oppose that

11 idea. And I just think it's very forward-thinking.

12 And, I think, at the time that it's really very

13 appropriate.

22 That'll get us into the meat of our agenda, our

23 public hearing items. The first up is going to be

24 PCN18-0068. This is a request to amend the existing

25 Special Use Permit SP050011 to allow for the operation

1 of a transportation passenger terminal at Centennial

2 Plaza.

3 So we'll turn this one over to staff.

4 MS. MELBY: Good evening, Commissioner Carey

5 and Planning Commission. I'm Karen Melby. I'm

6 Development Service Manager.

7 Before you tonight is a request for a

8 conditional use permit to amend Special Use Permit

9 SP050011 to allow for a transportation passenger

10 terminal on a site approximately 2.6 acres located at

11 1421 Victorian Avenue, or also known as Centennial

12 Plaza.

13 You can see here on the vicinity map, it's this

14 property outlined in cyan along on Victorian Avenue.

15 This request for the approval of the

16 conditional use permit as an amendment, as I stated, to

17 the existing special use permit to allow Greyhound

18 Lines, Inc. to operate an intercity or interstate

19 service on this property.

20 In 2005, SP05001, I mean 011, was approved by

21 the City of Sparks with 14 conditions of approval to

22 allow the RTC, or Regional Transportation Commission, to

23 develop Centennial Plaza.

24 According to the 2005 special use permit

25 application and staff report, Centennial Plaza was

1 intended to provide connections to local bus service.

2 It was constructed with 15 bus bays, employee parking,

3 and a 12,814-square-feet building, with approximately

4 2,000 square feet for retail space serving the transfer

5 facility.

6 Centennial Plaza was designed and approved as a

7 facility for the RTC's regional bus service. Centennial

8 Plaza functions as a local bus transfer station,

9 enabling RTC customers to make connections between

10 arriving and departing from Centennial Plaza or to

11 connect RTC transfer stations in downtown Reno to access

12 other RTC buses, routes departing from that facility.

13 RTC staff indicates that the transfer center

14 currently serves 8 buses per hour, with a standard

15 design to serve up to 40 buses per hour.

16 Here is the site plan. As you can see, shown

17 in blue here, this would be the area that Greyhound

18 would be taking, and this would be the two bays on the

19 site plan.

20 While there are certainly RTC passengers who

21 begin or conclude their bus travel at Centennial Plaza,

22 special use permit, the special use permit was approved

23 based on the belief that the vast majority of RTC

24 passengers would arrive and depart from this facility by

25 RTC bus.

1 RTC has entered into an agreement with

2 Greyhound to lease two bus bays and approximately 1,200

3 square feet of retail space for their ticket office, for

4 Greyhound's ticket office and waiting area.

5 Greyhound schedules indicate that there are 5

6 buses arriving and 5 buses departing daily. Traffic

7 analysis conducted by the traffic engineer using actual

8 tube counts at the Reno facility in December 2018

9 counted 22 trips per day attributed to the buses, 12

10 from three employees and 46 from passengers, for a total

11 of 78 average daily trips in the Reno facility.

12 Greyhound indicates on average that there are 10

13 passengers per bus, resulting in an average of 100

14 passengers arriving or departing daily.

15 In October of 2018, the presentation at City

16 Council, Chief Operating Officer Bill Blankenship made

17 remarks acknowledging that the Greyhound passengers will

18 be picked up and dropped off by private vehicles,

19 including shuttle or share-riding services.

20 The traffic analysis prepared by Solaegui

21 Engineers observed on December 11, 2018 that a minimal

22 of 67 percent of the passengers were dropped off or

23 picked up by vehicles or shuttles.

24 City staff's primary concern regarding an

25 intercity or interstate bus terminal operating at

1 Centennial Plaza is the current absence of a designated

2 passenger drop-off or pick-up zone. Victorian Avenue,

3 adjacent to this Centennial Plaza, has two narrow lanes

4 with no on-street parking and no shoulder. Victorian

5 Plaza, which is this road here -- I'm sorry. I'm off.

6 Victorian Plaza's right here, which borders on the east

7 side, is also constrained.

8 The Sparks Police Department is concerned about

9 the obstruction of the streets by vehicles dropping off

10 or picking up passengers and the safety of pedestrians

11 exiting or entering vehicles. The City's transportation

12 Manager has stated that the passengers loading and

13 unloading needs to occur on-site at the Centennial Plaza

14 facility so as to not negatively impact the surrounding

15 streets.

16 The conditional use permit application

17 submitted by Greyhound proposes employee parking and

18 loading and unloading of passengers to occur on A

19 Street, public right-of-way. Staff reviewed the

20 proposal using A Street and expressed concerns. The

21 Transportation Manager stated that the loading or

22 unloading zone needs to be off the City right-of-way.

23 Centennial Plaza is one block from the Fire

24 Station 1, and the Sparks Fire Department objects to the

25 use of A Street for this purpose, because access to

1 A Street is via 16th, which is their access for ingress

2 and egress from the fire station. The fire station is

3 by far the busiest fire station within the City of

4 Sparks.

5 Installing a loading zone on A for Greyhound

6 would also compromise its access for the fire station,

7 for emergency access, when Victorian Avenue is closed

8 during special events.

9 Based on the concerns expressed by City staff,

10 RTC, which is the landlord for Greyhound, has submitted

11 a conceptual exhibits proposed location of the plan for

12 on-site. You can see in this exhibit here, they're

13 proposing to put it along the south side of their south

14 driveway. They also submitted a conceptual plan showing

15 where they would put signage which would direct

16 passengers to this loading and unloading zone.

17 Condition 4 recognizes that federal and -- this

18 Condition 4 and 5 requires that the installation of this

19 passenger loading zone and supporting directional

20 signage and striping substantially is similar to this

21 Exhibit A and B. And it must be installed by May 31st,

22 is the date we're projecting for 2019.

23 Condition 4 also recognizes that federal and

24 state laws may require changes to the operation of

25 Centennial Plaza over time. As proposed, Condition 4

1 and 5 are written to allow RTC and also Greyhound to

2 modify, with the approval of the City Engineer, the

3 location of this loading zone within the Centennial

4 Plaza site and the corresponding signage if changes are

5 required to address the operational issues that maybe

6 arise at some time in the future.

7 Staff, City staff, including the City Engineer,

8 the Fire Chief and the Police Chief, are fine with these

9 Conditions 4 and 5 as submitted, and the revised

10 conditions that was submitted to you this afternoon.

11 Most importantly, having the loading and unloading

12 off-site is the main issue.

13 Regarding employee parking on A Street,

14 A Street does not qualify as frontage for Centennial

15 Plaza. However, Centennial Plaza is located within the

16 Victorian Square. And the need for employee parking can

17 be satisfied by the availability of the City-owned

18 parking lot facilities within Victorian Square.

19 Therefore, City staff is not proposing a

20 requirement of off-street parking as a condition of

21 approval and anticipates the need for parking is

22 mitigated by the additions of on-site and off-site --

23 the on-site loading zone.

24 Addressing the five conditional use permit

25 findings:

1 Finding C1, compliance with the Comprehensive

2 Plan. The use of this site as a transportation

3 passenger terminal for Greyhound would provide a

4 transportation mode for interstate travel, which is not

5 currently available within the City of Sparks,

6 supporting Goal C2.

7 Greyhound provides an alternative

8 transportation option not currently provided in the City

9 of Sparks, which supports Policy C9.

10 Finding C2, compatibility with the existing or

11 permitted uses. Centennial Plaza is located within the

12 Victorian Square area, which is the heart of downtown

13 Sparks. There is a mix of residential, gaming, bars,

14 restaurants, and various commercial land uses and

15 residential. The RTC transit facility is existing, and

16 adding Greyhound will provide an alternative

17 transportation mode within the City of Sparks. Adding

18 approximately 10 Greyhound buses per day is not

19 anticipated to adversely impact the surrounding land

20 uses, provided the impacts are being -- the impacts are

21 mitigated, or the loading zone is provided.

22 Finding C3, natural resource impairment. This

23 site was developed as Centennial Plaza in the year 2006.

24 City staff does not believe that approval of this

25 conditional use permit would impair the availability of

1 natural resources or the region's ability to support its

2 population.

3 Finding C4, which addresses identified impacts.

4 The identified impacts are the pick-up and drop-off

5 area, parking, and directional signs. All three of

6 these items I have previously discussed under the

7 analysis, and I won't repeat my information for that.

8 Addressing Finding C5, the public notice,

9 public notice was published in the Reno Gazette-Journal

10 on January 24th, 2019. We mailed 42 notices out to the

11 property owners within 500 feet of this property.

12 This afternoon, staff received one letter from

13 the Nugget's general manager in opposition to the

14 transportation passenger terminal, which has been

15 provided to you. I also received a phone call from a

16 property owner asking for clarification on this request

17 this afternoon.

18 Staff recommends approval with five conditions.

19 And we also have revised the conditions, which we

20 presented to you this afternoon. And so we are

21 recommending approval with the revision of the five

22 conditions. Or excuse me. This particular Condition 4

23 and 5.

24 This concludes my presentation, and I'm

25 available for any questions or comments.

2 Before I turn it over to the applicant, I just

3 wanted to, for the record, identify. We received a

4 revised staff report this afternoon. Could you please

5 highlight what those changes were in the staff report

6 and then maybe just highlight the new condition.

7 MS. MELBY: Okay. So what we did, when we

8 revised the staff report this afternoon, we included

9 acknowledgment of Exhibit A and, also, B. We talked

10 about that and recognize that.

11 And then, also, the revision to Conditions 4

12 and 5 is that we are saying these are conceptual, but --

13 I'm sorry. I flipped too far. The condition rewording

14 of 4 and 5, did you want me to read that, or?

15 CHAIRMAN CAREY: That's fine.

16 MS. MELBY: Okay.

17 CHAIRMAN CAREY: That's just fine like that.

18 MS. MELBY: But we referenced that it would be

19 conceptually referencing exhibits A and B.

20 CHAIRMAN CAREY: Okay.

21 MS. MELBY: And that was a change to the staff

22 report.

23 CHAIRMAN CAREY: Thank you very much.

25 MR. ORNELAS: I would just, to elaborate on

1 Ms. Melby's comment regarding Conditions 4 and 5,

2 essentially, basically, Conditions 4 and 5 were revised

3 to say that the loading zone and the directional signage

4 and striping will be installed per, you know,

5 subsequently similar to the exhibits that were provided.

6 There is flexibility in modifying, subject to City

7 Engineer approval, but the expectation is that unless

8 that occurred, they would be installed per those

9 exhibits, basically.

10 CHAIRMAN CAREY: Okay. Thank you. I

11 appreciate that, and for everyone at home following

12 along, how they did it.

13 Okay. At this time, I'll turn it over to the

14 applicant, the two gentlemen from Greyhound. You're

15 welcome to come up and provide a presentation. Our

16 Rules of Procedure limit the presentation to 15 minutes.

19 MR. ART ZOGLIO: My name is Art Zoglio. I'm an

20 attorney for Greyhound Lines. I have with me Rey Nunez.

21 He's the Director of Real Estate Development for

22 Greyhound Lines.

23 And I'll just turn it over to Rey for a brief

24 comment.

3 Yeah, we are thankful for being in Sparks.

4 We've been operating since late December. And we agreed

5 with what the staff has presented.

6 And we agree with the approval of the

7 conditions. However, in doing so, we're not waiving any

8 of our rights for the claims that are made in the

9 admission.

6 Could we pass that out and make that part of

7 the record.

8 Mr. Chair, Chairman, members of the Planning

9 Commission, I am J. Witt, Silverwing Development, as the

10 property owner of The Bridges, The Deco, Fountainhouse,

11 townhouse mixed-use, and the upcoming Atrium project,

12 along with five other parcels yet to be developed.

13 I take great issue with the findings or the

14 lack of information for its use.

15 When we acquired to develop, develop the

16 property, we relied upon the fact that Centennial Plaza

17 was only with bus services. This is supported by the

18 2005 SUP.

19 Per SOC Title 20, SUPs and CUPs must be

20 admitted to address impacts and strong requirements.

21 What is the City, RTC, or Greyhound doing to

22 address the uptick in property crimes and vagrancy we've

23 already experienced there in the last four weeks? It's

24 only going to increase during warmer weather.

25 The City's traffic is documented. While 46

1 percent of the passengers are being picked up, 33 are

2 simply leaving the station on foot. These are not our

3 tenants.

4 Passenger information from Greyhound says only

5 10 drivers per bus are departing from Victorian Square,

6 has never been verified by the City. So if not, why

7 not?

8 40 East 4th Street, Reno, is an empty

9 transportation facility a half a block away from the

10 bus facility where Greyhound departs for other

11 cities. Why is the station not being used?

12 Additionally, many with RTC and the City of

13 Reno have stated that the 4th Street station in Reno is

14 only at half capacity. And the Amtrak station was also

15 a viable option. However, in the end, Reno took issues

16 with each of these options. Why was Reno throwing up so

17 many hurdles? Has the Commission looked at the police

18 calls around the Greyhound terminal in Reno over the

19 last years? If not, it should. The numbers are high.

20 In Finding Number 1, the Comprehensive Plan

21 states the transportation network needs to support

22 business formation and economic vitality. I see

23 absolutely no connection between Greyhound's business

24 and the creation of economic vitality in the Victorian

25 Square area, right here.

1 We have more crime and vagrancy this last month

2 than we've had in the entire past four years. Is it a

3 coincidence that a bus facility was vandalized last

4 week?

5 Finding Number 2, the application is compatible

6 with adjacent properties. As a property owner, I could

7 tell you there's no compatibility between our lifestyle

8 and entertainment district and Greyhound's customer

9 base. They're not renting out apartments. They're not

10 patronizing our retail. And they're not coming to

11 attend a show.

12 If this application is allowed to proceed, you

13 could expect to see further increase in vagrancy and

14 property crimes. The SPD, which is already

15 overextended, will have more demands placed on it,

16 making it less available to other areas in Sparks.

17 Victorian Square will not find success in bringing

18 Greyhound into the area, with 33 percent of the

19 passengers simply walking out of the stations into the

20 shadows.

21 Greyhound risks the residual effect that some

22 aspect of the station's original costs were federally

23 funded. So the RTC has to provide reasonable access for

24 private carriers. But who's asking the question,

25 reasonable at what cost to the surrounding community?

1 I find the entire situation unreasonable. And

2 we should not be asked to bear the long-term cost of our

3 Washoe plan. Thank you.

14 COMMISSIONER FEWINS: Commissioner Fewins. I

15 have a question for the applicant.

16 Thank you for being here, gentlemen. The first

17 question is do you currently -- you've had a station in

18 the City of Reno for many years. Is that station still

19 open and running?

20 MR. REY NUNEZ: No, the former station was

21 closed upon relocation to Sparks. So we closed it on or

22 about December 28th or 29th. It's been vacant,

23 essentially, since then.

24 COMMISSIONER FEWINS: Okay. So you will not be

25 keeping that open, the Reno one?

1 MR. REY NUNEZ: No. That property was sold in

2 March of last year, and we were leasing it from March up

3 until the end of December.

4 COMMISSIONER FEWINS: Okay. So Sparks is the

5 main station. Now, would that be, would you consider an

6 uptick in the traffic with Sparks being the only

7 location, because you're not having -- you're just not

8 just having one, than what you had in Reno, or is it

9 going to be similar as far as the traffic?

10 MR. REY NUNEZ: Let me make sure I understand

11 your question. Are you suggesting if we're expecting an

12 increase in ridership?

13 COMMISSIONER FEWINS: Yeah.

14 MR. REY NUNEZ: That is, we think that could be

15 possible just based on the attractiveness of the

16 facility here. This Centennial Plaza is really a very

17 nice, nicely designed and well-located facility. And so

18 that was part of the attractiveness to the company as

19 well.

20 COMMISSIONER FEWINS: Is it monitored?

21 MR. REY NUNEZ: The facility in Reno used to

22 be. It had dormitories, which we don't have anymore.

23 And it was a training, it provided a driver training as

24 well. So it had some maintenance activities. We

25 amended those long ago, but the facility was -- the

1 square footage to support that was still there. It was

2 just vacant. And so it made it, we think, an attraction

3 for some of the homeless folks that tend to hang around

4 there, that it got associated with Greyhound.

5 And so that being the case, we expect, now

6 being a modern facility, that there could be, over time,

7 I think, just a little bit of an increase in ridership

8 just based on the quality of the facility.

9 COMMISSIONER FEWINS: Okay. Thank you.

10 CHAIRMAN CAREY: Are there any other questions

11 for the applicant?

12 COMMISSIONER READ: I have a question.

13 CHAIRMAN CAREY: Commissioner Read.

14 COMMISSIONER READ: Can you address some of the

15 concerns that Mr. Witt spoke of earlier?

16 MR. REY NUNEZ: Yeah. There was a comment

17 about crime. I'll address that. Unfortunately,

18 Greyhound gets sometimes unfairly targeted with being a

19 source of crime. And, what we have found is that

20 Greyhound is actually a victim often, because our

21 stations, like the one that we had in Reno, was large,

22 and we tend to be open, you know, through, in some cases

23 late into the night, early in the morning.

24 And in some cases, people are looking for

25 shelter, they're looking for restrooms. And if the word

1 gets out, hey, Greyhound's open at, you know, 11:00 p.m.

2 or late, then some folks are attracted to that. That

3 would be fine. So we're as much a victim on that. And

4 then, if something happens nearby, often the report will

5 say, you know, Greyhound, although it wasn't at the

6 Greyhound station, it was near the Greyhound station.

7 So we find that our name gets associated with that just

8 generally.

9 So, I think, that's an unfair -- I think,

10 that's an unfair categorization that there is

11 necessarily an uptick in crime.

12 And as far as the vandalization of the old

13 facility, well, it's vacant. Vacant properties, we all

14 know, just are. It's been vacant for -- you know, for

15 over a month now.

16 COMMISSIONER PETERSEN: Okay. It was the new

17 facility.

18 CHAIRMAN CAREY: Okay. Any other questions,

19 Commissioners?

20 COMMISSIONER VANDERWELL: Commissioner Carey?

21 CHAIRMAN CAREY: Go ahead.

22 COMMISSIONER VANDERWELL: I just have a

23 follow-up question on Commissioner Read's. And you're

24 talking about vagrancy and things like that. Does

25 Greyhound have security to maybe deter those types of

1 things?

2 MR. REY NUNEZ: We have worked with RTC.

3 They're providing a leased security. So RTC provides

4 the security for the station.

5 And there is a clause in the lease that if

6 there is a need for increased security, that the parties

7 will sit down, evaluate the data, and see what would be

8 the appropriate remedy for that.

9 CHAIRMAN CAREY: Okay. Rey, I had a question.

10 So, currently, what we see in our staff reports is about

11 five bus trips a day coming in, five coming out. Are

12 there any plans for future expansion at this time?

13 MR. REY NUNEZ: Well, the reality is that buses

14 carry 50. They have 50 seats. Right? And so, while

15 more folks can buy tickets, that assumes that bus is

16 getting that traffic. So we would have to kind of max

17 out those seats before, before we get to that point.

18 The other part that, I think, is mitigating

19 that is that we have recently entered into a

20 relationship with Amtrak. And so the Amtrak train is

21 actually transporting Greyhound passengers between here

22 and . And so we have actually reduced

23 some bus schedules because of that.

24 This collaboration that we entered into with

25 Amtrak, I think it was January of last year, where we

1 saw that as a win-win. As we collaborate with Amtrak

2 around the country, this was one of the more recent

3 examples of that. So in that case, that actually led to

4 a reduction in buses and passengers through that

5 partnership.

6 CHAIRMAN CAREY: And I'm curious, with leasing

7 two bays is what's proposed in the staff report. How

8 many, what would be the max number of trips you would

9 get from two bays, the amount of buses coming in and

10 out, with just two bays?

11 MR. REY NUNEZ: Yeah. Well, then you got to

12 get into capacity and demand, with your type of

13 question. But just conceivably, it just depends on the

14 dwell time.

15 CHAIRMAN CAREY: Okay.

16 MR. REY NUNEZ: You know, what I tell you is

17 we've got, you know, approximately five in, five out on

18 the weekends. There may be an extra one here or there,

19 because there's just more activity in the weekend.

20 But, I think, that's probably more a question

21 for RTC, just really in terms of capacity and that.

22 CHAIRMAN CAREY: I appreciate that.

1 COMMISSIONER BLACO: You just said that you --

2 sorry -- have that agreement with RTC to provide

3 security and that you would be revisiting what is being

4 done if there is some sort of increase in crime. What

5 exactly do you look at to make those decisions, and when

6 do you decide to revisit the security of that site?

7 MR. REY NUNEZ: Well, initially, the security

8 is provided by RTC. And that's part of our rent. We're

9 paying for that, essentially built into the rent.

10 And so I don't have the lease here in front of

11 me, but it was something to the effect that if there is

12 determined to be a need for more security, the parties

13 would sit down, look at the data, the property data, and

14 then formulate a plan.

15 COMMISSIONER BLACO: How exactly do you

16 determine the need for more security; is there a certain

17 threshold of instances of crime that it causes you to

18 revisit that, or is there any -- what exactly is the

19 policy for that?

20 MR. REY NUNEZ: It's just, I think, it's just

21 going to depend on -- I know, when we've looked at

22 things in the past, it could be something such as

23 determining where the concern is, what time of day,

24 sometimes more at night. And so perhaps maybe making

25 more coverage at night with more of a frequency, or an

1 additional person at night versus in the daytime.

2 So that's kind of one of the things we look at.

3 COMMISSIONER BLACO: So that's not something

4 that is scheduled to be looked at, you know, the --

5 MR. REY NUNEZ: Well, no, because if there's no

6 need, there's no reason to sit down.

7 CHAIRMAN CAREY: Okay. Now you guys are off

8 the hook.

9 Are there any questions for staff?

10 COMMISSIONER VANDERWELL: Commissioner Carey,

11 I've got a question.

12 CHAIRMAN CAREY: Okay. Commissioner

13 VanderWell.

14 COMMISSIONER VANDERWELL: I guess, what my

15 question is, is when you started with your presentation,

16 you said in 2005 RTC received a special use permit to

17 build Centennial Plaza. And then that special use

18 permit, it was connections to local bus services, for

19 local bus transfer stations, for RTC local bus routes.

20 So, I guess, what my question is, is RTC is

21 local, and Greyhound is cross-state. So in that special

22 use permit, is there a gray area or, you know, a way to

23 say, okay, well, it's no longer; you know, we can also

24 do interstate?

25 MS. MCCORMICK: Alyson McCormick, for the

2 The conditional use permit would be the process

3 to amend that special use permit. The City's view of

4 the existing special use permit is that if it were not

5 amended, it would not allow an interstate or intercity

6 bus use. But amending it through the conditional use

7 process, permit process would allow that use, because

8 that process provides an opportunity to review and

9 mitigate potential impacts from that change in use.

10 COMMISSIONER VANDERWELL: Okay. Thank you.

15 RTC. I did see Mr. Jickling is here in the audience.

16 I wonder if you could. I have a couple

17 questions for you.

18 David, welcome to the Sparks Planning

19 Commission.

20 MR. DAVID JICKLING: Thank you.

21 CHAIRMAN CAREY: My question was about capacity

22 at Centennial Plaza. As we've seen in the staff report,

23 it's the opinion of RTC that there is no capacity to

24 accommodate this use. I am wondering about, currently,

25 there's no passenger pick-up allowed on site. And, I

1 think, it's been that way since Centennial Plaza opened

2 up. I was curious about, you know, in your opinion,

3 about capacity of the proposed use and the proposed

4 unloading and loading area. Would that interfere with

5 the current bus service and potential future bus

6 service?

7 MR. DAVID JICKLING: David Jickling, Director

8 of Public Transportation for the RTC. Thank you,

9 Chairman Carey. Good questions.

10 As part of this process, through the federal

11 kind of review that we needed to do about capacity,

12 you're looking at both the 4th Street station and

13 Centennial Plaza to ascertain how much bus service we

14 are currently providing, how those schedules were

15 working, the bay capabilities that we had at both

16 facilities. And through that analysis, the conclusion

17 is 4th Street station did not have the capacity, but

18 Centennial Plaza did.

19 We had actually five bays of the existing, I

20 believe, 14 or 15 bays that we weren't using whatsoever.

21 And so right there was certainly opportunity for buses,

22 whether they be our service or someone else's, to

23 utilize those.

24 In terms of the question you had earlier about

25 capacity of the bay per hour, generally, we think about

1 15 minutes is about right. So four buses an hour in a

2 bay. And as Mr. Nunez mentioned, it really does just

3 depend on how long is that bus going to be there. If

4 your schedule is so efficient that the bus stops and

5 goes, you could have 40 buses in an hour. But most

6 times, you need some recovery and all of that for the

7 bus.

8 So we assumed, when we built this project, in

9 the original special use permit, that maximum capacity

10 would be each of those bays having four buses an hour,

11 basically 16 hours a day. So that's where those numbers

12 came from.

13 From a design standpoint, because it was such a

14 constraining site, and generally we prefer to keep

15 private vehicles separate from our transit vehicles, and

16 so that's why the original design and concept here did

17 not have any public access with vehicles onto the site.

18 Once Greyhound started operating, we did see

19 some -- obviously, there was some confusion amongst

20 folks coming and going. And it's pretty easy, just

21 during normal operations, we have people who sometimes

22 coming eastbound on Victorian, get confused and come

23 into our facility. So that is certainly something that

24 had happened periodically.

25 Our view was the best way to manage this and to

1 accommodate the request of the City of Sparks staff was

2 to come up with this passenger pick-up, drop-off lane

3 that we will mark through there. We've ascertained how

4 that would operate, and we're confident we can do that

5 without -- minimal conflict with our buses. And we

6 think that will work quite satisfactory in terms of

7 addressing the request of Sparks staff.

8 CHAIRMAN CAREY: Okay. Thank you very much,

16 know, again, it's --

18 MR. DAVID JICKLING: Open? Oh, no, there are

19 none open. Every one of those bays is occupied.

20 COMMISSIONER FEWINS: Okay. We heard testimony

21 from the applicants today that they have a partnership

22 with Amtrak. Is the 4th Street station in Reno closer

23 to the Amtrak station than Centennial Plaza?

24 MR. DAVID JICKLING: It is.

8 a motion, if we're ready for that.

9 COMMISSIONER FEWINS: I'd like to say a little,

10 have discussion on that. Commissioner Fewins here.

11 I have a problem with the motion or the

12 approval as it's coming forth for the conditional use

13 permit with this. I am having truly finding C1 in the

14 findings, particularly with Goal C2, that's saying that

15 it's providing a transportation network that supports

16 business formation and attraction and economic vitality.

17 I'm just not seeing how I can make that finding.

18 And, also, with C2. You know I think, in 2005,

19 when the special use permit, at that time -- now it's a

20 conditional use permit -- was made, that it said that

21 retail spaces could be leased out by RTC. And they even

22 pointed out things like just newspaper stands,

23 concession stands for the passengers at RTC for local

24 use.

25 And I'm finding that interstate use is not

1 compatible with the existing permitted uses and adjacent

2 properties. At the time, I think, in 2005, it was

3 tourist commercial down there, which it is no longer.

4 We are now a mixed-use development that is apartments to

5 the north and a lot of development that's happened to

6 downtown Sparks that has been great development for our

7 city.

8 I'm not saying that this use is going to, you

9 know, be horrible as a use there. But I just don't

10 think it is compatible with the existing mixed-use

11 development with the apartments.

12 I see local bus service as being a compatible

13 with the existing uses, because you are dealing with

14 people that are going to jobs, going shopping. They are

15 not, essentially, coming here from out of the state. To

16 where I see that a station that's been opened in Reno

17 where you have closer use to the current Amtrak, that

18 they have a partnership with, I am finding that I cannot

19 find the Finding C2 that staff had found.

20 So I will not be in favor of this conditional

21 use permit.

22 In addition, I thought the conditions were

23 written real well. And they are pretty well, I mean, I

24 believe that both parts in this case could recognize

25 these conditions and live with them. So I would kind of

1 be for this item.

6 I had one, just for the record. I will be

7 supporting the motion. Well, obviously, I seconded it.

8 But my -- you know, my main concern is I do, I do

9 certainly concur with staff, because of substantial

10 change from the original special use permit that was

11 approved in 2005.

12 I think, Centennial Plaza is a very important

13 asset to this community and to our Comprehensive Plan

14 and to meet our goals for transit and in the City.

15 My big concern with this proposed use is that

16 it doesn't conflict with the main and primary use of

17 Centennial Plaza, and that's local bus service. I

18 think, from a land use perspective, the proposed use

19 seems fine in that it's limited. It will be a secondary

20 use to the primary use of being a local transfer

21 station, or transit station.

22 I think, at this level that it's proposed,

23 that's acceptable. My big concern is that I wouldn't

24 want to see this proposed use becoming the primary use,

25 and it stays a secondary use, in order to protect

1 transit and to help promote our comprehensive land use

2 goals.

2 site outlined in cyan. It is a portion of the Aspen

3 Glen Shopping Center. This shopping center, the Aspen

4 Glen shopping Center is located in the Kiley Ranch South

5 Planned Development. That planned development handbook

6 specifically called out this site, the Aspen Glen

7 Shopping Center, as being subject to the use

8 requirements of C1, the neighborhood commercial zoning

9 district in the City of Sparks.

10 The applicant is proposing to occupy roughly

11 500 square feet. You can see here on the site map that

12 the applicant provided kind of the location of that

13 specific tenancy that they're proposing to occupy is

14 roughly 500 square feet located in the northeast corner

15 of that building.

16 The applicant currently owns and operates Smog

17 Monkey at 1564 Prater Way, and this would be a second

18 location for this business.

19 Emission testing would take place in the

20 parking space directly adjacent to the entrance, about

21 where the red car is on this site map. Emission testing

22 takes approximately three to five minutes, and only 1968

23 and older -- and newer, heavy-duty gasoline vehicles

24 require a two-speed test, as well as -- two-speed idle

25 test, as well as 1996 and older light-duty gasoline

1 automobiles. All newer light-duty automobiles do not

2 require the two-speed idle test.

3 The idle test will produce some noise, as

4 idling cars do, although this site is adjacent to Vista

5 Boulevard, which produces quite a bit more noise due to

6 traffic and so forth adjacent to the site.

7 The Comprehensive Plan land use for this site,

8 this location is C, which is Commercial. And the zoning

9 of C1, or Neighborhood Commercial, is in compliance with

10 that land use designation.

11 The site has existing and mature landscaping,

12 which does comply with Sparks Municipal Code Section

13 20.04.006, which is landscaping and screening.

14 Required parking for auto and truck repair,

15 light, per the Sparks Municipal Code, is one space per

16 500 square feet. The site has ample parking, and the

17 applicant's lease guarantees them two parking spaces.

18 And as this site -- the applicant's tenancy is only 500

19 square feet, this use would only require 1 parking space

20 per code.

21 Staff does believe that the parking allocated

22 for this use is adequate and complies with the parking

23 standards. We also did an evaluation of the parking

24 that's also inside of the site. Here's kind of a map

25 showing the other uses that are on the site.

1 The site has a total of 206 parking spaces,

2 which is more than adequate to meet the demand of 122

3 spaces that would be required based on the existing

4 businesses and the anticipated demand for the businesses

5 or vacant buildings on the site, plus the demand for

6 this new business.

7 Based on the transportation engineers, the

8 Institute of Transportation Engineers, this use would be

9 expected to generate no more than 40 average daily

10 trips, with a peak of 5.19 peak-hour trips. That is

11 well below the threshold that would require a parking,

12 or a traffic study.

13 Staff has received one email in opposition to

14 this item. That email was given to the Planning

15 Commission at the Study Session. It's also been posted

16 to the website as part of this item.

17 There are five findings associated with the

18 conditional use permit.

19 Finding 1 addresses compliance with the

20 Comprehensive Plan. The goals and policies of the

21 Comprehensive Plan that this request would support

22 include Goal MG1, which is to support economic vitality

23 by providing a non-residential land use base; Goal EV1,

24 to grow and diversify Sparks' economy; and Policy C4, to

25 require sidewalks for pedestrians on all street

1 networks.

2 This is a non-residential land use and provides

3 a service that's not available in the immediate

4 vicinity, which supports both goals MG1 and EV1.

5 The site has been developed since 2000, and

6 there are sidewalks throughout the interior of the site

7 and along the exterior on the road member.

8 Finding 2 addresses compatibility. The site is

9 adjacent to single-family residential on three sides,

10 kind of on the west here, the north, and then the east

11 across Vista Boulevard. And then to the south is the

12 remainder of the Aspen Glen Shopping Center.

13 Because there is adequate parking on the site,

14 and the expected traffic generation is low, the proposed

15 emissions testing facility should be relatively quiet,

16 and the site is located along a relatively busy street,

17 help mitigate the noise that it will create, City staff

18 views this proposal, or this proposed use as compatible

19 with the existing adjacent uses on the site, to the

20 site.

21 Finding C3 addresses impacts on the natural

22 environment. As stated, this site has been developed

23 since 2000. Staff does not believe that this use would

24 impair the availability of natural resources or the

25 region's ability to support its population.

1 Finding C4 looks at identified impacts. The

2 specifically identified impacts that staff saw on this

3 item were parking, traffic, noise, and another issue

4 about where the location of the testing unit would be.

5 I'll get into that.

6 As I mentioned, parking. Staff went through

7 that pretty detailed. And we believe its parking could

8 be easily met for this site.

9 Traffic. The traffic generation for this use

10 is very low and should be more than easily accommodated

11 by the location of this site.

12 Noise. Idle tests will generate noise, but not

13 nearly the amount of noise that's already going to be

14 generated off of Vista Boulevard, which has high speed

15 and it's already going to generate quite a bit of noise.

16 And then the smog unit location impact that we

17 addressed was just a concern that whatever cables and

18 cordage needed to run that smog machine which would be

19 brought out would not cross the sidewalk and produce a

20 tripping hazard condition. Proposed Condition of

21 Approval Number 3 addresses that and requires that that

22 be run in the landscaping so that it doesn't produce a

23 hazard.

24 And then, finally, Finding C5 requires proper

25 noticing. Public notice was published in the Reno

1 Gazette-Journal on January 24th. In addition, 86

2 notices were sent to all owners of property within 500

3 feet of the subject property on January 23rd. The

4 Planning Commission functions as the public hearing for

8 Planning Commission has.

5 PCN18-0070. This is a conditional use permit to allow

6 for a brewery at 305 East Glendale Avenue.

7 Jonathan, welcome.

8 MR. CUMMINS: Thank you, Mr. Chairman, Planning

9 Commissioners. I'm Jonathan Cummins, Planner.

10 PCN18-0070 is a request for a conditional use

11 permit to establish a brewery and tasting room on 4.82

12 acres at 305 East Glendale in the Industrial zoning

13 district. The property's outlined in cyan on the map.

14 Breweries are a lot of the Industrial zoning

15 district in the site complies with zoning codes,

16 locational criteria, as well as meeting the approval of

17 the Planning Commission on the conditional use permit

18 process to mitigate potential impacts that, essentially,

19 a nontypical use for the zoning district might have.

20 The proposed brewery includes 8,200 square feet

21 of manufacturing brewing space, 3,890 square feet of

22 storage and warehousing, 1,350 square feet of office

23 space, and a 1,300-square-foot tasting room where

24 customers will be able to both purchase and consume beer

25 on-site.

1 To address one of the questions from the

2 Planning Commission Study Session on Tuesday, a tasting

3 room would fit the zoning code's definition of a bar,

4 slash, lounge, which would require in the Industrial

5 zoning district that be limited from 6:00 a.m. to

6 midnight.

7 So the brewery overall will take up just over

8 10 or 12 percent of the overall site at 305 East

9 Glendale, in the area where the brewery is going to be,

10 this top section of the image here.

11 The applicant is allowed 34 parking spaces per

12 their agreement with the property owner. Per the uses

13 proposed in that breakdown that I gave you, the business

14 would require 13 spaces as well as what they're allowed

15 on-site.

16 Further, the City Transportation Manager has

17 evaluated the application and the 29 peak-hour trips

18 anticipated by the applicant's calculations, and concurs

19 with those numbers, considers them to be generally

20 acceptable for this use at this location.

21 Given the primary function of the size of the

22 manufacturing and warehousing facility, with only a

23 relatively small portion of the site to be used as a

24 tasting room open to the public for limited hours, staff

25 finds the proposed use to be compatible with the

1 surrounding uses.

2 Staff believes that the five findings for a CUP

3 can be made.

4 Finding C1 requires compliance with the

5 Comprehensive Plan. Staff believes that the proposed

6 use would contribute to Goal MG1, to provide economic

7 vitality by providing a non-residential land use base;

8 and Goal MG2, to foster diversity in the land use mix.

9 The proposed use would bring activity to the

10 Industrial district after usual hours of operation of

11 most businesses in the Industrial zoning district.

12 Finding C2 requires compatibility with the

13 surrounding uses. The majority of the site is used for

14 manufacturing and warehousing, matching the surrounding

15 and nearby uses. All surrounding uses are zoned

16 Industrial or categorized in the land use Comprehensive

17 Plan as Industrial as well.

18 Finding C3 addresses the impairment of natural

19 resources. The proposed use would be only to an

20 established site and would not be impacting natural

21 resources.

22 Finding C4 requires that staff and the Planning

23 Commission address any other identified impacts. The

24 Environmental Control office, the City's Environmental

25 Control office would regulate the use of grease

1 interceptors and other equipment that might be necessary

2 to dispose of unused product and spent grain.

3 The applicant is proposing a 9-foot-wide grain

4 silo to be established on the site. In that part of the

5 parking area here in the top corner, near the exit on

6 Glendale, that 9-foot silo would go there. And the Fire

7 Department's deemed that to be satisfactory in order to

8 get their fire engines on, on the site.

9 Staff received no comments from outside

10 agencies.

11 Finding C5 requires public notice. 60 property

12 owners within 500 feet of the site were notified on

13 January 23rd. Also, notice was published in the Reno

14 Gazette-Journal on January 24th. Staff received no

15 comment from the public on this item.

16 And staff believes the five findings can be

17 made and is recommending approval.

1 PCN18-0069. This is a request to amend the Pioneer

2 Meadows handbook.

3 Jonathan, welcome back.

4 MR. CUMMINS: Thank you, Mr. Chairman, Planning

5 Commissioners. Jonathan Cummins, Planner.

6 PCN18-0069 is a request to amend the final

7 approved plan for the Pioneer Meadows planned

8 development, to amend the approved plan, slash, handbook

9 for a 640-acre site.

10 The site is outlined in cyan on the map. It is

11 east of Kiley Ranch North, west of Wingfield Springs,

12 and south of Stonebrook planned developments.

13 The Pioneer Meadows handbook was adopted by the

14 City Council in 2000. It has since been amended three

15 times. This will be the fourth amendment of the

16 handbook.

17 On January 28th of this year, the City Council

18 certified the Comprehensive Plan amendments changing the

19 land use designations for approximately 10 acres in

20 Pioneer Meadows from CF, Community Facilities, to LDR,

21 Low Density Residential. I just want to see these,

22 clarify what those changes were. The 10-acre site, the

23 10.6-acre site was changed recently. It's outlined in

24 cyan on this map, in the top middle. The old

25 designation had that piece there listed as Community

1 Facilities, where a school and park were going to go,

2 and today it was, now had the rest Low Density

3 Residential.

4 So the applicant is seeking to amend the

5 handbook to conform to this new Comp Plan designation

6 and is also taking the opportunity to amend some

7 sections of the handbook that have been affected by the

8 change.

9 Overall, the proposed amendments include

10 changes of the land use, the land uses to match the

11 Comprehensive Plan: Updates the land use summary and

12 density tables; removal of the school site; a reduction

13 in the number of parks from three to two -- where there

14 were three smaller parks planned, there will now be two

15 larger parks planned for Pioneer Meadows; removal of

16 references to the Northern Sparks Sphere of Influence

17 Plan, which is no longer in effect; and other minor

18 administrative changes throughout the document.

19 There are 10 required findings, which staff

20 believes can be made by the Planning Commission.

21 Finding A, the amendment is consistent with the

22 City's Comprehensive Plan and the Truckee Meadows

23 Regional Plan and is otherwise consistent with Nevada

24 and federal laws. Staff finds the amendment contributes

25 to Goal H2 of the Sparks Comprehensive Plan to promote a

1 strong housing market in order to support economic

2 vitality and growth.

3 Finding B requires the amendment to be

4 consistent with the surrounding land uses. The proposed

5 amendment does not change the types of land uses within

6 Pioneer Meadows but does rearrange them a little bit in

7 order to better reflect the new land use designations in

8 the Comprehensive Plan.

9 Finding C requires that the amendment be

10 fiscally positive to the City. Requiring a handbook

11 amendment, it's less than 20 acres and therefore does

12 not trigger a fiscal impact analysis.

13 Finding D requires the amendment further the

14 mutual interest of residents and owners of the planned

15 development. Among other things, the changes will allow

16 the development of two large parks, which will advance

17 the parks department's efforts to create fewer but

18 larger parks, which can provide better services and

19 function more effectively for its residents over time.

20 Staff believes that this change, in addition to the more

21 low-density housing that will be added, would mutually

22 benefit current and future homeowners in Pioneer

23 Meadows.

24 Finding E requires the amendment not impair the

25 reliance of the residents and owners on the provisions

1 of the plan. The proposed changes are not expected to

2 make an impact on current and future owners.

3 Finding F requires the amendment will not

4 result in changes that would adversely affect the public

5 interest. The proposed changes are intended to

6 facilitate and improve the development of Pioneer

7 Meadows in a manner that is consistent with the new Comp

8 Plan land use designations and would not be detrimental

9 to the public interest.

10 Finding G requires the amendment is consistent

11 with the efficient development and preservation of the

12 entire planned unit development. These amendments are

13 intended to preserve the character of the approved

14 planned development and, in doing so, make it consistent

15 with new changes in the Comprehensive Plan.

16 Finding H requires that the amendment not

17 adversely affect the enjoyment of land abutting the

18 planned development. The land use pattern and street

19 network will remain generally the same as was originally

20 approved.

21 Finding I requires the amendment not grant,

22 solely grant or confer private benefit upon a person.

23 The proposed amendment is intended to rectify the loss

24 of the school site, which was outside the control of the

25 landowners, and bringing the land use pattern into

1 conformance with the City's Comprehensive Plan and

2 realigning the designated park sites is intended to

3 benefit current and future owners alike.

4 Finding J requires that public notice be given

5 and a public hearing held. Notice was mailed to 1,173

6 property owners within the Pioneer Meadows planned

7 development on January 23rd. Public notice was

8 published in the Reno Gazette-Journal on January 24th.

9 Staff did receive comments from about 10

10 property owners via telephone, email, and a handwritten

11 letter as well. The emails and the handwritten letter

12 have been provided to the Commissioners.

13 Staff believes the 10 findings can be made by

14 the Planning Commission and is recommending the Planning

15 Commission forward a recommendation of approval to the

16 City Council.

12 The first item is PCN04051. This is

13 consideration and possible approval on a request to

14 amend Condition 14 of the original Miramonte Tentative

15 Map.

16 Dani, welcome.

17 MS. WRAY: Thank you, Chair and members of the

18 Planning Commission. I'm Dani Wray, Planner I.

19 Firstly, staff apologizes, that we'd like you

20 to draw your attention to page 3, paragraph 2, line 4,

21 of your staff report. An error was erroneously made.

22 It referred to Vista Boulevard as Vista Heights Drive.

23 CHAIRMAN CAREY: Okay. Thank you.

24 MS. WRAY: This is a request to amend Condition

25 Number 14 of the Miramonte Tentative Map on a site

1 approximately 834 acres in size.

2 You'll see the area of the tentative map is

3 outlined in red. It's generally located east of

4 Los Altos Parkway between Belmar Drive and Vista Heights

5 Drive. The existing zoning is New Urban District.

6 there's no proposed changes to the existing zoning or

7 the land use plan.

8 The Miramonte planned Development handbook and

9 the Miramonte tentative map were approved back in 2005.

10 At the time of that approval of the tentative map, the

11 Regional Transportation Commission, or RTC, model called

12 for widening from two lanes to four lanes the section of

13 Los Altos Parkway from Belmar Drive to Vista Boulevard

14 when the final maps are recorded for 600 units in the

15 Miramonte tentative map area. That is, that area is

16 outlined in cyan, the effected portion of Los Altos

17 Parkway.

18 So Condition number 14 of the Miramonte

19 Tentative Map required a widening of Los Altos Parkway

20 to address the RTC standard for planned long-range

21 roadway changes and improvements.

22 As of the date of this staff report, final maps

23 have been recorded for 589 units, close to that 600-unit

24 trigger for Condition Number 14.

25 The RTC model, the 2040 Regional Transportation

1 Plan has since changed and no longer requires Los Altos

2 Parkway to be widened to four lanes. The applicant is

3 requesting that Condition Number 14, therefore, be

4 amended to comply with the current RTC model and

5 standards.

6 Amending that condition will not change the

7 number of approved lots in Miramonte, nor will it affect

8 the size, the layout, the design standards of any of the

9 existing or remaining lots. The requested amendment of

10 Condition 14 only affects the off-site improvements that

11 are required on Los Altos Parkway.

12 A traffic analysis was submitted by Traffic

13 Works that evaluated existing traffic and estimated

14 future demand based on approved land uses, both in the

15 Miramonte Planned Development and the other planned

16 developments that access Los Altos Parkway. The

17 analysis was performed when the 448-townhome subdivision

18 to the south of this project was approved back in May of

19 2017. This traffic analysis evaluated all existing and

20 proposed traffic impacts on Los Altos Parkway and

21 suggested a mitigation measure that was evaluated by RTC

22 and the City of Sparks.

23 The proposed mitigation measure is to extend

24 the westbound left turn lane pocket from 120 feet, as it

25 exists today, to 400 feet, which is shown on this

1 graphic, at the intersection of Los Altos Parkway and

2 Vista Boulevard. This mitigation measure will allow

3 Los Altos Parkway to operate at a level of service

4 LOS D, which is the standard LOS for Los Altos Parkway

5 currently required by RTC, the current level of service

6 at LOS C.

7 If approved, the amended Condition Number 14

8 would read: 14. Roadway improvement on Los Altos

9 parkway: The developer shall comply with the conditions

10 of the traffic study prepared by Traffic Works, dated

11 9-8-17, to include, without limitation, the left-turn

12 lengthening improvement on Los Altos Parkway, south, and

13 Vista Boulevard intersection, extending the westbound

14 left turn pocket on Los Altos Parkway to accommodate

15 400, plus or minus, feet of storage.

16 Staff requested comments from public agencies,

17 and the responses that were received have been

18 incorporated into the findings and the proposed

19 conditions of approval for this item.

20 Staff has confirmed with RTC staff by phone

21 that there have been no changes to the Regional

22 Transportation Plan, RTP, for this area since the date

23 of that letter.

24 A special plan review meeting was held on

25 January 24th with the applicant's representatives

1 present, as well as staff from engineering and the

2 Sparks Fire Department, and all parties are in agreement

3 with the proposed change to Condition 14.

4 Given that this proposed amendment to

5 Condition 14 would have no material effect on the

6 tentative map for Miramonte, other than to bring the

7 proposed mitigation measure for Los Altos Parkway into

8 compliance with the current RTC model, staff is in

9 support of amending Condition 14 to this effect. All

10 other conditions of approval from the original tentative

11 map shall remain the same and are included with this

12 approval.

13 It is the opinion of staff that Findings T1

14 through T12 can be found and are as follows:

15 Finding T1. Environmental and health laws and

16 regulations concerning water and air pollution, the

17 disposal of solid waste, facilities to supply water,

18 community or public sewage disposal and, where

19 applicable, individual systems for sewage disposal were

20 considered.

21 The amendment of Condition 14 will have no

22 impact on the existing compliance of the Miramonte

23 Tentative Map regarding environmental health laws and

24 water and air pollution, or the supply of water or

25 disposal of sewage and solid waste, Conditions 3 and 4.

1 Finding T2. The availability of water which

2 meets applicable health standards and is sufficient in

3 quality for the reasonably foreseeable needs of the

4 subdivision have been considered.

5 The amendment of Condition 14 will not impact

6 the existing compliance of the Miramonte Tentative Map

7 regarding the availability of water because the

8 condition pertains to off-site improvements,

9 Condition 3.

10 Finding T3. The availability and accessibility

11 of utilities has been considered.

12 The amendment of Condition 14 will not impact

13 the existing compliance with the Miramonte Tentative Map

14 regarding the availability and accessibility of

15 utilities.

16 Finding T4. The availability and accessibility

17 of public services such as schools, police protection,

18 transportation, recreation and parks has been

19 considered.

20 The amendment of Condition 14 will not impact

21 the existing compliance of the Miramonte Tentative Map

22 regarding the availability accessibility to public

23 services.

24 Finding T5. The request conforms to the

25 Comprehensive Plan and zoning ordinances.

1 The Comprehensive Plan Goals and Policies that

2 are relevant to this proposal include:

3 Goal C1. Develop a complete, efficient

4 transportation system that gives Sparks residents of all

5 ages a visitors access to employment, housing, services

6 and recreation throughout urban Washoe County.

7 Staff believes that the amendment of Condition

8 Number 14 will meet the goal of providing adequate

9 access for residents and visitors and will continue to

10 provide an acceptable LOS as identified by RTC.

11 Policy C1. Work with the Regional

12 Transportation Commission to add roadway capacity as

13 necessary to accommodate Sparks' growth.

14 Working in partnership with RTC to assess and

15 develop roadway capacity needs for long-term planning

16 achieves a moderated and controlled development of

17 roadway infrastructure to meet the future needs of the

18 City. RTC has removed the widening of Los Altos Parkway

19 from its list of long-range roadway improvements.

20 Amendment of Condition 14 brings street improvement

21 plans for this area into conformance with the current

22 RTC modeling.

23 Goal MG6. Promote compact development to

24 reduce the per capita cost of providing infrastructure,

25 public facilities and public services.

1 Staff believes that the amendment of

2 Condition 14 will reduce the per capita cost of

3 providing and maintaining infrastructure by reducing the

4 total number of lanes that need to be construct and

5 ultimately maintained by the City of Sparks.

6 Finding T6. General conformity with the City's

7 master plan of streets and highways has been considered.

8 The amendment of Condition 14 is in compliance

9 with the current RTC model and will maintain LOS D. All

10 other streets within the Miramonte Tentative Map will

11 remain the same. This amendment does not change the

12 subdivision street design or layout, Conditions 9, 10,

13 11, 12, 13, and 15.

14 Finding T7. The effect of the proposed

15 subdivision on existing public streets and the need for

16 new streets or highways to serve the subdivision has

17 been considered.

18 The 2005 RTC model that was in place when this

19 tentative map was originally approved required the

20 widening of Los Altos Parkway from two to four lanes

21 from Belmar Drive to Vista Boulevard. The current RTC

22 model no longer requires this as a mitigation measure

23 for Los Altos Parkway to operate at the acceptable

24 LOS D. The proposed mitigation from the

25 applicant-provided traffic analysis is to extend the

1 left turn pocket to 400 feet from the intersection of

2 Los Altos Parkway and Vista Boulevard. The City

3 Engineer and RTC staff have reviewed this mitigation

4 measure and are in support of the mitigation.

5 Finding T8. The physical characteristics of

6 the land such as floodplain, slope, and soil has been

7 considered.

8 The amendment of Condition 14 will not impact

9 the existing compliance of the Miramonte Tentative Map

10 regarding floodplain, slope, and soil. There are no

11 changes to the subdivision's number of lots or design,

12 Conditions 5, 18, and 26.

13 Finding T9. The recommendations and comments

14 of those entities reviewing the tentative map pursuant

15 to NRS 278.330 to 278.348, inclusive, have been

16 considered.

17 The City has received a comment letter from

18 RTC, which is attached to the staff report, Exhibit 6.

19 RTC's comments and recommendations generally support the

20 amendment of Condition 14 and are discussed throughout

21 this staff report and the conditions of approval.

22 Finding T10. The availability and

23 accessibility of fire protection, including, but not

24 limited to, the availability and accessibility of water

25 and services for the prevention and containment of

1 fires, including fires in wild lands, has been

2 considered.

3 The amendment of Condition 14 will not impact

4 the existing compliance of the Miramonte Tentative Map

5 regarding fire protection, Condition 19.

6 Finding T11. The application, as submitted and

7 conditioned, will address identified impacts.

8 This section identifies project-specific issues

9 not discussed above, such as landscaping. The amendment

10 of Condition 14 will not impact the existing compliance

11 of the Miramonte Tentative Map regarding landscaping,

12 Condition 8.

13 Architecture. The amendment of Condition 14

14 will not impact the existing compliance of the Miramonte

15 Tentative Map regarding architecture, Condition 24.

16 Finding T12. Public notice was given, as

17 required by the Sparks Municipal Code and Nevada Revised

18 Statutes.

19 Public notice for tentative map is accomplished

20 through the posting of the agenda for a public meeting.

21 The Planning Commission agenda was posted on

22 January 30th. Staff has not received any additional

23 comments. The Planning Commission and City Council

24 meetings function as the public meetings for this item.

25 Staff believes the findings of fact have been

1 made and recommends that the Planning Commission make a

2 recommendation of approval to the City Council.

1 I have just one quick comment before we vote,

2 for the record. You know, this Commission, we received

3 a lot of public comment last year concerning the two

4 townhome projects that we saw. I think, there's an

5 expectation in the -- with at least the item from public

6 and what we heard from the residents, that there is a

7 need for a four-lane, you know, roadway in this area.

8 However, I think, given them all, that our

9 staff and RTC staff have conferred with, that that's no

10 longer necessary, and the proposed improvements to the

11 turn lane there on Los Altos and Vista should help with

12 the situation.

13 It's always kind of tough, in my eyes, when the

14 City is amending conditions that would, essentially,

15 bring forth, you know, millions of dollars in

16 infrastructure and road infrastructure. But with this

17 case, given the facts presented, I have to go with our

18 staff and RTC on this.

19 And I hope down the road that there isn't a

20 situation where the City ends up, you know, expanding

21 this roadway, if it's not needed, and using that out of

22 the City CIP or some other funding source.

23 So just some comments.

9 for approval of the Phase 9 Kiley Ranch North Handbook.

10 Hey, Karen.

11 MS. MELBY: Good evening, Chairman Carey and

12 Planning Commissioners. I'm Karen Melby, Development

13 Service Manager.

14 This is a request for the approval of Phase 9

15 Final Development Handbook for the Kiley Ranch North

16 planned development area. This is generally located on

17 the northwest corner of Wingfield Hills Road and Kiley

18 Parkway.

19 Wingfield Road here will be constructed in the

20 future. And this is Kiley Parkway on the north.

21 The proposed Kiley Ranch North Phase 9 handbook

22 is approximately 29.5 acres, the handbook designation

23 land uses in Phase 9 as 25 acres of High Residential and

24 4.26 acres of Open Space.

25 The City Council approved the amended tentative

1 handbook, development handbook for Kiley Ranch North

2 Planned Development on July 11, 2016. The tentative

3 handbook covers the entire 874.2 acres. Unlike other

4 planned developments, Kiley Ranch North is being

5 reviewed and approved in phases as final handbooks are

6 submitted for each respective phase. To date, there are

7 eight final handbooks that have been reviewed and

8 approved and recorded for the Kiley Ranch North Planned

9 Development. The handbook being reviewed tonight is the

10 ninth handbook or, hence, we are calling Phase 9.

11 The land use designations are Open Space along

12 the east and north boundary and then High Residential,

13 which allows rental or for sale multi-family dwellings

14 at a density of 18 to 23.9 dwelling units per acre. The

15 handbook specifies the permitted and conditional uses;

16 the project approval procedures; the land use

17 development standards; streetscape and development

18 standards; design standards and guidelines for the site

19 planning, architecture, and landscaping; and, lastly,

20 construction and operation and maintenance requirements.

21 The handbook does not include development plans, and any

22 future development will be developed in accordance with

23 the handbook standards.

24 Staff wants to inform you about some changes in

25 the Phase 9 handbook. As staff was completing the staff

1 report, in preparation, staff realized that the Phase 9

2 handbook incorporated land uses, which is in conformance

3 with the Comprehensive Plan amendment that was approved

4 and certified by City Council on July 28, I mean

5 January 28. I'm pulling with Scott. However, the

6 amendment, amended tentative handbook has not been

7 approved today.

8 So staff had asked that these amendments, these

9 exhibits be changed. That is on page 2-1. And then,

10 also, 2-3 is noted that the approval was pending.

11 The third page that was amended is page 1-9

12 that shows a summary of land uses by acreages and

13 densities. The revised handbook was provided to the

14 Planning Commission at the Study Session on February

15 5th.

16 Sparks Municipal Code 20.02.012 and NRS

17 278A.540 both specify a review process for the final

18 approval of the planned development handbook. Staff has

19 compared the handbook with the tentative handbook,

20 approved tentative handbook and determined that the

21 development standards in the handbook are in substantial

22 compliance.

23 There are five criteria to determine

24 substantial compliance.

25 The first one, it does not vary the proposed

1 residential density or intensity from the Kiley Ranch

2 North Planned Development handbook.

3 The High Density Residential designation

4 permits a maximum density of 23.9 units per acre for

5 multi-family housing, as does the tentative handbook.

6 The handbook does not propose any changes to the maximum

7 density.

8 The next criteria is it does not vary the

9 proposed ratio of residential to non-residential.

10 The handbook designates 25.27 acres as High

11 Residential, the same acreage that is in the tentative

12 handbook.

13 The next criteria is does not reduce the common

14 open space area.

15 The handbook designates 4.26 acres of open

16 space, allocated between a buffer of Phase 9 and the

17 Lazy Five Regional Park to the north and a regional

18 trail connection to Lazy Five along the eastern boundary

19 of Phase 9. This is consistent with the tentative

20 handbook.

21 The fourth criteria, does not increase the

22 floor area proposed for the non-residential uses from

23 the approved tentative handbook.

24 Phase 9 handbook does not have any

25 non-residential uses. And they're all designated High

1 Residential.

2 There is no increase in the total ground area

3 covered by buildings, nor is there substantial change in

4 the height of buildings.

5 The development standards in the handbook do

6 not vary from those in the tentative handbook. Future

7 development plans will be reviewed in accordance with

8 the handbook.
