    CLARIFICATION The Hon’ble Supreme Court (Bench of Hon.7 judges) has delivered a judgment on 12/08/2005 in Civil Appeal No. 5041/2005 in respect of ‘rights and entitlement’ of Government as against Private Professional Educational Institutions. This judgment expects enactment of legislation by Central Government and in its absence, by State Government in this regard. This process has been initiated. However it is not certain, as of this date, as to when such legislation will come into force, as also its provisions. In the meanwhile, in terms of the observations of the Hon’ble Supreme Court from the aforesaid judgment, at least at this stage, it appears that State Government cannot claim any quota/seats in these colleges/institutions, and consequently cannot effect admission in these Private Management Colleges/Institutes, except to the extent agreed to with certain institutions. It is therefore made clear that on the aforesaid interpretation and advice given to the State Government, this Brochure will not apply to the admissions to be effected in the academic year 2012-2013 at the Private Management Colleges / Institutions in so far as postgraduate courses are concerned, with the above exception. However, it is made expressly clear that if, after issuance of this Brochure, either on account of any legislation or on account of any different interpretation/opinion/advice or due to any judgment/order passed by any court of law or even otherwise, the State Government is found entitled to any seat(s) in the Private Management Colleges/Institutions and consequently entitled to effect the admission(s) to such seat(s), the rules and regulations set out in this Brochure will be made applicable to such seat(s) and admission(s).
