Planning Sub Committee of Corporate Services Committee 7 May 2002 IRVINE, 7 May 2002 - At a Meeting of the Planning Sub Committee of Corporate Services Committee at 2.00 p.m. Present David Munn, Samuel Gooding, Jack Carson, Ian Clarkson, David Gallagher, Jane Gorman, Elizabeth McLardy, John Moffat, David O'Neill and Robert Rae. Councillor Munn declared an interest in items 2.1, 2.2 and 2.3, vacated the Chair and withdrew from the meeting. Councillor Gooding, the Vice-Chair assumed the Chair for the following items of business. 1. Deputation and Petition In terms of Standing Orders 17 and 18, the Chair advised that the Sub Committee would receive a Deputation and Petition on applications by Scottish Water (formerly West of Scotland Water) at items 2.1, 2.2 and 2.3 below for (i) the erection of a wastewater treatment works including access road, security fencing and landscaping to the site to the north of Feorline Shore Cottage; (ii) for the erection of a water pumping station including access roadway and ancillary works for the proposed collection/transfer system at the site opposite the Knoll; and (iii) for the erection of a wastewater pumping station including access roadway and ancillary works for proposed collection/transfer system to the site opposite Queenscliff, all Blackwaterfoot, Isle of Arran. Page 1 The Sub Committee heard Mr Donald Turner, Principal Spokesperson, Save Drumadoon Bay Petition raise concerns on behalf of other petitioners on the abovementioned proposals by Scottish Water. Also present were Mrs Brenda Hunter, Mrs Margie Currie and Mr Gordon Stewart to answer questions from Members. Petitioners confirmed general support for an improvement to the Water Treatment facilities on Arran but expressed concerns about the undernoted planning applications on certain grounds. These included odour, noise, limited numbers of Arran residents benefiting from the works, environmental concerns such as sewage flowing from outfills, limited community consultation, the positioning of facilities and the need to await detailed consideration by SEPA. In response Mr Gordon Laing and Mr Andy Leith, Scottish Water provided a detailed response to the petitioners concerns and clarified the purpose and design of the various water treatment facilities. It was confirmed that all appropriate environmental checks had been carried out by Scottish Water and consultation had taken place with a wide variety of experts in this field. Following the presentations, Members asked questions of both parties. The Sub Committee thereafter heard the Principal Development Control Officer present reports on each of the planning applications as follows:- 2. Arran Local Plan Area 2.1 N/00770/PP: Blackwaterfoot: Site to North of Feorline Shore Cottage Scottish Water, 419 Balmore Road, Glasgow have applied for planning permission for the erection of a wastewater treatment works including access road, security fencing and landscaping at the site to the north of Feorline Shore Cottage, Blackwaterfoot, Isle of Arran. 40 representations have been received (see Appendix PS1). The Sub Committee, having considered the terms of the objections and the views of petitioners, agreed to grant the application, subject to the following conditions: - 1. That prior to the commencement of the development details of the proposed hours of construction operations shall be agreed in writing with North Ayrshire Council as Planning Authority. 2. That the plant and equipment shall be designed, constructed and operated (a) in compliance with the best practicable technique principle; (b) such that there will be an absence of any perceived audible discrete tones, whines or hisses at sensitive receptors and that any noise generated will not dominate the ambient noise environment; and (c) such that the existing level of ambient noise is not increased, all to the satisfaction of North Ayrshire Council as Planning Authority. Page 2 3. That prior to the commencement of the development the applicants shall carry out a background noise survey and submit the results to North Ayrshire Council as Planning Authority. 4. That prior to the commencement of the development a detailed scheme of odour control measures for the wastewater treatment works shall be submitted for the written approval of North Ayrshire Council as Planning Authority, in consultation with the Principal Environmental Health Officer. Details should include the design of the plant, operational procedures, maintenance arrangements and procedures to be followed in the event of an emergency, with particular reference to odour control. The scheme shall demonstrate the best practicable means of odour suppression. 5. That prior to the commencement of the development the applicant shall submit for the written approval of North Ayrshire Council as Planning Authority the colour of the proposed external finishes. 6. That no development shall take place until there has been submitted to and approved by North Ayrshire Council as Planning Authority a scheme of landscaping, which shall include details of species, planting densities, soil treatment and aftercare and shall include indications of all existing trees and hedgerows on the land and details of any to be retained together with measures for their protection in the course of the development. 7. That all planting, seeding or turfing comprised in the approved details of landscaping shall be carried out in the first planting season and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which, within a period of five years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of a similar size and species, unless North Ayrshire Council as Planning Authority gives written consent to any variation. 8. That the mounding round the site shall be no greater than 0.5 metres above the existing ground level. 9. That hedging round the site shall be a species rich hedge containing four or more native woody species on average in a 30 metre length, to the satisfaction of North Ayrshire Council as Planning Authority. That the developer shall secure the implementation of an archaeological watching brief, to be carried out by an archaeological organisation acceptable to North Ayrshire Council as Planning Authority, during development work. The retained archaeological organisation shall be afforded access at all reasonable times and allowed to record and recover items of interest and finds. Terms of Reference for the watching brief will be supplied by West of Scotland Archaeology Service. The name of the archaeological organisation retained by the developer shall be given to North Ayrshire Council as Planning Authority and to the West of Scotland Archaeology Service in writing not less than 14 days before the development commences. 11. That prior to the commencement of the development details of finished site levels shall be submitted for the written approval of North Ayrshire Council as Planning Authority. 2.2 N/01/00774/PP: Blackwaterfoot: Site Opposite The Knoll Scottish Water, 419 Balmore Road, Glasgow have applied for planning permission for the erection of a water pumping station including access roadway and ancillary works for the proposed collection/transfer system at the site opposite the Knoll, Blackwaterfoot, Isle of Arran. Objections have been received from Brenda Hunter, 3 Hillcrest Street, Milngavie and Donald I Turner, Blairessan, Station Road, Killearn. The Sub Committee, having considered the terms of the objections and the views of petitioners, agreed to grant the application, subject to the following conditions: - 1. That prior to the commencement of the development a detailed scheme of odour control measures for the pumping station shall be submitted for the written approval of North Ayrshire Council as Planning Authority, in consultation with the Principal Environmental Health Officer. Details should include the design of the plant, operational procedures, maintenance arrangements and procedures to be followed in the event of an emergency, with particular reference to odour control. The scheme shall demonstrate the best practicable means of odour suppression 2. That no surface water shall issue from the access/driveway on to the public road. 3. That prior to the commencement of the development the applicant shall submit, for the written approval of North Ayrshire Council as Planning Authority, the type and colour of the proposed external finishes.
