Q: When starting a dewatering project what rules and regulations should I know? A: Dewatering regulations are generally promulgated and enforced on the local level. The State of Florida does not require statewide permitting for dewatering outside of very limited circumstances involving prior unground fuel storage. It is important that you know and understand your local jurisdictions rules that govern dewatering projects. Building relationships with your local building official, zoning, and development offices will help you navigate local regulations better and solve any conflicts in timely manner. Many other industry shows, our cruise, chapter meetings, golf tournaments, and I'm sure many a vacation, were cancelled. As mentioned before, we were incredibly fortunate to get our January Board meeting and Everything Under the Sunsm Expo completed right before the shutdowns began. We are forging ahead with plans to have the show as planned in February. This show is vitally important to this organization and we look forward to seeing you all there. Ours was the only pool show that took place in 2020 and will be the first major show since. Florida and Orlando are open for business! I would also like to thank you all for the opportunity to serve as the 2020 president of an organization that is incredibly important to the pool industry in the state of Florida, but also nationally as a trendsetter. I thank the state Board for trusting me with this responsibility as well. Other than a worldwide pandemic, it's been a pretty smooth year. I couldn't have done it without the help, support, and guidance of Wendy Parker Barsell, the office staff, and the rest of the Executive Committee. I'm excited for the next president, Maurice Bushroe, and the future of the FSPA! The Executive Committee "retreat" has just taken place, all of the committee chairs have been filled, and we fully intend to hit the ground rolling in 2021! If you register by December 10 non- members can get Four hours of Free education courses along with Free exhibit hall entry. What will the show look like this year? Familiar, with some tweaks. Face masks are required for everyone. Online registration will make your badge pick up easy and fast – so visit underthesunexpo.com and sign up. Then, you will just have to scan your barcode and pick-up a badge. Registration stations will have a single computer rather than dual lines you’ve seen in the past and the floor will be marked with six foot social distancing stickers. There are more than fifty classes being offered but this year you will select a block of classes which take place in one room. So, rather than taking a 1 hour class in room A, then going to a 2 hour class next door in room B, you will just stay in room A for the full morning session. The seat you select is your seat for the full session – we are working on a system so if you leave the room, when you return it is easy to locate your seat and others know it has been taken. The chairs will be set six feet apart and there will not be tables. Classroom capacity will be at 50% of normal levels (register early!). The exhibit hall will have one entrance and a separate exit. All booths in the hall are corner booths and between booth spaces there will be 8’ tall

Exhibit hall hours will likely be extended to reduce density in the hall. The size of the hall is much larger than we need allowing for plenty of extra space for everyone. Exhibitor profiles have been upgraded for 2021 so you can learn more about the company’s products and show specials. The show website allows you to message exhibitors and arrange meeting times. Once registered for the show you will be set up to be able to use the connection portal. Again, get registered early so you can plan your time at the show. I can’t wait to see you face to face, feet on the ground, in February!

Most of us would agree that finding good employees and subcontractors is one of the single largest challenges facing the construction industry today. So, maximizing the efficiency of the crews we all work with is more important than ever. In our business, we have found the most efficient swimming pool construction method to be installing fiberglass shell pools. By far, the greatest percentage of residential swimming pools installed in Florida today are concrete shell pools, and with good reason! Concrete pools have many things going for them. But, there is also lots of labor (typically both employees and subcontractors) involved with installing the concrete pools. As we are all challenged by a dwindling qualified labor pool, and good subcontractors are spread too thin, this can make scheduling a nightmare! Add in the Florida weather challenges and this can quickly turn into a situation that costs us (the pool builder) real money that we did not have in the budget. Let's explore fiberglass pool shells for a minute. I know that fiberglass pool shells have their drawbacks, but they have their strong points too! The single biggest drawback is that your customer will have to choose from the sizes, shapes, and colors the manufacturers offer. But, for the vast majority of homeowners’ situations, this is not too great a challenge to overcome. You still have all of the decking options available that you have with concrete shell pools. In fact, with the same waterline pool tile and decking options, all of the fiberglass gelcoat finish is below the waterline, just exactly the same way the plaster finish is on a concrete shell pool. All of that being said, here is the main point of this article: I have found that we can install more residential swimming pools, with fewer employees and fewer subcontractors, and finish in significantly less time when installing fiberglass pool shells than we could when we focused on building concrete pool shells. And ultimately this puts more money in the company pockets with less frustration than when we focused on concrete pool shells.

December 2020 • Florida Pool Prosm 9 FSPA CHAPTER NEWS In fact, our front end crew is a four man crew. These four will typically install a fiberglass pool shell in three workdays. The front end installation consists of: digging the hole, setting the pool shell, rough plumbing and pressure test, and backfill and compact to be ready for the decking crew. Imagine literally being ready for the pool deck crew the fourth day you are in the backyard! Imagine never having to send a crew out to dig mud that caved in from between the steel, and scrambling to reschedule the concrete and shell crew. Imagine never again having to delay the plaster crew because of inclement weather. All of these are realities for builders who focus on fiberglass pool shell installations. How much easier would this make the front end construction for the person responsible for the construction schedule? Of course, one of the primary factors for the quick jobsite installation is that the shell is already constructed in a factory where trained technicians work in a climate controlled environment. The pool shell arrives at the jobsite structurally sound, and with the finish already installed. Speaking of the pool finish, imagine not having to monitor the pool and water chemistry for the first 30 days. Imagine being able to put salt in salt water pools immediately. Imagine not having to brush the pool multiple times per day to help the fresh pool finish settle in. How would this change the pool start-up? How much more quickly will the already excited customers be able to enjoy their new pool? At the end of the day, the success of business is ultimately its ability to turn a profit. We have found that we can make approximately the same profit margin installing fiberglass pool shells as we were making installing concrete pool shells. But, we can do this with significantly fewer employees and trucks on the road. And we can install significantly more pools in significantly less time. Both are absolutely increasing the net bottom line!

The service industry is one of the United States' most significant and steadfast industries. It is our history of dedication to service that has defined us as a more established country. Economies with little-to-no service sector rely heavily on agricultural and mining professions. In 1929, the service sector accounted for more than half of the United States GDP (gross domestic product). Again in 1993, service accounted for more than three-quarters of the GDP. The pool industry must take advantage of these precedents and strive to make our business practices based on service, not price. In this year’s general election, Florida State Legislative candidates supported by FSPA’s political action committee, PIPAC, won big. Some PIPAC supported candidates won reelection while others won seats with no incumbent but one thing is for sure all but one of the candidates who received FSPA support will be representing their districts in Tallahassee this spring. As results are confirmed, it appears that Republicans are set to pick up five seats in the Florida House of Representatives. These pickups by Republicans shift the balance of power in the House even further toward Republicans heading in to the 2021 Legislative Session. The House of Representatives partisan split now sits at 78 Republicans and 42 Democrats. On the Senate side of the Capitol, Democrats may lose one seat pending a recount in State Senate District 37. As of the writing of this article, the Republican challenger in Senate Jurisdiction was leading by 18 votes. If the current results in Senate District 37 hold the partisan split in the State Senate will sit at 23 Republicans and 17 Democrats heading to 2021. The results of the state legislatives races are welcome news to incoming Speaker of the House Rep. and incoming Senate President Sen. Wilton Simpson, whose reelection goals have been heavily supported by PIPAC. Both will be beginning their terms as leader of their respective chambers with increased majorities. The 2020 election was a big win for FSPA and PIPAC, the candidates that were supported all have worked hard to support the swimming pool industry and work to keep businesses big and small, working. 2021 is shaping up to be a very productive and positive legislative session for FSPA, PIPAC, and the entire Florida swimming pool and spa industry.

Florida’s insurance regulator has called for a further decrease to proposed workers’ compensation insurance rates in response to a filing by the National Council on Compensation Insurance. In an order issued October 30, Florida Insurance Commissioner David Altmaier said the recent filed proposal for an average 5.7% decrease needed to be amended to a larger average decrease of 6.6% to be approved. NCCI has subsequently approved of the 6.6% filed by the State of Florida. Altmaier’s order disapproved the inclusion of large deductible coverage from two NCCI financial calls, saying that NCCI indicated in its testimony at a public hearing that the use of large deductible coverage data imposes a cost on carriers “but does not have a significant impact on the credibility or predictive value of the filing’s aggregate indication. NCCI agreed that this data should be eliminated from the filing’s aggregate indication.” The order also noted that filing does not include claims from COVID-19, as potential impact of the coronavirus on the workers’ compensation system is

18 Florida Pool Prosm • December 2020 INSURANCE UPDATE in the beginning stages. “NCCI is gathering information and conducting research to gauge the pandemic’s impact on claim frequency, severity, and duration, but has not yet assessed its impact on future rate levels,” the order states. As approved by the Florida Office or Insurance Regulation (OIR), the revised average rate decrease becomes effective on January 1, 2021, for new and renewal business. The history of Florida rates over the past several years is below. In 2003 there were major reforms passed to the Florida workers’ compensation system. The 2003 column below represents the high-water mark for the rates. Most of the rates bottomed out in 2010 (the second column) and the most recent two years, both rate reductions, are to the right. As you can see, the big percentage winner was class code 5223, swimming pool construction! Please note that as the rates come down the tendency is for the individual Experience Modification factors (for those of you who have one) to increase thus diluting, ever so slightly, the rate reduction.

December 2020 • Florida Pool Prosm 19 FSPA CHAPTER NEWS This decrease marks the fifth for Florida since 2016, when two separate Florida Supreme Court decisions led to a significant rate increase and much anticipation that rates would continue rising soon. Those decisions, Westphal v. City of St. Petersburg and Castellanos v. Next Door Company, “resulted in changes to the Florida workers' compensation landscape” by undoing a primary cost-reduction component of reforms passed by Florida lawmakers in 2003. The initial response was a steep 14.5% rate increase for 2017. NCCI was ordered by the Florida OIR in 2017 to begin assessing the market impact of Castellanos, which has been considered the main driver of concern and accounted for most of the 2017 rate increase. In that case the Florida Supreme Court found the state’s mandatory attorney fee schedule unconstitutional as a violation of due process under both the Florida and United States Constitutions. However, other factors now appear to be impacting rates positively. NCCI’s rate explanation for 2021 noted that carrier loss ratio results are improving over time, which is consistent with the “very favorable workers' compensation industry results countrywide over this period.” Nationally, the workers' compensation system is experiencing unprecedented results, NCCI said. The combination of underwriting discipline, moderating severity, declining frequency, and adequate reserves has resulted in six straight years of combined ratios under 100%. Claims frequency has been on a downward path thanks to technology, safer workplaces, improved risk management, and a long-term shift from manufacturing to service sectors, NCCI said. Last year, OIR disapproved NCCI’s statewide average rate decrease of 5.4% and instead required NCCI resubmit the filing for a 7.5% rate decrease for new and renewal policies taking effect

20 Florida Pool Prosm • December 2020 INSURANCE UPDATE January 1, 2020. The regulator said that given NCCI’s assertion that claim frequency is declining for workers’ compensation in Florida and nationwide and that is expected to continue, NCCI’s ranges appeared to be “unreasonable.” OIR also said at the time that more quantitative analysis needed to be conducted “to determine the effect the Castellanos decision is having on the Florida workers’ compensation market and the data used to support future rate filings.” NCCI’s assessment on the Florida’s workers' compensation marketplace for the 2021 rate filing included reviewing insurance company feedback from the state’s largest workers’ compensation writers that report financial data to NCCI, the change in claimant attorney fees and the change in loss ratios that have occurred since the Castellanos decision. Carrier feedback was largely unchanged from last year, NCCI noted, with most carriers saying they experienced cost increases after the 2016 decision, particularly for claimant attorney fees. Carriers reported that litigated claims generally take longer to close and are costlier when compared to non-litigated claims. “Some carriers reported that litigated claims now represent a relatively larger portion of their book of business versus their experience prior to the Castellanos decision,” NCCI said. At the same time, NCCI said there has been a marked increase in valuation dates for attorney fees from before and after Castellanos, which is supported by data from the Florida Division of Administrative Hearings (DOAH). That data shows claimant attorney fee percentages through June 2020 have increased from 13% prior to the decision to more than 20% in recent years. NCCI noted carrier indemnity paid loss ratios are worsening over time when looking at a single year, with Castellanos likely contributing to this pattern. However, when looking across years, results are improving over time. “The combination of two counteracting impacts has contributed to the current state of the Florida workers' compensation system. To date, the especially favorable workers' compensation industry results observed across the country have more than offset the observed cost increases associated with the Castellanos decision,” NCCI said. With the time changing and the craziness of 2020, we were thankful to see those who attended the monthly meeting on November 10 sponsored by Jack’s Magic. As always, Joel Gray gave a great presentation and we are grateful that a few new members were in attendance who want to invite him to their showrooms to educate their teams on the Jack’s Magic difference. The Board will be hosting their retreat in December and looks forward to rolling out another great program for the 2021 year. We also invited Tom Gillin with the City of Flagler Beach Junior Lifeguards who educated us on their annual program. With the support of so many members and community supporters at our 2nd Annual Golf Tournament, we wrote a check to them for $2,000 and are submitting for a matching grant of $1,000. Thanks to all. Due to the environment this past year, the Board of Directors decided to cancel the holiday party. We will not be meeting in December. We appreciate your understanding and look forward to planning next year’s when we all have a better grasp on the climate. The Chapter’s Skeet Shooting event was September 24 at Jacksonville Clay Target Sports. It was a beautiful day in northeast Florida! While practicing our social distancing, everyone enjoyed a chicken burrito, chips and salsa, cookies and drinks from the Burrito Gallery. We then hopped on our golf carts and started the course. Congratulations to Crown Pools for getting the highest score! Second place was David Pruette Electric Services and third place was new member Cover Care. Also congratulations to Jay Bolton, Cover Care, for scoring the highest individual shooting - he scored 91 out of 100!
