Crowley Program in International Human Rights/Centro de Derechos Humanos Miguel Agustõn Pro Juarez (ªPRODHº): Joint 2000 Mission in Mexico* INTRODUCTION On June 2, 1990, Manuel ManrÂõquez San AgustÂõn (ªManuel ManrÂõquezº), a mariachi musician, was performing in a town square in Mexico City. Several men approached him, seeking the musical services of the mariachi band. Once the members of the band boarded the truck in which they traveled together, they were blindfolded and taken to the offices of the Public Ministry. The men who had approached them were agents of the Mexico City judicial police. At the Public Ministry, members of the judi- cial police detained Manuel ManrÂõquez without an arrest war- * The Joseph R. The coerced confession was the only piece of evidence linking him to the murder.4 Nevertheless, Manuel ManrÂõquez was convicted of homicide and sentenced to twenty-seven years in prison.5 An ap- pellate court affirmed that decision6 and subsequent motions to overturn his conviction were rejected.7 After serving nine years, Manuel ManrÂõquez was finally 1. When asked about his change of heart, the judge responded that although he personally still be- lieved Manuel ManrÂõquez was guilty, he reversed his decision for two reasons: an international human rights body had intervened in the case and, after nine years in prison, the judge believed that Manuel ManrÂõquez had served enough time for his crime.10 The Manuel ManrÂõquez case demonstrates that the Mexican criminal justice system is riddled with serious failings, but is sus- ceptible to reform. The failings include the arbitrary arrest and detention of individuals by the judicial police, the use of torture to obtain false confessions, and the evidentiary weight given to these confessions by judges, despite detainees' statements that they were obtained through coercion. The judge we inter- viewed, who was one of the judges on the panel that granted Manuel ManrÂõquez's release, for example, was not convinced of his innocence or of the compelling evidence of the torture he suffered. The judge also failed to recognize the need not to base convictions on confessions obtained through torture. Yet the case also demonstrates that justice can be achieved in the Mexi- can criminal justice system. Although Manuel ManrÂõquez served nine years in prison for a crime that he did not commit, he was eventually released through the recognition of innocence rem- edy, impelled by the Inter-American Commission's findings of torture. Indeed, at least according to some officials we inter- viewed, subsequent reforms to the criminal justice system have 8. Nonetheless, too few necessary re- forms have been implemented and too few judges apply existing reforms with sufficient independence. Nor do other officials, such as prosecutors, show adequate concern for the protection of fundamental freedoms. The Manuel ManrÂõquez case, in sum, illustrates that Mexico has a long road to travel before its crimi- nal justice system becomes rooted in human rights principles.

    The Two Deaths of Digna Ochoa: A Window onto the Violences of Power in Neoliberal Mexico1 John Gledhill School of Social Sciences, The University of Manchester On 19th October, 2001, Digna Ochoa y Plácido, a thirty‐seven year old lawyer and human rights defender, was found dead in her office in Mexico City. The immediate cause of death was a gunshot wound to the head. This is one of the very few matters on which all parties involved in the case still agree. When the news of Ochoa’s death initially broke, nobody, inside or outside Mexico, would have dreamed of questioning the presumption of homicide related to her work as a human rights defender. Yet in July 2003, the last in a series of three prosecutors to be appointed by the government of Mexico’s Federal District, Margarita Guerra y Tejada, gave a press conference to deliver what she conceded was her investigation’s far from “politically convenient” conclusion that Digna Ochoa had died by her own hand. By the time that it was publicly announced, Margarita Guerra’s conclusion of suicide provoked no surprise, although it did provoke considerable indignation, both from Ochoa’s family and the human rights community at home and abroad. The announcement was the culmination of a long series of leaks of information to the press, which reflected the way that the investigation had shifted from an investigation of possible perpetrators of a crime to an investigation of the victim’s personality and life.     Mexico Page 1 of 37 Mexico Country Reports on Human Rights Practices - 2001 Released by the Bureau of Democracy, Human Rights, and Labor March 4, 2002 Mexico is a federal republic composed of 31 states and a federal district, with an elected president and a bicameral legislature. In July 2000, voters elected President Vicente Fox Quesada of the Alliance for Change Coalition in historic elections that observers judged to be generally free and fair, and that ended the Institutional Revolutionary Party's (PRI) 71-year hold on the presidency. The peace process in Chiapas between the Zapatista National Liberation Army (EZLN) and the Government remained stalled, despite positive developments early in the year. Sporadic outbursts of politically motivated violence continued to occur in the southern states of Chiapas, Guerrero, and Oaxaca. The judiciary is generally independent; however, on occasion, especially at the state level, it has been influenced by government authorities. Corruption, inefficiency, impunity, disregard of the law, and lack of training are major problems. The police forces, which include federal and state judicial police, the Federal Preventive Police (PFP), municipal police, and various police auxiliary forces, have primary responsibility for law enforcement and maintenance of order within the country. However, the military plays a large role in some law enforcement functions, primarily counternarcotics. Elected civilian officials maintain effective control over the police and the military; however, corruption is widespread within police ranks and also is a problem in the military. The military maintains a strong presence in the state of Chiapas and a lesser, but still significant, deployment in Guerrero.

Drawing on cases of harassment of human rights defenders from 1996 onwards, it highlights how efforts by defenders to improve Mexico’s human rights situation have been met with obstruction and persecution. The report examines cases that occurred both during the years of the government of President Ernesto Zedillo Ponce de León (1994-2000) and during the administration of President Vicente Fox Quesada (2000-). The abuses examined by Amnesty International during 2001 indicate that patterns of harrassment continue, and will remain unchanged until the authorities adopt immediate measures and reforms that filter down to all levels of the state. Harassment in the form of spurious criminal charges, public smear campaigns and surveillance operations of human rights defenders have been widely used by past and current Mexican authorities to silence human rights defenders. As well as impeding the work of defenders, such activities deflect attention from human rights violations reported by human rights defenders and undermine the moral authority of the human rights movement, and standards in international human rights law. The extent of persecution facing human rights defenders in Mexico was thrown into sharp relief with the killing of human rights lawyer Digna Ochoa y Plácido on 19 October 2001. Had previous threats and attacks against Digna Ochoa been properly investigated, her death could have been avoided.

Overview of the information presented in this report In this report, the Miguel Agustín Pro Juárez Human Rights Center (Center Prodh) 1 presents information to assist the Human Rights Committee in its consideration of the fifth periodic report of Mexico, submitted in July 2008 and due for evaluation in March 2010 (UN Doc. CCPR/C/MEX/5, dated Sept. 24, 2008). The present report focuses on several areas in which the Mexican government is currently committing systematic and unpunished violations of fundamental civil and political rights. The themes analyzed correspond to issues of concern identified by this Committee both in its previous concluding observations on the fourth periodic report of Mexico, published on July 27, 1999 (UN Doc. CCPR/C/79/Add.109), and in its List of Issues to be taken up in the evaluation of the fifth periodic report (UN Doc. CCPR/C/MEX/Q/5 of Aug. 24, 2009). In 1999, this Committee correctly identified numerous subjects of deep concern regarding human rights in Mexico. As demonstrated by the information provided below, the Mexican government, far from complying with the Committee’s 1999 recommendations in many of these areas, has in recent years implemented measures that have increased the violations of the ICCPR occurring on a daily basis.
