Reason: To enable the Planning Authority to consider these aspects in the interests of the visual amenity of the site and the surrounding area, traffic and pedestrian safety and the amenity and wellbeing of future residents of the site. 4. That notwithstanding the generalities of Condition 3, the reserved matters application shall include the following:- (a) written confirmation from Scottish Water that the site can be provided with an acceptable water supply and a foul sewerage system which would not contribute to the premature operation of consented downstream overflows; (b) details of the proposed surface water surface drainage scheme which must comply with the principles of Sustainable Urban Drainage Systems (SUDS) in terms of the relevant ClRlA Manual and other advice published by the Scottish Environment Protection Agency (SEPA). Reason: To enable the Planning Authority to consider these aspects in the interests of ensuring that the drainage scheme complies with best SUDS practice, to protect adjacent watercourses and groundwater, and in the interests of the amenity and wellbeing of existing and future residents adjacent to and within the development site. 5. That notwithstanding the generalities of Condition 3, the reserved matters application shall also include:- (a) details of all proposed noise mitigation measures to be utilised within the site; (b) a report from a qualified noise engineer confirming that the measures proposed are sufficient to result in an internal daytime noise level of less than 45dB and an internal night time noise level of less than 35dB for all of the proposed dwellings within the site. Reason: To enable the Planning Authority to consider these aspect in the interests of the visual amenity of the site and the surrounding area and in the interests of the amenity and wellbeing of existing and future residents of the development site. 6. That notwithstanding the generalities of Condition 3, the reserved matters application shall include details of the proposed access from the A80 and that except as may otherwise be agreed by the Planning Authority, in consultation with the Roads Authority it shall comply with following requirements:- (a) provide visibility splays which shall be triangles of ground bounded by the first 9 metres of the centreline of the access (the set back dimension) and the nearside trunk road carriageway for 90 metres in both directions from the intersection of the access with the trunk road (the y dimension). In a vertical plane nothing shall obscure visibility measured from a drivers eye height of between 1.05 metres and 2 metres positioned at the set back dimension to an object of between 0.26 metres and 1.05 metres anywhere along the y dimension: (b) be to a standard as described in the Department of Transport Advice Note TA 41/95 (Vehicular Access to All-Purpose Trunk Roads) (as amended in Scotland) complying with Layout 3; (c) have no drainage connections to the Trunk Road drainage system; Reason: In the interests of traffic safety.

Introduction 1.1 Landscape designations play an important role in Scottish Planning Policy by protecting and enhancing areas of particular value. Scottish Planning Policy encourages local, non-statutory designations to protect and create an understanding of the role of locally important landscape have on communities. 1.2 In 2014, as part of the preparation of the North Lanarkshire Local Development Proposed Plan, a review of local landscape designations was undertaken by URS as part of wider action for landscape protection and management. 2. URS Review of North Lanarkshire Local Landscape Character (2015) 2.1 The purpose of the Review was to identify and provide an awareness of the special character and qualities of the designated landscape in North Lanarkshire and to contribute to guiding appropriate future development to the most appropriate locations. The Review has identified a number of Local Landscape Units (LLU) that are of notable quality and value within which future development requires careful consideration to avoid potential significant impact on their landscape character. 2.2 There are two exemplar LLUs identified in this study, Kilsyth Hills and Clyde Valley, which are seen as very sensitive to development. Both of these areas warrant specific recognition and protection, as their high landscape quality would be threatened and adversely affected by unsympathetic development within their boundaries.

PURPOSE OF REPORT This report concerns a proposal to sell small areas of land within Tannochside Park, Uddingston to Scottish Enterprise. 2. BACKGROUND Scottish Enterprise & North Lanarkshire Council’s predecessors were the original owners of Tannochside Park. The respective titles covered large areas of ground with irregular boundaries and few, if any, physical features to identify the boundaries. Through partnership working, civil engineering works were undertaken to service the site suitable for industrial / business development. The sites created have subsequently been sold on to a diverse range of business users. Scottish Enterprise disponed sites to Oakwood Food Limited and Orange Telecommunications. At the time of sale, which was several years ago now, Scottish Enterprise genuinely felt that they were selling land that was exclusively in their ownership. The view of both original landowners was that the feu boundary between the Scottish Enterprise and Motherwell District Council ownership’s was through an area designated common landscaping separating developable plots. Through the land registration process, it has however emerged that there are discrepancies over the supposed common boundary between the Scottish Enterprise & North Lanarkshire Council titles. As a consequence, small areas of land now occupied by Oakwood Foods and Orange Telecommunications are not shown on their respective Land Certificates despite their inclusion in the sale missives. The above areas are highlighted on the accompanying plan. In the case of Oakwood Foods Limited, the area in question covers part of the access into the manufacturing facility as well as part of the yard area.
