Take Action If you have experienced school-based bullying, harassment, or discrimination, file a complaint with the Office for Civil Rights (OCR) at the U.S. Education Department today. Things to know about filing a complaint: You are entitled to file a claim. Nearly every public school receives some level of federal funding and is therefore protected under Title IX, which entitles you to file a bullying, harassment, or discrimination claim with OCR. Time is of the essence. A complaint must be filed within 180 days of when the bullying, harassment, or discrimination occurred. Your confidentiality is assured. -

Svikhart* INTRODUCTION Shaun McCutcheon’s was the “next big campaign finance case to go before the Supreme Court.”1 When the Alabama GOP warned the conservative businessman that his 2010 federal campaign contributions might soon exceed a congressionally imposed limit, he decided to “take a stand.”2 Together, McCutcheon and the Republican National Committee (RNC)—which “wish[ed] to receive the contributions that McCutcheon and similarly situated individuals would like to make” in the absence of such aggregate contribution limits3—challenged the responsible statutory regime4 on First Amendment grounds and attracted national attention en route to a victory before the Supreme Court.5 But while McCutcheon and the RNC prevailed in their case, they failed in another noteworthy regard—Chief Justice Roberts’s controlling opinion declined their request to squarely overrule a relevant portion of the landmark campaign © 2017 Riley T. Practice Advisory | November 2018 PUBLIC CHARGE AND NATURALIZATION By Erin Quinn and Melissa Rodgers I. Introduction On October 10, 2018, the Department of Homeland Security (DHS) published a proposed rule related to public charge in the Federal Register. The proposed rule is not current law. We are many steps away from a final rule and its implementation. Even after the 60-day comment period for the proposed rule, DHS must review and consider all submitted comments before the rule becomes final. If the agency chooses to proceed with the rule, the final rule will then be published in the Federal Register. We expect it to be many months before DHS publishes a final rule on public charge. Even after publication, legal challenges could delay implementation. The proposed rule interprets a provision of the Immigration and Nationality Act (INA) pertaining to inadmissibility. The inadmissibility ground at issue says a person is inadmissible if they are likely to become a public charge, which is a concept having to do with the likelihood that an immigrant will be financially self-reliant or need publicly funded support. (INA § 212(a)(4)). This law only applies to individuals seeking admission into the United States or applying for adjustment of status. This is not a provision of the law that applies to all immigrants. 1 Indeed, the eligibility requirements for naturalization do not include a public charge test. The legal use of government benefits and programs does not disqualify a permanent resident from naturalization. This practice advisory provides an update on public charge for advocates providing naturalization legal assistance. -

Reference Guide for Transgender Policy CIAC Transgender Policy Page 54 – Article IX - Rules of Eligibility and Control for Boys and Girls High School Athletics in Connecticut: Section B. Transgender Participation The CIAC is committed to providing transgender student-athletes with equal opportunities to participate in CIAC athletic programs consistent with their gender identity. Hence, this policy addresses eligibility determinations for students who have a gender identity that is different from the gender listed on their official birth certificates. The CIAC has concluded that it would be fundamentally unjust and contrary to applicable state and federal law to preclude a student from participation on a gender specific sports team that is consistent with the public gender identity of that student for all other purposes. Therefore, for purposes of sports participation, the CIAC shall defer to the determination of the student and his or her local school regarding gender identification. In this regard, the school district shall determine a student’s eligibility to participate in a CIAC gender specific sports team based on the gender identification of that student in current school records and daily life activities in the school and community at the time that sports eligibility is determined for a particular season. Accordingly, when a school district submits a roster to the CIAC, it is verifying that it has determined that the students listed on a gender specific sports team are entitled to participate on that team due to their gender identity and that the school district has determined that the expression of the student’s gender identity is bona fide and not for the purpose of gaining an unfair advantage in competitive athletics. -

Trump Judges: Even More Extreme Than Reagan and Bush Judges September 3, 2020 Executive Summary In June, President Donald Trump pledged to release a new short list of potential Supreme Court nominees by September 1, 2020, for his consideration should he be reelected in November. While Trump has not yet released such a list, it likely would include several people he has already picked for powerful lifetime seats on the federal courts of appeals. Trump appointees' records raise alarms about the extremism they would bring to the highest court in the United States – and the people he would put on the appellate bench if he is reelected to a second term. According to People For the American Way’s ongoing research, these judges (including those likely to be on Trump’s short list), have written or joined more than 100 opinions or dissents as of August 31 that are so far to the right that in nearly one out of every four cases we have reviewed, other Republican-appointed judges, including those on Trump’s previous Supreme Court short lists, have disagreed with them.1 Considering that every Republican president since Ronald Reagan has made a considerable effort to pick very conservative judges, the likelihood that Trump could elevate even more of his extreme judicial picks raises serious concerns. On issues including reproductive rights, voting rights, police violence, gun safety, consumer rights against corporations, and the environment, Trump judges have consistently sided with right-wing special interests over the American people – even measured against other Republican-appointed judges. Many of these cases concern majority rulings issued or joined by Trump judges. -
