The court denied defendant’s Petition for Post-Conviction Relief, based on ineffec- tive assistance of counsel, because: (1) counsel could not be ineffective for failing to present false alibi evidence where defendant admitted to counsel he committed robbery; (2) de- fendant made an informed decision not to testify and counsel’s advice not to testify was sound; and (3) counsel made reasonable, strategic decisions during trial and raised only appeal issues that had merit. The petitioner, Hishamu Curry, was found guilty after a jury trial of Robbery1 (three counts), Attempted Criminal Homicide,2 Aggravated Assault3 (two counts), and Criminal Conspiracy to Commit Robbery.4 The petitioner and two confederates, Isaah Sampson and Edward Maye, robbed the KNBT Bank in Emmaus at gunpoint. During the robbery, Edward Maye assaulted the Assistant Manager of the bank with a firearm, and in their flight to avoid apprehension, Isaah Sampson fired his weapon multiple times at Officer William Bryfogle of the Emmaus Police Department. Multiple bullets struck Officer Bryfogle’s cruiser, but he escaped uninjured. A presentence report was ordered following the jury’s verdict. A full sentencing hearing was held on February 13, 2012, during

At the conclusion of the sentencing hearing, the petitioner received a total sentence of not less than thirty (30) years nor more than sixty (60) years in a state correctional institution.5 A Notice of Appeal was filed by trial counsel on March 14, 2012. Pursuant to this court’s directive, counsel filed a timely Pa. R.A.P. 1925(b) Statement. The sole issue6 raised alleged that it was error to permit the introduction into evidence of cell phone records and text messages secured from petitioner’s cell phone.7 On October 4, 2013, the judgment of sentence was affirmed by the Superior Court.8 A Petition for Allowance of Appeal was denied by the Supreme Court on April 4, 2014.9 On July 10, 2014, the petitioner filed a pro se Post Conviction Relief Act (hereinafter PCRA) petition. Attorney Robert Long was appointed to represent the petitioner and filed an Amended PCRA petition on May 8, 2015.10 A PCRA hearing was held on August 24, 2015. During the hearing, trial counsel, Eric Dowdle, and the petitioner testified. The issues pursued by the petitioner at the hearing were that trial counsel was ineffective because of the following: (1) he failed to

DISCUSSION All of the petitioner’s claims are presented as allegations of ineffective assistance of counsel. Counsel is presumed to be effec- tive and the burden to show otherwise lies with the petitioner. See Commonwealth v. Singley, 582 Pa. 5, 19, 868 A.2d 403, 411 (2005). To prevail on a claim that counsel was constitutionally ineffective, the [Appellant] must overcome the presumption of competence by showing that: (1) his underlying claim is of arguable merit; (2) the particular course of conduct pursued by counsel did not have some reasonable basis designed to effectuate his interests; and (3) but for counsel’s ineffective- ness, there is a reasonable probability that the outcome of the [trial] would have been different. Commonwealth v. Fitzgerald, 979 A.2d 908, 910 (Pa. Super. 2009). See also, Commonwealth v. Hammond, 953 A.2d 544, 556 (Pa. Super. 2008) citing Commonwealth v. Miller, 868 A.2d 578, 581 (Pa. Super. 2005); Commonwealth v. Reyes, 582 Pa. 317, 330, 870 A.2d 888, 896 (2005); Commonwealth v. Jones, 571 Pa. 112, 126, 811 A.2d 994, 1002 (2002); Commonwealth v. Pierce, 515 Pa. 153, 527 A.2d 973 (1987). Furthermore, a claim of ineffectiveness must be rejected if the petitioner fails to satisfy any of the prongs. See Fitzgerald, supra. If the petitioner is unable to demonstrate preju- dice, the first two prongs of the ineffective examination need not be addressed. Commonwealth v. Chmiel, 585 Pa. 547, 614, 889 A.2d 501, 540 (2005). All of the petitioner’s claims must be examined in the context that he admitted his involvement to the robbery of the KNBT Bank 12 Lehigh 7-17 op Commonwealth vs. Curry 667 in Emmaus to his trial counsel.11 Likewise, one of the petitioner’s claims was that counsel failed to investigate the subscriber informa- tion on the Sanyo cell phone. However, the petitioner told trial counsel that the Sanyo belonged to him.12 Most of the petitioner’s testimony at the PCRA hearing was contradicted by trial counsel, who was infinitely more credible than the petitioner. It is well settled that PCRA credibility determina- tions are entitled to great deference. Commonwealth v. Philistin, 617 Pa. 358, 399 n.17, 53 A.3d 1, 25 n.17 (2012); Commonwealth v. Clark, 599 Pa. 204, 217, 961 A.2d 80, 87 (2008); Commonwealth v. Markowitz, 32 A.3d 706, 714, 717 (Pa. Super. 2011); Common- wealth v. Widgins, 29 A.3d 816, 819 (Pa. Super. 2011); Common- wealth v. Maynard, 900 A.2d 395, 398 (Pa. Super. 2006); Com- monwealth v. Knighten, 742 A.2d 679, 682 (Pa. Super. 1999). I. Alibi The petitioner testified that he told trial counsel that he was at a “girlfriend’s house in Bethlehem during the time of the rob- bery, and I was asleep.” 13 He claimed that he gave trial counsel three names, but he did not know the whole name of the third individual.14 The two individuals whose names he knew were Bar- bara Johnson and Carisma Curry.15 Neither of them testified at the PCRA hearing. Trial counsel testified that the petitioner did not tell him he was sleeping in Bethlehem.16 Instead, he told counsel that he com- mitted the robbery.17 The names the petitioner used at the PCRA hearing were not mentioned as alibi witnesses to trial counsel.18

He may have identified names of real people, but he did not establish that they were alibi wit- nesses or were available as alibi witnesses. In that regard, the pe- titioner testified at the PCRA hearing, but not the named indi- viduals. He has also failed to establish counsel’s actual awareness, or duty to know of them and their willingness and ability to coop- erate and appear on the defendant’s behalf. Commonwealth v. Spotz, 587 Pa. 1, 48, 896 A.2d 1191, 1219 (2006) quoting Com- monwealth v. Whitney, 550 Pa. 618, 708 A.2d 471, 480 (1998); see also, Commonwealth v. Gibson, 597 Pa. 402, 441, 951 A.2d 1110, 1133 (2008). More importantly, due to the petitioner’s admissions, counsel was precluded from presenting false alibi testimony. In Common- wealth v. Alderman, 292 Pa. Superior Ct. 263, 437 A.2d 36 (1981), it was held that a “lawyer may not argue known perjury to fact finder as credible.” Although counsel has a duty to interview alibi witnesses, “[i]t is axiomatic that the right of a client to effective counsel in any case (criminal or civil) does not include the right to compel counsel to knowingly assist or participate in the commission of perjury or the creation or presentation of false evidence.” Id. at 269, 437 A.2d at 39. See also, Commonwealth v. Hall, 549 Pa. 269, 292, 701 A.2d 190, 201 (1997) quoting Commonwealth v. Jones, 501 Pa. 162, 167, 460 A.2d 739, 741 (1983) (there can be no inef- fectiveness of trial counsel for failure to call an alibi witness when the defendant admits that this testimony would be perjured). The Sixth Amendment right to assistance of counsel is not violated when an attorney refuses to cooperate with his client in presenting perjured testimony at his trial. If the petitioner had pursued an alibi defense, trial counsel’s refusal to present false testimony would have fallen within the accepted range of profes- sional responses to threatened client perjury. “Counsel’s duty of loyalty to, and advocacy of, the defendant’s cause is limited to le- gitimate, lawful conduct compatible with the very nature of a trial as a search for truth. Although counsel must take all reasonable lawful means to attain his client’s objectives, counsel is precluded from taking steps or in any way assisting the client in presenting false evidence or otherwise violating the law.” Nix v. Whiteside, 475 U.S. 157, 158 (1986). 14 Lehigh 7-17 op Commonwealth vs. Curry 669 When confronted with a proposal for perjurious testimony, the Supreme Court stated “under no circumstance may a lawyer either advocate or passively tolerate a client’s giving false testi- mony. This, of course, is consistent with the governance of trial conduct in what we have long called ‘a search for truth.’ The sug- gestion sometimes made that ‘a lawyer must believe his client, not judge him’ in no sense means a lawyer can honorably be a party to or in any way give aid to presenting known perjury.” Id. at 170-71. Therefore, even if trial counsel was presented with the alibi wit- nesses, he had no right to advocate or passively tolerate the peti- tioner’s giving of false testimony. To do so would have placed him at a risk of prosecution for suborning perjury and disciplinary proceedings including suspension or disbarment. Id. at 173. See also, Alderman, supra at 270, 437 A.2d at 40; Hall, supra at 292, 701 A.2d at 201. II. Right to Testify The petitioner at the time of trial “did not think it was a good idea to testify,” but now claims trial counsel was somehow ineffec- tive in advising him not to do so.19 This claim is raised even after a colloquy was conducted with him under oath at trial where he stated that he was not forced or coerced into not testifying.20 A hindsight approach to that decision will not entitle the petitioner to any PCRA relief. The petitioner has failed to demon- strate either that: (1) counsel interfered with his client’s freedom to testify; or (2) counsel gave specific advice so unreasonable as to vitiate a knowing and intelligent decision by the client not to tes- tify in his own behalf. Commonwealth v. Thomas, 783 A.2d 328, 334 (Pa. Super. 2001) (collecting cases). See also, Commonwealth v. O’Bidos, 849 A.2d 243, 250 (Pa. Super. 2004). In other words, “counsel is not ineffective where counsel’s decision to not call the defendant was reasonable.” Commonwealth v. Breisch, 719 A.2d 352, 355 (Pa. Super. 1998). Likewise, “[a] claim of strategic error absent a showing of specific incidents of counsel’s impropriety will not satisfy this standard.” Thomas, supra at 334-35 quoting Com-

Superior Ct. 125, 613 A.2d 603, 605 (1992). No testimony was presented that trial counsel interfered with petitioner’s right to testify. The colloquy conducted with the peti- tioner demonstrates just the opposite. Providing advice to a client regarding the decision to testify has never been equated with in- terference. See id. at 335. The advice provided to the petitioner was sound in light of his admission to counsel that he committed the robbery. “What- ever the scope of a constitutional right to testify, it is elementary that such a right does not extend to testifying falsely.” Nix v. White- side, supra.21 If the petitioner had persisted, counsel was required to explain to him his ethical limitations. Commonwealth v. Jermyn, 533 Pa. 194, 200, 620 A.2d 1128, 1131 (1993). It can hardly be argued that advice which preserves the adjudicative process is “so unreasonable as to vitiate a knowing and intelligent decision by the client not to testify in his own behalf.” III. Subscriber Information for Sanyo Cell Phone The petitioner admitted to trial counsel that the Sanyo cell phone belonged to him. He also indicated that subscriber informa- tion to the Sanyo did not exist.22 Counsel, faced with a similar ethical conundrum, proceeded under the theory that the Com- monwealth was unable to authenticate the text messages recovered from the cell phone. Counsel argued at trial that there was “no authentication, there was no way of proving that he had that phone ... . I was trying to separate Mr. Curry from that phone.” 23 See Commonwealth v. Koch, 106 A.3d 705 (Pa. 2014) (plurality); Com- monwealth v. Mosley, 114 A.3d 1072, 1081-82 (Pa. Super. 2015).

If somehow he was able to obtain sub- scriber information, he would have been precluded from arguing the cell phone did not belong to the petitioner. “Generally, counsel’s assistance is deemed constitutionally effective if he chose a particular course of conduct that had some reasonable basis designed to effectuate his client’s interests. ... Where matters of strategy and tactics are concerned, a finding that a chosen strategy lacked a reasonable basis is not warranted unless it can be concluded that an alternative not chosen offered a poten- tial for success substantially greater than the course actually pur- sued.” Commonwealth v. Spotz, 624 Pa. 4, 33, 84 A.3d 294, 311-12 (2014) (internal citations and quotations omitted) citing Common- wealth v. Colavita, 606 Pa. 1, 993 A.2d 874, 887 (2010). “A claim of ineffectiveness generally cannot succeed through comparing, in hindsight, the trial strategy employed with alternatives not pur- sued.” Commonwealth v. Sneed, 616 Pa. 1, 20, 45 A.3d 1096, 1107 (2012) (internal quotations omitted). Here, counsel made a reason- able, strategic, and ethical decision to attack the author of the text messages. IV. Trooper Tempinski’s Report Trial counsel stipulated to the laboratory report prepared by Trooper Kurt Tempinski, a firearm expert.24 The report pertained to firearms and bullets recovered in this case. Nothing in his report directly implicated the petitioner. In the words of trial counsel, his testimony “didn’t help or hurt us.” 25 Furthermore, the petitioner’s defense was that he did not commit the robbery, and was not pres- ent when the robbery was committed. It would have been fool- hardy to contest the firearms evidence or that the bullets recovered were not fired at Officer Bryfogle from the recovered firearms.26 None of the firearms referenced by Trooper Tempinski’s report were found on the petitioner, nor did the evidence place them in

Birdsong, 611 Pa. 203, 24 A.3d 319, 335-36 (2011); Commonwealth v. Fletcher, 604 Pa. 493, 541, 986 A.2d 759, 788 (2009); Commonwealth v. Cheatham, 419 Pa. Superior Ct. 603, 613, 615 A.2d 802, 807 (1992). Strategic decisions will not be second guessed “so long as the strategy has a reasonable basis.” Id.27 V. Other Claims The petitioner contends that trial counsel was ineffective because he failed to file a post-sentence motion that the verdict was against the weight of the evidence. It is well settled that coun- sel will not be held to be ineffective for failing to raise meritless claims on appeal. Commonwealth v. Martin, 607 Pa. 165, 188, 5 A.3d 177, 190 (2010); Commonwealth v. Dent, 837 A.2d 571, 588 (Pa. Super. 2003); Commonwealth v. Pritchett, 320 Pa. Superior Ct. 359, 368, 467 A.2d 364, 367 (1983). One of the duties of peti- tioner’s counsel was to select claims most likely to succeed. Com- monwealth v. Best, 120 A.3d 329, 340-41 (Pa. Super. 2015); Com- monwealth v. Ellis, 534 Pa. 176, 183, 626 A.2d 1137, 1140 (1993) (“While criminal defendants often believe that the best way to pursue their appeals is by raising the greatest number of issues, actually, the opposite is true: selecting the few most important issues succinctly stated presents the greatest likelihood of suc- cess.”); see also, Commonwealth v. Robinson, 581 Pa. 154, 187 n.28, 864 A.2d 460, 479-80 n.28 (2004); cert. denied Robinson v. Pennsylvania, 546 U.S. 983 (2005). [A] verdict is against the weight of the evidence only when the jury’s verdict is so contrary to the evidence as to shock one’s sense of justice. ... It is well established that a weight of the evidence claim is addressed to the discretion of the trial court. ... [T]he role of the trial court is to determine that notwithstanding all the evidence, certain facts are so clearly of greater weight that to ignore them, or to give them

A motion for a new trial on the grounds that the verdict is contrary to the weight of the evidence concedes that there is sufficient evidence to sustain the verdict; thus the trial court is under no obligation to view the evidence in the light most favorable to the verdict winner. ... Commonwealth v. Rivera, 603 Pa. 340, 362, 983 A.2d 1211, 1225 (2009) (internal citations and quotations omitted). It has been explained that a weight of the evidence claim is an extraordinarily difficult claim to prove. “A verdict is said to be contrary to the evidence such that it shocks one’s sense of justice when the figure of Justice totters on her pedestal, or when the jury’s verdict, at the time of its rendition, causes the trial judge to lose his breath, tem- porarily, and causes him to almost fall from the bench, then it is truly shocking to the judicial conscience.” Commonwealth v. Boyd, 73 A.3d 1269, 1274-75 (Pa. Super. 2013) (internal citation and quotations omitted). It is highly unlikely that anyone would be shocked by the verdict in this case. Counsel’s opinion was that “a weight of the evidence claim had zero chance of going forward.” 28 As a result, he pursued the authentication issue, which in light of Koch, was more likely to prevail. In other words, he engaged in the “process of ‘winnowing out weaker arguments on appeal.’ ” Smith v. Murray, 477 U.S. 527 (1986). The petitioner’s claim that counsel was ineffective because he failed to subpoena Edward Maye, a convicted co-conspirator, deserves limited comment. At the outset of the PCRA hearing, PCRA counsel was set to withdraw the issue, but did not do so.29 The petitioner essentially presented no testimony to support his claim. Trial counsel testified that not only was Maye unwilling to testify, but he had provided statements implicating the petitioner.30 Finally, it is alleged that counsel was ineffective because he failed to “review or discuss discovery” with the petitioner. It has been held that counsel is not obligated to share discovery with the

Petitioner has failed to show a reasonable probability that, but for trial counsel’s failure to provide him with copies of the discovery materials, the outcome of his trial would have been dif- ferent.” Id. (internal citations omitted). Here, the petitioner acknowledged at the PCRA hearing that he reviewed certain discovery with counsel, including Edward Maye’s statement. Furthermore, copies of police reports and the text messages retrieved from the Sanyo cell phone were reviewed with him and a copy provided to him.31 It is not alleged that counsel failed to request and secure discovery, nor is it alleged that counsel failed to conduct any in- vestigation. Counsel fulfilled all of his obligations in that regard. See Commonwealth v. Timchak, 69 A.3d 765, 770 (Pa. Super. 2013). The petitioner’s claim appears limited to the extent with which trial counsel reviewed the discovery materials with him. Such a claim does not support a finding of ineffectiveness. For all the foregoing reasons, the petitioner’s request for PCRA relief is denied.

The Bar Association of Lehigh County has started the Annual Ask for the Lehigh County Lawyer’s Charitable Fund Grant. This year’s theme is “Homeless and Mental Illness “ and we are asking all organizations applying to keep that mind as they complete their request.

We are proud to remind all lawyers that the Bar Association of Lehigh County has conducted an Assistance Program to benefit area 501c3 organizations to provide much needed assistance to our surrounding communities for many years. This program has raised over $200,000 throughout that time and distributed these funds to many deserving area organizations.

This year to assist these organizations, we are asking each and every lawyer to give generously to help support those in our local community. Remember, these contributions stay in the Greater Lehigh Valley area.

The Program is administered through the Lehigh Valley Community Foundation and all gifts are tax deductible to the fullest extent of the law. The Foundation will acknowledge all gifts for tax purposes.

This lecture will examine the highlights of perhaps America’s most brilliant legal career by looking not only at Holmes’ major dissents and decisions but also looking to his life history as being a basis for many of his legal theories. Holmes, in addition to being a brilliant jurist, is a profoundly interesting human being as we will see.

Attorney Malcolm J. Gross is a founding partner of Gross McGinley, LLP, headquartered in Allentown, where he has long represented media interests, including representing them in their pursuit of access to government records. Malcolm J. Gross was born in Allentown, PA. He graduated from Muhlenberg College, cum laude in 1962, with a Bachelor’s Degree in History and Political Science. He earned his J.D. from Villanova University School of Law in Philadelphia in 1965 and was admitted to the Pennsylvania Bar that year. While at Villanova, he was an editor of the Law Review. Mr. Gross also is admitted to the United States District Court for the Eastern District and Middle Districts of Pennsylvania, the United States Court of Appeals for the Third Circuit and the Supreme Court of the United States.

Attorney Gross has written on a wide range of topics, and his articles have appeared in such national publications as Social Work, Case & Comment, and Communications and the Law. He also has published work in the Pennsylvania Bar Quarterly and the Pennsylvania Law Journal Reporter. Some of his articles cover press law including defamation, subpoenas, and freedom of information issues. He also writes about general-interest issues such as custody and domestic relations.

In 2004, 2006, and 2012, Attorney Gross was named a Pennsylvania Super Lawyer, reserved for the top 5 percent of Pennsylvania attorneys, and holds an AV Rating by Martindale- Hubbell Legal Directory.

“Immigration Law Pro Bono for the Non-Immigration Lawyer” Presented by: David Trevaskis, Esq. Thursday, December 3, 2015

This session will highlight developments in immigration law, especially the status of immigration reform that will provide opportunities for pro bono service for both the veteran immigration lawyer and the non-immigration attorney. Featured is Citizenship Day, an annual opportunity for pro bono service that any lawyer can support. DACA, Deferred Action for Childhood Arrivals, will be discussed to emphasize how work in such areas requires immigration expertise.

David Keller Trevaskis, Esq., is an attorney and former third grade teacher with a Master’s Degree in Education. He is the Pro Bono Coordinator for Legal Services for the Pennsylvania Bar Association (PBA), responsible for assisting local bar associations, legal services programs and other groups who offer pro bono legal services across the Commonwealth. Trevaskis coordinates the PBA’s pro bono placement efforts, using the PALawHelp.org and PAprobono.net technologies to expand the resources for the neediest among us. He runs the PBA’s Pro Bono Office and the wide range of that work is viewable at http://www.pabar.org/public/probono/probonohome.asp. Trevaskis is a frequent presenter across Pennsylvania on civil legal aid and pro bono issues and is recognized as a national expert in public education about the law. He is the recipient of the 1996 Philadelphia Bar Association’s Leon J. Obermayer Education Award, a 2000 President’s Award from the Pennsylvania Bar Association for the Project PEACE anti-violence program he developed and still coordinates, the Philadelphia Bar Association’s Young Lawyer Division’s 2002 F. Sean Peretta Service Award, and a 2004 Chester County Bar Association President’s Award. In 2006, Trevaskis was the second recipient of the Compass Award, which was first given to United States Supreme Court Justice Sandra Day O’Connor. During that same year, Trevaskis received the President’s Citation from the Indiana Bar Association and the LEAP-Kids Lifetime Achievement and Mentor Award. In 2007, Trevaskis received the President’s Award from the Delaware County Bar. Trevaskis was one of ten inaugural Gavel Award winners from Community College of Philadelphia in 2009.

Ethical requirements and what to do with old client files; development of a records management policy – how and why. In the wake of Zubulake I thru VI, it is important to have an understanding of how to manage both electronic and paper documents.

Ellen Freedman serves as the Law Practice Management Coordinator for the Pennsylvania Bar Association. In that capacity she assists PBA’s members with management issues and decisions on the business side of their practice, including areas like technology, bookkeeping procedures, human resources, risk management, setting up a practice and so forth. Ellen Freedman is founder and President of Freedman Consulting, which assists Delaware and Lehigh Valley law firms with mergers, partner compensation issues, strategic planning, management of projects in such areas as technology, financial management, time and billing, facilities, human resources, and providing computer training ad hoc or in a classroom setting.

Ellen holds the designation of Certified Legal Manager through the Association of Legal Administrators (ALA), the credentialing body for the CLM degree. She was one of the first 20 in the nation to have achieved this designation. (Currently less than 200 in the nation have earned the degree.) She holds a Certification in Computer Programming from Maxwell Institute, a Certification in Web Site Design from Temple University, and a B.A. from Temple University, where she also did two years of graduate studies in Criminology.

Ellen managed inside law firms for twenty years. Most of that time was spent in a mid-size (35+ attorney) firm environment. She launched her consulting practice in 1998, and joined the Pennsylvania Bar Association in 1999. Ellen has been a frequent author and speaker on law firm management issues on a national, regional and local level.

He has served as the Chair of the Pennsylvania Bar Association Bankruptcy Committee (1992-95), of the Berks County Bar Association Bankruptcy Committee (1993), and of the Eastern District of Pennsylvania Bankruptcy Conference (1996-97). He received his B.A. from Yale University and his J.D., magna cum laude, from Dickinson School of Law, where he received the Walter Harrison Hitchler award for graduating first in his class. VOLUNTEER OPPORTUNITY:

Bradbury-Sullivan LGBT Community Center recently purchased a 13,000 square foot building in downtown Allentown to provide services for the Lehigh Valley LGBT community.

Once open, the space will provide free health testing, a legal clinic, an LGBT library, meeting and event space, a variety of support groups and book clubs, computer access, and more.

The Bar Association of Lehigh County will be volunteering on Tuesday, December 8th to help get the center ready to open, by painting and assisting with other tasks.

Volunteers are needed in two shifts, from 10:30pm-12pm and from 12pm-1:30pm. To sign up, please contact Erin at [email protected].
