Truck Driver’s Guidebook Introduction The U.S. Congress passed the Motor Carrier Safety Act in 1984. The Act directed the Secretary of Transportation to determine the safety fitness of all motor carriers, subject to federal regulations, operating in Michigan interstate commerce. In 1990, Michigan adopted these regulations for motor carriers operating in intrastate commerce. As a result of these actions, Michigan businesses which also operate trucks may be subject to all or some of these rules. Additional requirements are also contained in the Michigan Vehicle Code and, in some instances, the “Federal Hazardous Materials Regulations.” The rules and regulations governing the operation of trucks establish minimum safety and record keeping requirements that carriers and drivers must meet. These requirements include, but are not limited to, qualification of drivers; proper licensing of vehicles and drivers; insurance; driver drug and alcohol testing programs; accident recording; driver’s hours of service; hazardous material handling and training; vehicle maintenance and inspection; and vehicle loading and weight require- ments. Failure to meet these minimum requirements subjects both carriers and drivers to civil and criminal penalties.
