ITEM: Rescind Removal Directive of BLM & Pride Displays and Refer Political Signs Ban to Policy Committee for Policy Development PRESENTER: Chair Dave Brown ACTION

BACKGROUND:

At the 13, 2021, Board meeting, the Board tabled Motion 13 directing the Superintendent to remove all Black Lives Matter (a.k.a. BLM) signs, flags, placards, and all instances of the symbol known as the Pride flag from district facilities immediately and direct the policy committee to draft policy language prohibiting the display of political signs, flags, and placards, in district facilities with the sole exception of the American flag and the Oregon state flag.

At the , 2021, Board meeting, the Board continued discussion of Motion 13 and amended the original motion to direct the Superintendent to remove all Black Lives Matter (a.k.a. BLM) signs, flags, placards, apparel, buttons, and all other modes of display, and all instances of the symbol known as the Pride flag from District facilities immediately, and direct the Policy Committee to draft policy language prohibiting the display of political signs, flags, apparel, buttons, and placards, and all other modes of display from District facilities, with the sole exception of the American flag and the Oregon state flag, with exemptions as it sees proper. The language contained in this directive shall only apply to District staff and faculty while in the performance of their official duties as District employees after a second motion to table failed. The Superintendent stated that he would not implement the directive before receiving legal advice to ensure enforcement was not unlawful.

The Board met in Executive Session pursuant to ORS 192.660 (2)(h): To Consult with Legal Counsel on , 2021.

At a Special Meeting of the Board on September 1, 2021, the Board will consider a motion to rescind Motion 13 and the removal directive of BLM and Pride displays from district facilities and refer the political signs ban to the policy committee for development of policy.

RECOMMENDATION: Move that the Newberg School District Board of Directors rescind Motion 13 from the August 10, 2021, Board meeting including a directive to the Superintendent to remove all Black Lives Matter (BLM) and Pride displays from District facilities and to refer the political signs ban to the Policy Committee for policy development.

ITEM: Designate Board Committees PRESENTER: Dave Brown, Chair ACTION

BACKGROUND:

Each school year we establish three committees to accomplish the work of the Board: Policy, Facilities/Property, and the Personnel Committee. Members will be assigned to each committee.

In addition, the Board will continue with the established Ad Hoc Committee moving forward with anti-racism and equity work in the district. Members will be assigned to the Equity Ad Hoc Committee to develop recommendations to come to the full Board for approval.

See attachment for the descriptions of each committee and the proposed member assignments.

RECOMMENDATION: Move that the Newberg School District Board of Directors approve the membership of each committee as designated.

Board Committees 2021-22

Policy Committee Review, update, analyze, and recommend Board policy to the whole Board. This committee meets a minimum of three times per year to review, update and develop policy. Suggested timeframes: September, , , , and . However, for 2021-22, this committee will continue to meet at least monthly for the complete policy review process.

2021-2022 Proposed Members: Rebecca Piros, Trevor DeHart, Brian Shannon

Facilities/Property Committee Provide direction and recommendation on properties and facilities owned by the district and/ or long range planning for a question of new property and other capital projects. This group would likely meet in the spring per strategic plan to look long-range at upcoming needs based on enrollment trends. Timeframes: , , .

2021-2022 Proposed Members: Dave Brown, Trevor DeHart, Brandy Penner

Personnel Committee Organize the processes around the Superintendent’s evaluation and the interviewing of student representatives to the Board. This group will meet as needed in the fall, winter, and spring.

ITEM: Governor’s Mask Mandate and Local Control Options PRESENTER: Dr. Derek Brown, Assistant Superintendent ACTION

BACKGROUND:

At the , 2021, Board meeting, the Board approved an amended Motion 7 to lift the face mask mandate in district facilities effective on the first day of school for the 2021-22 school year.

On , 2021, Governor Kate Brown announced that masks will be required in all Oregon K-12 schools in the fall, superseding the Board’s Motion 7 to lift the mask mandate.

At the August 10, 2021, Board meeting, the Board approved a motion requesting legal counsel to provide options for challenging the Governor’s mask mandate in court.

The Board met in Executive Session pursuant to ORS 192.660 (2)(h): To Consult with Legal Counsel on August 24, 2021.

At a Special Meeting of the Board on September 1, 2021, the Board will discuss the Governor’s mask mandate and local control options. Staff will be asking the Board to rescind the previous Motion 7 to lift the mask mandate and make masks optional which preceded the Governor’s directive to make masks mandatory for all schools.

RECOMMENDATION: Move that the Newberg School District Board of Directors rescind Motion 7 from the July 13, 2021 Board meeting to lift the face mask mandate in district facilities, effective on the first day of school for the 2021-22 school year because it preceded the Governor’s directive to make masks mandatory for all Oregon K-12 schools.

ITEM: Approve CM/GC Recommendations for Bond Construction Firms to Build Edwards Elementary & Newberg High School Projects

PRESENTER: Rick Rainone from Cornerstone Management Group, Inc. ACTION

BACKGROUND:

Rick Rainone from Cornerstone Management Group, Inc, the Owner’s Representative for Newberg Public Schools for Bond Construction, will present a recommendation for hiring a Construction Manager/General Contractor (CM/GC) for the Newberg High School and Edwards Elementary construction projects.

As presented and approved at the 22, 2021 Board Meeting, hiring a CM/GC for certain projects is extremely cost effective and helpful in keeping bond projects on schedule. There was an open bidding process, and eleven highly qualified firms applied. Three were invited to interview. After scoring that was based on interview questions and cost proposals, Pence Construction is recommended for the CM/GC for the Newberg High School projects, and Skanska USA is recommended for the CM/GC for the Edwards Elementary projects.

RECOMMENDATION: Move that the Newberg School District Board of Directors approve hiring Pence Construction as the CM/GC for the Newberg High School projects, and hiring Skanska USA as the CM/GC for the Edwards Elementary projects.
