    THE ICJ IN THE SERVICE OF PEACE AND JUSTICE Words of welcome by President Tomka Excellencies, Dear Guests and friends, It is with great pleasure that I greet you this morning on behalf of the International Court of Justice on the occasion of the Conference organized by the Court to celebrate the centenary of the Peace Palace. We are particularly pleased to welcome such eminent guests on this occasion, and are similarly delighted that our invitation to this Conference has been met with a very positive response. As a result, we were able to bring together a roster of very distinguished speakers in today’s panels, for which we are very grateful. We are privileged to host this Conference in the recently renovated Great Hall of Justice, with its improved, modern working facilities. In many ways, this renovation and the centennial festivities not only provide a propitious moment to reflect upon the great past and history surrounding this Hall, the Palace and its occupants, but also they present us with the opportunity to look forward and embrace a future in which international peace, justice and modernity can work in concert. Thus, today we not only celebrate the Palace, but also the great advances that have been made inside its walls towards creating a safer and more peaceful world. In this regard, the Conference programme is equally rich as it is balanced in engaging the past and present of international justice, while also entertaining future prospects and challenges for the work of the Court and beyond. Thus, the past, present and future will very much be reflected in the various themes addressed today, be they “A Century of International Judiciary and Prospects for the Future”, “The International Court of Justice and the International Legal System”, “The Role of the International Court of Justice for Enhancing the Rule of Law”, and “The International Court of Justice and the United Nations: Relationship of the ICJ with other UN Organs”.

Groves High School Beverly Hills, Michigan Ruth Kay Detroit Country Day School Beverly Hills, Michigan Background The United Nations (UN) was founded as an international organization in 1945. It is made up of 193 Member States. Over a 72-year period, more than 1 million individuals from 125 countries have served in 71 peacekeeping missions. As of 2021 there are approximately 90,000 peacekeepers in 12 operations around the world (UN 2021). The number one goal of UN Peacekeeping is to protect civilians. In addition to their main goal, the UN identifies a total of six objectives of their Peacekeeping operations: Protecting civilians, Preventing conflicts, Building Rule of Law and security institutions, Promoting human rights, Empowering women, and Delivery of field support. Of late, the UN has made a commitment to include more women in peacekeeping roles. Ultimately, the deployment of women as peacekeepers is up to the member states. But the UN has established a global effort to increase the role of women. According to the UN, “The 2028 target for women serving in military contingents is 15%, and 25% for military observers and staff officers. The 2028 target for women serving in formed police units is 20%, and 30% for individual police officers.” Main Organs The main organs of the United Nations (UN) are the General Assembly, Security Council, Economic and Social Council, Trusteeship Council, International Court of Justice, and the Secretariat. The General Assembly is the main organ of the United Nations.

The International Court of Justice (ICJ), the principal judicial organ of the United Nations, today commemorated the 75th anniversary of its inaugural sitting, which took place on 18 April 1946 in the Great Hall of Justice of the Peace Palace in The Hague. The Court was set up in the aftermath of the Second World War as the principal judicial organ of the United Nations. The Statute of the Court forms an integral part of the Charter of the United Nations, which was signed in San Francisco on 26 June 1945 and came into force on 24 October 1945. The first Members of the Court were elected on 6 February 1946 at the First Session of the General Assembly and the Court held its inaugural sitting at the Peace Palace, The Hague, on 18 April 1946. On the occasion of the 75th anniversary of the Court, the President of the Court, Judge Joan E. Donoghue, made a statement which can be viewed on UN Web TV. In her statement, President Donoghue noted that since the establishment of the ICJ, “States have submitted over 140 disputes to it”, adding that the Court has also received “over 25 requests for advisory opinions .

The European Union) The Hague, 17 March 2014 The Arbitral Tribunal Holds First Organizational Meeting with the Parties On 15 March 2014, representatives of the Kingdom of Denmark in respect of the Faroe Islands and the European Union convened at the Peace Palace in The Hague for a first organizational meeting with the Arbitral Tribunal constituted under Annex VII to the United Nations Convention on the Law of the Sea (“Convention”). The arbitration was commenced by letter dated 16 August 2013 by the Kingdom of Denmark in respect of the Faroe Islands addressing to the European Union a Notification and Statement of Claim invoking Articles 287 and 288(1) of the Convention, and Article 1 of Annex VII to the Convention. The dispute concerns the interpretation and application of Article 63(1) of the Convention in relation to the shared stock of Atlanto- Scandian herring. The Arbitral Tribunal is chaired by Judge Thomas A. Mensah (Ghana). The other members of the Arbitral Tribunal are Professor Gerhard Hafner (Austria), Professor Francisco Orrego Vicuña (Chile), Dr. M.C.W. Pinto (Sri Lanka) and Judge Rüdiger Wolfrum (Germany). The Permanent Court of Arbitration (“PCA”) acts as Registry in the arbitration by agreement of the Parties. At the first organizational meeting, the Arbitral Tribunal and the Parties discussed the procedural framework for the arbitration. On the proposal of the Parties, the Arbitral Tribunal accepted a calendar for pleadings pursuant to which the Kingdom of Denmark in respect of the Faroe Islands will file its first written submission on 15 July 2014, and the European Union will file its first written submission on 15 October 2014.

    doi:10.1017/aju.2020.25 SYMPOSIUM ON ART, AESTHETICS, AND INTERNATIONAL JUSTICE THE PEACE PALACE: BUILDING (OF) THE INTERNATIONAL COMMUNITY Tanja Aalberts*, and Sofia Stolk** These things also require their material forms, their easily recognizable visible symbols, their homes. [With the Peace Palace,] international justice between nations has moved into a splendid home. The proud building is standing now, visible, and tangible: Temple, symbol and workplace. At least the spirit of peace is no longer homeless.1 At the festivities around the opening of the Peace Palace in August 1913, Bertha von Suttner—1905 Nobel peace prize winner and early advocate for an international court for arbitration—emphasized the importance of a home for international justice as a temple, a symbol, and a workplace. In line with Suttner’s observation, this essay argues that the Peace Palace is more than just a venue where international law is practiced: it provided a material home for the international community and thereby helped to sing this “imagined community”2 into exis- tence. By studying the historical context of the establishment of the Peace Palace, we draw attention to the impor- tance of the building as well as the gifts that it received from states in imagining and enacting the international community. Moreover, we discuss how two paradoxes underpinning the ideal of the international community also transferred into its material referent: the tensions between unity and individuality and between universalism and exclusion. As the residence of the Permanent Court of Arbitration and the International Court of Justice, the Peace Palace is one of the most prominent stages of international law and a visible symbol of the international community of (allegedly) equal sovereign states; the magisterial scenery to the practice of the international community to promote the goals of international justice and create a peaceful international order.

    Mr. Bill Pace∗ Throughout the world the Coalition and governments are hosting celebrations of the 10th anniversary of the Rome Statute of the International Criminal Court. Earlier today, in South Africa, Judge Navi Pillay, Deputy Prosecutor Fatou Bensuda, Archbishop Desmond Tutu are among the keynote speakers; but other celebrations are being held in Iran, Benin, Indonesia, Guatemala, Moldova, India, Ukraine, Nigeria; last week at the Peace Palace. Most of us who were in Rome on Friday evening July 17, 1998 for the UNGA International Criminal Court treaty conference will, I believe, never experience another moment like that in our lives. I have never seen such an outbreak of emotion and celebration in any intergovernmental conference. We knew the moment the treaty was adopted that we were simultaneously making and challenging history. Nothing in the last ten years has clouded this judgment. I believe today it was as important and historic an achievement as on that extraordinary tension-filled day. In fact, if anything, it seems more of a miracle now than it did then. The dreadful geopolitical developments of the last 8 years mean so many things, but also that had the Statute not been adopted in Rome, there would still be no treaty, no International Criminal Court. I believe history will greatly honor the gift to peace bestowed by the extraordinary assemblage of world lawmakers – from governments, international organizations and civil society. This was equal to ten thousand “Agincourts” or “world cups” and we must not shy from the achievement… or the responsibility. I am honored to speak on behalf of the NGO Coalition for the International Criminal Court (CICC) which has proven to be one of the most successful civil society networks and campaigns in the world.

    100 YEARS OF INTERNATIONAL ARBITRATION AND ADJUDICATION KENNETH KEITH* On 28 August 1913, the Peace Palace in The Hague was opened in the presence of Queen Wilhelmina. Andrew Carnegie, the Scottish American philanthropist who provided the major funding for the building, recorded in his diary that evening that [n]othing he [man] has yet accomplished equals the substitution for war, of judicial decisions founded upon International Law, which is slowly, yet surely, to become the corner stone, so long rejected by the builders, of the grand edifice of Civilization.1 The Peace Palace was built to house the Permanent Court of Arbitration (‘PCA’), which was established by the Hague Conventions for the Pacific Settlement of International Disputes.2 It was said of that body that it ‘is not permanent because it is not composed of permanent judges; it is not accessible because it has to be constituted for each case; it is not a court because it is not composed of judges’.3 Neither did it arbitrate. Rather it was a secretariat with a list of possible arbitrators if states in dispute were willing to agree to use its * Judge, International Court of Justice.     Introduction Steven van Hoogstraten * This book is a compilation of reflections on some widely divergent themes in public international law and in international criminal law. From the constitutional role of the International Court of Justice (ICJ) within the UN system to the innovation of international criminal law. From the jurisdictional complexities of the ICJ to the universal protection of human rights. The history and legacy of the International Criminal Tribunal for the former Yugoslavia (ICTY). The widely known Yukos arbitral award by the PCA. What these themes have in common are basically two matters. The first is that they try to identify more the underlying thoughts and considerations – what I would call the legal political considerations – than the detailed description of a subject. General impression and a helicopter view take precedence over minute description. And the second is that most of these contributions have been produced in The Hague, the international city of Peace and Justice. More in particular these reflections are in some way related to in the Peace Palace, home to the ICJ and the PCA. The Peace Palace was the result of The Hague peace treaties of 1899 and 1907 and it opened its doors in 1913 after steel magnate Andrew Carnegie donated a grand sum of money. This iconic Peace Palace has contributed so much to the image of The Hague, city of the government of the Netherlands and city of diplomats, international organizations and courts. It is for that reason that this book has the intention of giving “a view from The Hague”. While the Security Council has addressed maritime challenges over the past seven decades, a diplomatic renaissance began in 2008 with decisions impacting naval engagements unfolding with unparalleled frequency: From 1946 to 2007, resolutions were adopted about once every 1.7 years, and since, are now approved every 2.5 months.
