December 2009 Introduction I am pleased to introduce our summary of the Mersey Estuary Catchment Flood Management Plan (CFMP). This CFMP gives an overview of the flood risk in the Mersey Estuary catchment and sets out our preferred plan for sustainable flood risk management over the next 50 to 100 years. The Mersey Estuary CFMP is one of 77 CFMPs for have a 1% chance of flooding in any one year from rivers England and Wales. Through the CFMPs, we have (i.e. a 1% annual probability). We estimate that by 2100 assessed inland flood risk across all of England and approximately 25,000 properties will be at risk of river Wales for the first time. The CFMP considers all types of flooding. This is a 30% increase compared to the current inland flooding, from rivers, groundwater, surface water number at risk across the catchment. -

PURPOSE OF REPORT 1.1 The Liverpool City Region Combined Authority ("the LCRA") is responsible for determining the level of tolls ("the tolls") payable for use of the Mersey Tunnels ("the Tunnels"). 1.2 This report is intended to assist the LCRCA by allowing the following issues to be explained and discussed by the Transport Committee and for a recommendation made to the LCRCA on the level of tolls. This report will: (a) outline the legal procedure for revising the level of the tolls; (b) summarise how the current level of tolls was arrived at; and (c) make proposals for the level of tolls payable in 2019/20. 2. 9 May 2018 Network licence condition 7 (land disposal): Pall Mall, Liverpool Decision 1. On 29 March 2018, Network Rail gave notice of its intention to dispose of land at Pall Mall, Liverpool (the land), in accordance with paragraph 7.2 of condition 7 of its network licence. The land is described in more detail in the notice (copy attached) and in the additional plan included at Annex B. 2. We have considered the information supplied by Network Rail including the responses received from third parties you have consulted. For the purposes of condition 7 of Network Rail’s network licence, ORR consents to the disposal of the land in accordance with the particulars set out in its notice. Reasons for decision 3. We are satisfied that Network Rail has consulted all relevant stakeholders with current information. 4. In considering the proposed disposal we note that: there is no evidence that current or future railway operations would be affected adversely; and no other reasonably foreseeable railway use for the land was identified. 5. Network Rail’s submission referred to the former Waterloo line which passed under Pall Mall and through Plot 4. We note Network Rail’s confirmation that the potential future railway use of the subsurface corridor will not be jeopardised by the development of the land. We also note Network Rail’s further statement to us, confirming that its engineering approval takes into account all relevant Group Standards and ensures that passive provision is not compromised. 6. Based on all the evidence we have received and taking into account all the material facts and views relevant to our consideration under condition 7, we are satisfied that there are no issues for us to address. -

MERSEY TUNNELS BYELAWS 2003 BYELAWS made by the Merseyside Passenger Transport Authority in pursuance of Section 102 of the County of Merseyside Act 1980 as amended by the Mersey Tunnels Order 1986 with regard to the Mersey Tunnels, the approaches and marshalling areas. These Byelaws may be cited as the Mersey Tunnels Byelaws 2003. 1. INTERPRETATION In these Byelaws:- “the tunnels’ approaches” means all or any of the approaches to the Queensway Tunnel authorised by the Mersey Tunnel Acts 1925 to 1928 and the Birkenhead Corporation (Mersey Tunnel Approaches) Act 1965 and all or any of the approach roads and approaches to the Kingsway Tunnels authorised by the Mersey Tunnel (Liverpool/Wallasey) etc Act 1965 and the Mersey Tunnel (Liverpool/Wallasey) Act 1968; “authorised officer” means any person employed by the Authority and authorised by the Authority to exercise the powers and functions contained in these Byelaws; “carriageway” means that part of a highway which is constructed so as to be suitable for regular use of motor vehicles; “central reservation” means that part of a highway which separates the two carriageways of that highway; “the Authority” means the Merseyside Passenger Transport Authority; 1 “the Operations Manager” includes any other person for the time being responsible for the management of operational aspects of the Mersey Tunnels; “the Tunnels General Manager” includes any other person for the time being in charge of the Mersey Tunnels; “marshalling area” means an area provided for the marshalling of vehicles using,
