(Consolidated up to 27/2010) ALBERTA REGULATION 343/79 Public Lands Act FOREST RECREATION REGULATION 1(1) In this Regulation, (a) “camping accommodation unit” means (i) a motorhome, (ii) a van, (iii) a truck camper, (iv) a trailer, (v) a tent trailer, or (vi) a tent used or to be used by a person as shelter equipment while camping; (a.1) “camping permit” means a permit under this Regulation authorizing camping; (a.2) “campsite” means a campsite in a forest recreation area that is designated in the forest recreation area as an individual campsite or, if there is no such designation, the general location in that area where persons actually engage in camping and ancillary activities, and includes any improvements on the land comprising the campsite; (a.3) “forest land use zone” means an area of forest land declared by this Regulation to be a forest land use zone; (b) “firearm” means a pistol, rifle, gun, sling-shot, bow and arrow or any other device which discharges a potentially harmful missile; (c) “group camp forest recreation area” means a forest recreation area that is designed for use by organized groups; Section 1 FOREST RECREATION REGULATION AR 343/79 (d) “highway” means that part of a secondary road, bridge, parking lot or other place intended for use by on-highway vehicles; (e) “motor vehicle” means a motor vehicle as defined in the Traffic Safety Act; (f) “off-highway vehicle” means a motor vehicle used for cross-country travel on land or water but does not include snow vehicles or motor boats; (g) “on-highway vehicle” means a motor vehicle designed for travel on a highway; (h) “open fire” means a fire that is not confined to a facility designed to contain fire; (h.1) “permit holder” means a person who has been issued a camping permit that is currently valid; (i) “secondary road” means any publicly owned road other than a primary highway as defined in The Public Highways Development Act; (i.1) “senior” means a person who is 65 years of age or older; (i.2) “single family unit” means a group that consists solely of persons who fall within one or more or all of the following categories of person: (i) one or both parents of dependent children of any age; (ii) those dependent children; (iii) parents of either or both of those parents; (j) “snow vehicle” means a motor vehicle designed and equipped to be driven exclusively or chiefly on snow or ice or both; (k) “registered trapping area” means an area or location defined and registered under The Wildlife Act for the taking of fur-bearing animals and fur-bearing carnivore on it by a licensed trapper; (l) “youth” means a person who has not attained the age of 18 years. (2) For the purposes of this Regulation and notwithstanding any other law, a night and a period expressed as a number of days shall be treated as expiring at 2:00 p.m. on the day in question unless a 2 Section 2 FOREST RECREATION REGULATION AR 343/79 forest officer extends the time of expiry, and a period of hours is measured exactly in point of time. AR 202/2002 s4 4 Section 5.95 FOREST RECREATION REGULATION AR 343/79 5.95 The area of forested land described in Schedule D.95 is declared to be a forest land use zone named the Ghost Forest Land Use Zone. AR 138/2007 s2 6 The areas of forest land described and named in Schedule E are declared to be forest recreation areas. AR 343/79 s6 7 The areas of forest land described and named in Schedule F are declared to be forest recreation trails. AR 343/79 s7 General Regulation 8 Every person who is within a forest land use zone, forest recreation area or on a forest recreation trail shall comply with (a) the lawful orders and instructions of a forest officer, and (b) the instructions, prohibitions and directions contained in signs and notices posted on or about the forest land use zone, forest recreation area or forest recreation trail. AR 343/79 s8 9(1) Subject to subsections (2) and (3), no person shall start or maintain an open fire in a forest recreation area. (2) Subject to subsection (3), fires started, controlled and extinguished in accordance with The Forest and Prairie Protection Act and confined to facilities provided for the containing of fire, are permitted within forest recreation areas. (3) No person shall (a) camp, or (b) start or maintain an open fire within one kilometre of a forest recreation area or roadway located within the Kananaskis Country Forest Land Use Zone, the McLean Creek Off-Highway Vehicle Forest Land Use Zone, the Sibbald 5 Section 10 FOREST RECREATION REGULATION AR 343/79 Snow Vehicle Forest Land Use Zone or the Cataract Creek Snow Vehicle Forest Land Use Zone. AR 343/79 s9;280/85;106/2006 10(1) No person, except a forest officer engaged in the control of wildlife or a person authorized by a forest officer to assist in that activity, shall set a trap, use an explosive or discharge a firearm within a forest recreation area or on a forest recreation trail.
