Article 19: Freedom of Opinion and Expression Why would a human rights organization go to court to support someone whose extreme political views or ethical position it fundamentally opposes? A pornographer perhaps, or an anarchist? Because of the rights asserted in Article 19 of the Universal Declaration of Human Rights (UDHR), we all have the right to form our own opinions and to express and share them freely. “If we do not believe in freedom of expression “The first human who hurled an for people we despise, we do not believe in it at insult instead of a stone was the all,” says linguist and political activist Noam founder of civilization.” Chomsky. A common metaphor to describe its limits is that you cannot falsely yell “fire” in a crowded theatre and cause a panic and possible injury. Other forms of speech generally not protected include child pornography, perjury, blackmail, and incitement to violence. The UDHR’s drafters wrestled with the issue of how tolerant a tolerant society should be of people like Nazis and fascists who themselves are intolerant. They were acutely conscious of the role played by the Nazi media and film industry in the creation of an environment that enabled the slaughter of 6 million Jews, and other groups such as the Roma and people with disabilities. -

The primary purpose of the assessment was to inform project efforts and build organizational knowledge. The results have been positive in this regard, and we therefore provide the document to others with the aim to inform organizations seeking to employ information and communication technologies in Afghan agricultural development. While we have attempted to be as thorough and objective as possible, the information in this report is not based on systematic field tests and surveys, but rather but rather interviews, case studies, and literature reviews. Consequently, we refrain from making concrete recommendations. Rather, this report should be viewed as an introduction to information and communication technologies for agricultural development in Afghanistan. -

Repression has increased drastically and a more assertive public position from states is crucial to protecting Algerians peacefully exercising their rights to freedom of expression, association and assembly. Kenya: ARTICLE 19 Calls for Expansion of Freedom of Expression Rights to Be Integrated Into the New Draft Constitution of Kenya
For immediate release – 15 May 2009 Kenya: ARTICLE 19 Calls for Expansion of Freedom of Expression Rights to be Integrated into the New Draft Constitution of Kenya Today, ARTICLE 19 Kenya and East Africa, based in Nairobi, Kenya, submitted its comments to the Committee of Experts for the new Constitutional Review Process currently ongoing in Kenya. ARTICLE 19 welcomes the review process and calls on the Committee of Experts to ensure the new Draft Constitution of Kenya is in line with freedom of expression and information best practice and international standards, as laid out in Article 19 of the International Convention on Civil and Political Rights (ICCPR), which Kenya has signed and ratified. The Constitutional Review Process seeks to improve the current Constitution of Kenya which was first developed in 1963, and amended in 1996. The current process to review the Constitution will be the third of its kind. The Committee of Experts is responsible for developing a new draft Constitution by 1 December 2009. The final draft is expected to be adopted by Parliament by 2 March 2010 prior to a constitutional referendum. In its note to the Committee of Experts, ARTICLE 19 highlights the areas where guarantee of freedom of expression falls short of international human rights law and standards on the right to freedom of expression, the right to access information, and media freedoms. ARTICLE 19’s recommendations to the Committee of Experts include: That the Committee should ensure that the new Draft Constitution of Kenya protects the right of freedom of expression, including the right to information, in compliance with international and regional human rights law and standards. -
The Internet Beyond Borderless Versus Balkanized
POROUS TERRITORIES: THE INTERNET BEYOND BORDERLESS VERSUS BALKANIZED LUKE MUNN Western Sydney University (Australia) [email protected] Abstract: If the internet was once viewed as a borderless realm, critics now warn it is in danger of being “balkanized”, splintering into nationalized fragments. Certainly nation-states increasingly see the Internet as “their” internet, a national space to be regulated and actively shaped. The first half of this article charts the technologies that appear to place this vision within reach: data localization, internet shutdowns, and internet filtering. These moves promise to exert sovereign control, to make the inter- net an extension of national territory. Yet by drawing on two recent events in China, this article argues that these territories are messy and their borders are permeable. Pro-government activists jump across the firewall in order to attack individuals and organizations who threaten the stability and security of their motherland. Simultane- ously, individuals scale the firewall in order to question the party line and express solidarity with democratic movements, undermining the political and technical boundaries established by their nation. Internet architectures create a condition where territorialization is constantly being both amplified and undermined by “extra- territorial” activities. These practices demonstrate the everyday porosity of internet territories, providing a messier portrait that goes beyond the dichotomy of borderless vs balkanized. At the dawn of the internet, cyberspace was framed as a new realm decoupled from the state. This digital sphere stretched across the globe, making it essentially ungovernable. -

Tygar, Chair Research on Internet censorship is hampered by poor models of censor behavior. Censor models guide the development of circumvention systems, so it is important to get them right. A censor model should be understood not just as a set of capabilities|such as the ability to monitor network traffic—but as a set of priorities constrained by resource limitations. My research addresses the twin themes of modeling and circumvention. With a grounding in empirical research, I build up an abstract model of the circumvention problem and examine how to adapt it to concrete censorship challenges. I describe the results of experiments on censors that probe their strengths and weaknesses; specifically, on the subject of active probing to discover proxy servers, and on delays in their reaction to changes in circumvention. I present two circumvention designs: domain fronting, which derives its resistance to blocking from the censor's reluctance to block other useful services; and Snowflake, based on quickly changing peer-to-peer proxy servers. I hope to change the perception that the circumvention problem is a cat-and-mouse game that affords only incremental and temporary advancements. -

The MoC has set up a three tier model for phone coverage, where the finishing of tier one and the start of tier two are under implementation. Today Kabul, Herat, Mazar-i-Sharif, Kandahar, Jalalabad, Kunduz has some access to phones, but not enough to supply the demand. Today there are concrete plans for extension to Khost, Pulekhomri, Sheberghan, Ghazni, Faizabad, Lashkergha, Taloqan, Parwan and Baglas. Beside the MoCs terrestrial network, two GSM vendors (AWCC and Roshan) have license to operate. The GoA has a radio network that reaches out to all provinces. 10 ISPs are registered. The .af domain was revitalized about a year ago, now 138 domains are registered under .af. Public Internet cafes exists in Kabul (est. 50), Mazar-i-Sharif (est. 10), Kandahar (est. 10) and Herat (est. 10), but NGOs has set up VSATs also in other cities. The MoC has plans for a fiber ring, but while the fiber ring may take some time, VSAT technology are utilized. Kabul University is likely offering the best higher education in the country. Here bachelor degrees in Computer Science are offered. Cisco has established a training centre in the same building offering a two year education in networking.
