BUSINESS TO BE CONSIDERED IN PUBLIC The Committee agreed that all its business would be conducted in public. 2. DECLARATION OF INTERESTS Councillor John Hensley declared a personal and prejudicial interest in Item 1 – Brunel University, The Meadows, Site 1, Uxbridge Campus, Cleveland Road, as he was an Ex Don and Academic Adviser to Brunel University, and left the meeting during the discussion on this item. Councillor Judith Cooper chaired the meeting for this item. Councillor Paul Buttivant declared a personal and prejudicial interest in Item 12 - 518 & 520 Sipson Road, Sipson, as he had reported the unauthorised use on behalf of residents and left the meeting during the discussion on this item. 4. DECISIONS ON APPLICATIONS Decisions on applications are shown below and are based on Agenda and reports for the meeting, and an Addendum sheet circulated at the meeting. Item Address Ward Proposal Application Number No. 1. Brunel University Uxbridge Reserved matters, new 532/APP/2008/1224 The Meadows, South access road from Cowley Site 1 Road leading to a car park for Uxbridge Campus 28 vehicles (Including 20 Cleveland Road spaces for people with disabilities), relocation of existing footpath to align with new road, together with associated infrastructure and landscaping Central & South Planning Committee Minutes – 12th August 2008 Page 1 In accordance with the Council’s constitution a representative of the petitioners addressed the meeting. The agent was not present at the meeting. A member asked for the comments made by the Metropolitan Police with reference to secure by design are added as an informative. This was agreed by the committee. In answer to a question raised as to whether the proposed access road encroaches on the Green Belt officer’s reported that it did encroach on the Green Belt but on the Master Plan was shown as a country lane. A member suggested that this should be added to reason for refusal 1 as the access road dissects the Green Belt land, which has been protected for years and is a green and leafy area prevalent to a Conservation Area. Officer’s suggested that reason for refusal 1 be amended to insert after ‘its’ in the first line ‘bisection and’. This was put to members and agreed. Members agreed to a further informative being added to ensure that any future application is DDA compliant. The recommendation with the amendments was moved, seconded and on being put to the vote was agreed Resolved – That the application be Refused for the reasons set out in the officer’s report. Reason for refusal 1 was amended to insert after ‘its’ in the first line ‘bisection and’ ….……. An additional two informatives were added as follows:- 3. In the event of any further application being submitted the applicants attention is drawn to comments from the Metropolitan Police Crime Prevention Officer that the landscaping should be designed and maintained to ensure natural surveillance of the car park can be achieved from the adjacent student accommodation. 4. In the event of any further application being submitted the applicants’ attention is drawn to the need to ensure that any proposals are DDA compliant, any barriers are designed for ease of use by disabled persons and the access road is of an appropriate width. Item Address Ward Proposal Application Number No. 2. 186 Grosvenor Crescent Hillingdon Erection of a two-storey 25424/APP/2007/3703 Hillingdon East detached one- bedroom house with flat eco roof and integral garage This application was withdrawn by the applicant. Central & South Planning Committee Minutes – 12th August 2008 Page 2 Item Address Ward Proposal Application Number No. 3. 32A Pole Hill Road Hillingdon Variation of Condition 11 of 30117/APP/2007/3661 Hillingdon East Planning Permission ref: 1729D/1830 dated 08/07/1966 (Erection of 8 terrace houses and 8 garages) to remove site boundary fencing between No.32A Pole Hill Road and Sheridan Close In accordance with the Council’s constitution two representatives of 2 petitions received objecting to the proposal and the agent addressed the meeting. The Legal Adviser reported that the issue raised in relation to the parking of vehicles in front of the garages in Sheridan Close was a Private Law issue, which residents need to seek Legal advice on. The Ward Councillor addressed the meeting stating that the decision to approve was taken without consideration being given to condition 11 and would hope the same would be done with this application. The planning permission in 1966 was attached to safeguard the amenity of the residents of Sheridan Close. The proposal to vary this condition will adversely affect the properties in Sheridan Close. There has been no mention of condition 5, which states that the land should not be used for any other purpose. The application to vary condition 11 should be refused and access to this should be gained from Pole Hill Road. A member asked why the application had not included a variation to condition 5 as highlighted by the Ward Councillor. Members were informed that the committee needed to make the decision on the application before them. It is not unusual for a variation of conditions to be made separately. A member made reference to the planning permission granted in 1966 and that the land fronting the garages had been used exclusively for residents of Sheridan Close in excess of 20 years. I accept that this is a private legal matter but the variation of the condition is a planning matter and see no reason for departing from the condition as originally approved. In answer to a question raised in relation to the right of way and Members were informed that residents would have right of way across the land to access their garages but not for parking. Enforcement against residents and tenants of the flats would be a private matter for the owner of the site. Officer’s raised concerns that as members approved the scheme with access from the rear there would be implications if members were minded to refuse this application as without condition 11 being varied the permission could not be implemented. Central & South Planning Committee Minutes – 12th August 2008 Page 3 The Chairman felt that there was material information that needed to be clarified before the committee makes a decision on this application. This being in relation to whether the size of the access could be reduced, type of wall /railings to be provided, gates to be kept closed when not in use and a Legal safeguarding for the residents of Sheridan Close. It was moved and seconded that the application be deferred for further information to be provided and on being put to the vote was agreed. Resolved – That the application be Deferred, to enable further information to be provided. Item Address Ward Proposal Application Number No. 4. 1and rear of 2 Townfield Retention of a single-storey 15826/APP/2006/2664 Broadway Parade side/rear extension for use Coldharbour Lane as hand car wash with car Hayes waiting area and staff parking The petitioner and applicant/agent were not present at the meeting. The recommendation for refusal, enforcement and prosecution was moved, seconded and on being put to the vote was agreed. Resolved – (A) That the application be Refused for the reasons set out in the officer’s report, (B) That Members, having regard to the provisions of the Hillingdon Unitary Development Plan (Saved Policies September 2007) (UDP) and all other material planning considerations, in accordance with Section 172 of the Town and Country Planning Act 1990 (as amended), granted authority for the service of an Enforcement Notice in respect of the following breach of planning control: The unauthorised erection of a glazed wooden paneled side/rear extension with front and rear roller shutters 2. That the Enforcement Notice (s) requires the following steps to be undertaken in order to remedy this breach: (i) Demolish the unauthorised erection of a glazed wooden paneled side/rear extension with front and rear roller shutters (ii) Remove from the land subject of the Notice (s) all debris, building material, waste, plant and machinery resulting from compliance with step (i) above. 3. That the reasons stated for the issue of the notice be stated as follows: (i) The single storey side and rear extension by reason of its incongruous external finish and projection forward of the established building line along Minet Drive represent an unduly intrusive and incongruous form of development detrimental to the visual amenities of the street scene. The Central & South Planning Committee Minutes – 12th August 2008 Page 4 proposal is therefore contrary to policies BE13, BE15 and BE19 of the Hillingdon Unitary Development Plan Saved Policies September 2007. 5. It appears to the Council that the operation development has taken place within the last 4 years. 6. That the period of 6 months be given for compliance with the terms of the enforcement notice. (C) PROSECUTION In the event of non-compliance to the terms of such Notice (s) as may be issued, the Borough Solicitor, in conjunction with the Director of Planning and Community Services, be authorised to take all further proceedings necessary to ensure compliance with the Enforcement Notice.
