TN/06/0133 (2.1) 02 (UK) Limited c/o Infratec

Upgrade of existing MM02 Airwave installation by the addition of one 300mm dish at 21.5m. Extension of the compound in order to install an additional two MM02 Airwave equipment cabinets. 02 mast, Reservoir, Rook Lane, .

The Area Planning Officer reported that five further letters of objection had been received which raised additional concerns with the application being part of a continual upgrade and whether there was a limit for the future upgrade of the mast and apparatus; with it being adjacent to a residential development; requests for local residents' Council Tax to be reduced; and it would devalue local properties. He reported that the Head of Environmental Services had raised no objection to the development and he had emphasised that a standby generator would have a minimal effect on local residential amenity and would be used in emergencies only.

Mr Martin, an Objector, spoke against the proposal.

The Chairman reminded Members that some of the issues raised in objection to the development were not planning issues.

RESOLVED That the applicant be informed that the Council's prior approval is not required and that they may proceed with the development.

SW/06/1381 (2.2) Toma UK Ltd

Development of 4 x 1 bedroom flats and extension to existing first floor flat with ground floor kitchen and w.c. Land rear of Retail Store, Jetty Road, Warden.

Mr Dunn, the Applicant, spoke in favour of the proposal.

RESOLVED That SW/06/1381 be approved subject to conditions (1) to (10) in the report.

SW/06/1324 (2.3) Owen Mullen (Contractors) Ltd

Outline application for the erection of 23 dwellings with associated car parking, garaging and access road. Danaway Contractors Yard, Maidstone Road, Danaway, Sittingbourne.

The Area Planning Officer reported that the applicant had commissioned a Tree Specialist who had considered the condition of the tree within the proposed development was not a particularly worthy example and concerns had been raised about the safety of the tree.

Mr Brooks, an Objector, spoke against the proposal.

Mr Page, the Agent, spoke in favour of the proposal.

Some Members considered that the tree on the site was worth preserving. Members emphasised that they were in support of developments adopting more environmentally sustainable methods; their attention was drawn to Condition 17 in the report which addressed these issues.

RESOLVED That application SW/06/1324 be delegated to Officers to approve subject to further investigations into the health of the tree on the site by Swale's Tree Officer, and if necessary to replace the tree, and the completion of a Section 106 Agreement in respect of a contribution to community facilities and the provision of a public open space and towards provision of school places.

SW/06/1434 (2.4) Bandol Holdings Ltd

Listed Building consent for internal alterations and removal of 20th century brickwork. Priory Coach House, Davington, .

The Area Planning Officer clarified the application and reminded Members that the proposal was for internal works and the removal of some brickwork.

Mr Osborne, an Objector, spoke against the proposal.

Mr Jones, for the Applicant, spoke in favour of the proposal.

The Ward Member raised concern over the proposal and work that had been done that he did not consider appropriate to the building. He was also concerned with overlooking onto neighbouring properties. In response to concerns with regard to the proposal, the Conservation Officer emphasised that this was an application for Listed Building Consent and that external works had been approved in 2000 and 2005. He considered the internal works were relatively insignificant and that the application should be considered for what it was.

RESOLVED That application SW/06/1434 be approved subject to condition (1) to (2) in the report.

SW/06/1173 (2.5) Mr Puyner & Mr Ford c/o Woodstock Associates.

Demolition of existing bungalows and construction of 4 semi-detached chalet bungalows. 27-29 Darlington Drive, Minster.

The Area Planning Officer reported that one further letter of objection had been received which raised concerns about an increase of on street parking, strain on waste and water facilities and that there were already enough dwellings on the .

Amended plans were received on 19th January 2007 and the deadline for consultation was 6th February 2007. Highway Services had raised no objection to the proposal.

RESOLVED That SW/06/1173 be delegated to Officers to approve subject to Conditions (1) to (7) in the report and to no fresh issues being received before 6th February 2007.

SW/06/1378 (2.6) Mr & Mrs Ashworth

SW/06/1256 (2.7) Mr Carpenter

RESOLVED That application SW/06/1256 be approved subject to conditions (1) to (2) in the report.

SW/04/0032 (2.8) Intier Automotive Interior Ltd

Retrospective application for addition of 2 new windows at first floor level to north elevation and new ducts/vents at roof level. Spade Lane, .

The Area Planning Officer reported that the applicant had recently attended a meeting with local Councillors, residents and the Council's Environmental Health Officers to resolve any outstanding issues. He considered that the applicant had done as much as reasonably possible to reduce the noise emanating from the premises.

The Ward Member told Members that he had attended the recent meeting with the applicant and although measures had been taken to decrease the noise, he considered that this was still a problem. He raised concerns with regard to any additional flues being added in the future; which meant there was more machinery, and this would further affect the amenities of the local neighbours. He requested an additional condition with regard to restriction of further flues being added.

In response, the Area Planning Officer confirmed that a condition was not necessary as a planning application would be required for any additional flues. Discussion ensued with regard to the amount of vents currently in existence.

RESOLVED That application SW/04/0032 be approved subject to a condition stating that there be a maximum of 105 vents/flues and if more were required, the applicant would need to apply for planning permission.
