PART - III ELECTION COMMISSION OF INDIA Nirvachan Sadan, Ashoka Road, New Delhi—110001 Dated the 4th April, 2013 ---------------------------------------------- 14th Chaitra, 1935 (Saka) NOTIFICATION No.100/CS-MEGH/2/2013.—WHEREAS, the Commission, vide its Notification No.100/CS-MEGH/2/2013 (1), dated 1st April, 2013, had notified the schedule for the bye-election to fill a seat in the Council of States by the elected members of the Legislative Assembly of Meghalaya; and WHEREAS, the poll for the above election has to be taken up on 18th April, 2013, if necessary; and WHEREAS, the date of counting of votes has been fixed as 18th April, 2013 vide the Commission’s Press Note No.ECI/PN/15/2013, dated 25th March, 2013; and WHEREAS, in the meanwhile, the Chief Electoral Officer of Meghalaya has forwarded a letter received from the Secretary, Meghalaya Legislative Assembly, wherein he has mentioned that 18th April is the last day of the Budget Session of the Meghalaya Legislative Assembly and there are many important business to be taken up on that day like Passing of the Meghalaya Appropriation Bill, Election of Deputy Speaker, Election of Financial Committee, etc; and WHEREAS, taking into account the above mentioned facts, the Commission has decided to postpone the date of poll from 18th April, 2013 to 19th April, 2013, if necessary, for bye-election to the Council of States from Meghalaya; and also decided that the date of counting of votes shall be 19th April, 2013 at 5.00 P.M.; Now, therefore, the Commission, in exercise of its powers conferred under section 30 read with section 153 of the Representation of the People Act, 1951 hereby directs that for the existing sub-clause (d) of Clause B of the Commission’s Notification No.100/CS-MEGH/2/2013 (1), dated 1st April, 2013, the following sub-clause shall be substituted “(d) the 19th April, 2013 (Friday), as the date on which a poll shall, if necessary, be taken; and”.
