Brett Kavanaugh Action Resources BRETT KAVANAUGH ACTION RESOURCES ACTION CAMPAIGN KAVANAUGH: WRONG FOR THE SUPREME COURT Together, we can #StopKavanaugh The future of the Supreme Court hangs in the balance with the next lifetime appointment to the Court. Judge Brett Kavanaugh is a nominee whose confirmation would endanger critical legal rights and protections for millions of people. Kavanaugh was nominated to the Supreme Court because he passed Donald Trump’s litmus test as a person who, if confirmed, would “automatically” overturn and gutRoe v. Wade and who would work against accessible and affordable health care. Like virtually all of Donald Trump’s nominees, Kavanaugh can be counted on to favor the wealthy and powerful over the rights of all. He would push the Supreme Court to further gut access to health care and rights for workers, women, people of color, LGBTQ people, and immigrants. And he would not serve as a much-needed check on the executive branch. We can’t afford the confirmation of another extreme right-wing justice in the mold of Neil Gorsuch, Donald Trump’s first appointee to the Court. And we know we can win. Mass mobilization against unqualified, extreme federal judicial nominees has resulted in their withdrawal in the past, but it takes all of us coming together. Together, we can #StopKavanaugh. This toolkit can help you take action. What’s in this Toolkit Resources for Individuals Resources for Organizations Key points Key points Tips on taking action Tips on taking action Sample call script Sample call script Writing a letter to your senator Writing an action alert Writing a letter to the editor Writing a letter to senators Sample social media Planning an event AFJAction AFJActionCampaign WRONG FOR THE SUPREME COURT Key Points A coalition of progressive organizations opposing the Kavanaugh nomination have developed these talking points for activists: Since Kavanaugh’s name was on Donald Trump’s short list of potential nominees approved by the Heritage Foundation and Federalist Society, we know he satisfied Trump’s litmus test as a person who, if confirmed, would “automatically” overturn Roe v. Wade and who would work against accessible and affordable health care. In the now-famous “Jane Doe” case, Kavanaugh tried to block an undocumented minor in government custody from exercising her constitutionally protected right to an abortion. Over Kavanaugh’s dissent, the D.C. Circuit allowed the young woman to seek the care she needed. In a case challenging the Affordable Care Act, Kavanaugh wrote a dissenting opinion that would have kept alive a frivolous attack on the health care of millions of Americans. Kavanaugh believes the president should be above the law. He has said the president should have “absolute discretion” to determine whether and when to appoint a special counsel like Robert Mueller. And he said that special counsels should be “removable in the same manner as other high-level executive branch officials” - in other words, at the president’s prerogative. Kavanaugh has also said that a sitting president should not be able to be criminally indicted, no matter what evidence of wrongdoing is uncovered. He would not serve as a much-needed check on the executive branch. Kavanaugh would favor the wealthy and powerful over the rights of all. Throughout his tenure on the bench, he has consistently ruled against workers, consumers, and the environment. He believes the Consumer Financial Protection Bureau, which was created to protect consumers from unscrupulous financial institutions, is unconstitutional. He argued that the FCC’s net neutrality rule benefitting millions was unconstitutional. Kavanaugh has repeatedly ruled against protections for clean air and clean water. In one case he tried to reverse an EPA penalty against a company that improperly shipped a corrosive chemical that caused “significant risks to public health.” He has fought for cable companies and the auto industry, against consumers. Kavanaugh has a poor record on antitrust issues: He stood with multi-billion dollar insurance companies that were merging to eliminate consumer choice. He has consistently ruled against workers fighting discrimination and mistreatment on the job. He is so extreme that he has the highest number of dissents per year of any judge on the D.C. Circuit. The American people need a nominee who believes the Constitution protects all of us, not just the wealthy and powerful. Supreme Court justices should approach each case with an open mind and make fair decisions based on the merits of each case. But Kavanaugh would rule according to the political agenda of the Trump Administration. Kavanaugh’s nomination causes deep concern for several reasons. First, he clearly passed Donald Trump’s two main litmus tests for Supreme Court nominees: he will overturn and gut Roe v. Wade and undermine the Affordable Care Act. If Kavanaugh is confirmed, 130 million Americans with preexisting conditions stand to lose their protections. With Kavanaugh on the high court, many other critical legal rights and protections are at risk as well. He believes the Consumer Financial Protection Bureau, created to protect consumers from unscrupulous financial institutions, is unconstitutional. He has repeatedly ruled against protections for clean air and water, and against workers fighting discrimination on the job. Disturbingly, he has indicated on several occasions that he believes presidents should be above the law – a deeply troubling point of view that is not consistent with our system of government. We also know that Kavanaugh was hand-picked by the ultraconservative Federalist Society and Heritage Foundation, and would favor the wealthy and powerful over the rights of all. Brett Kavanaugh just cannot be trusted to serve as a fair-minded, independent jurist on our highest court. Your leadership on so many critical issues has been invaluable for [residents of your state, i.e., “Californians”] and people across the country. On this issue, we need your leadership more than ever. Please take the time to fully scrutinize the record of Brett Kavanaugh with the utmost attention to his ability to uphold core constitutional values of liberty, equality, and justice for all. • The Civil War in the American Ruling Class
tripleC 16(2): 857-881, 2018 http://www.triple-c.at The Civil War in the American Ruling Class Scott Timcke Department of Literary, Cultural and Communication Studies, The University of The West Indies, St. Augustine, Trinidad and Tobago, [email protected] Abstract: American politics is at a decisive historical conjuncture, one that resembles Gramsci’s description of a Caesarian response to an organic crisis. The courts, as a lagging indicator, reveal this longstanding catastrophic equilibrium. Following an examination of class struggle ‘from above’, in this paper I trace how digital media instruments are used by different factions within the capitalist ruling class to capture and maintain the commanding heights of the American social structure. Using this hegemony, I argue that one can see the prospect of American Caesarism being institutionally entrenched via judicial appointments at the Supreme Court of the United States and other circuit courts. Keywords: Gramsci, Caesarism, ruling class, United States, hegemony Acknowledgement: Thanks are due to Rick Gruneau, Mariana Jarkova, Dylan Kerrigan, and Mark Smith for comments on an earlier draft. Thanks also go to the anonymous reviewers – the work has greatly improved because of their contributions. A version of this article was presented at the Local Entanglements of Global Inequalities conference, held at The University of The West Indies, St. Augustine in April 2018. 1. Introduction American politics is at a decisive historical juncture. Stalwarts in both the Democratic and the Republican Parties foresee the end of both parties. “I’m worried that I will be the last Republican president”, George W. Bush said as he recoiled at the actions of the Trump Administration (quoted in Baker 2017).

  • Taking Down Trumpism from Africa: Delegitimation, Not Collaboration, Please Patrick Bond 9 Feb 2017
Taking down Trumpism from Africa: Delegitimation, not collaboration, please Patrick Bond 9 Feb 2017 In the US there are already effective Trump boycotts seeking to delegitimise his political agenda. Internationally, protesters will be out wherever he goes. And from Africa, there are sound arguments to play a catalytic role, mainly because the most serious threat to humanity and environment is Trump’s climate change denialism. Consider two contrasting strategies to deal with the latest mutation of US imperialism: we should protest Donald Trump and Trumpism at every opportunity as a way to contribute to the unity of the world’s oppressed people, and now more urgently link our intersectional struggles; or we should somehow take advantage of his presidency to promote the interests of the ‘left’ or the ‘Global South’ where there is overlap in weakening Washington’s grip (such as in questioning exploitative world trading regimes). The latter position is now rare indeed, although before the election Hillary Clinton’s commitment to militaristic neoliberalism generated so much opposition that to some, the anticipated ‘paleo-conservatism’ of an isolationist-minded Trump appeared attractive. One international analyst of great reknown, Boris Kagarlitsky, makes this same argument this week largely because Trump is questioning pro-corporate ‘free trade’ deals. But the argument for selective cooperation with Trump was best articulated in Pambazuka as part of a series of otherwise compelling reflections by the Ugandan writer and former South Centre director Yash Tandon. Tandon might re-examine the ‘space’ he can ‘seize’ with Trump, the ‘fraud’ Since more than any other individual Tandon helped make the 1999 Seattle and Cancun World Trade Organisation summits a profound disaster for world elites, I take him very seriously.

Administration of Donald J. Trump, 2017 Remarks at the National Rifle Association Leadership Forum in Atlanta, Georgia April 28, 2017 Thank you, Chris, for that kind introduction and for your tremendous work on behalf of our Second Amendment. Thank you very much. I want to also thank Wayne LaPierre for his unflinching leadership in the fight for freedom. Wayne, thank you very much. Great. I'd also like to congratulate Karen Handel on her incredible fight in Georgia Six. The election takes place on June 20. And by the way, on primaries, let's not have 11 Republicans running for the same position, okay? [Laughter] It's too nerve-shattering. She's totally for the NRA, and she's totally for the Second Amendment. So get out and vote. She's running against someone who's going to raise your taxes to the sky, destroy your health care, and he's for open borders—lots of crime—and he's not even able to vote in the district that he's running in. Other than that, I think he's doing a fantastic job, right? [Laughter] So get out and vote for Karen. Also, my friend—he's become a friend—because there's nobody that does it like Lee Greenwood. Wow. [Laughter] Lee's anthem is the perfect description of the renewed spirit sweeping across our country. And it really is, indeed, sweeping across our country. So, Lee, I know I speak for everyone in this arena when I say, we are all very proud indeed to be an American.

TIERED BALANCING AND THE FATE OF ROE V. WADE: HOW THE NEW SUPREME COURT MAJORITY COULD TURN THE UNDUE-BURDEN STANDARD INTO A DEFERENTIAL PIKE TEST By Brendan T. Beery* In one of the more noteworthy uses of his much-ballyhooed “swing vote”1 on the U.S. Supreme Court, Justice Anthony Kennedy sided with Justices Breyer, Ginsburg, Sotomayor, and Kagan in striking down two Texas laws that restricted access to reproductive- healthcare facilities. The laws did so by imposing toilsome admitting privileges and surgical-facility standards that clinics had difficulty abiding. 2 The proposition that a woman has an unenumerated constitutional right to terminate a pregnancy, at least before the point of fetal viability, won the day in 1973.3 But, as 2018 fades into 2019, no judicial precedent is more endangered than the one that has evolved in a triumvirate of cases: Roe v. • Capitol Insurrection at Center of Conservative Movement
Capitol Insurrection At Center Of Conservative Movement: At Least 43 Governors, Senators And Members Of Congress Have Ties To Groups That Planned January 6th Rally And Riots. SUMMARY: On January 6, 2021, a rally in support of overturning the results of the 2020 presidential election “turned deadly” when thousands of people stormed the U.S. Capitol at Donald Trump’s urging. Even Senate Republican leader Mitch McConnell, who rarely broke with Trump, has explicitly said, “the mob was fed lies. They were provoked by the President and other powerful people.” These “other powerful people” include a vast array of conservative officials and Trump allies who perpetuated false claims of fraud in the 2020 election after enjoying critical support from the groups that fueled the Capitol riot. In fact, at least 43 current Governors or elected federal office holders have direct ties to the groups that helped plan the January 6th rally, along with at least 15 members of Donald Trump’s former administration. The links that these Trump-allied officials have to these groups are: Turning Point Action, an arm of right-wing Turning Point USA, claimed to send “80+ buses full of patriots” to the rally that led to the Capitol riot, claiming the event would be one of the most “consequential” in U.S. history. • The group spent over $1.5 million supporting Trump and his Georgia senate allies who claimed the election was fraudulent and supported efforts to overturn it. • The organization hosted Trump at an event where he claimed Democrats were trying to “rig the election,” which he said would be “the most corrupt election in the history of our country.” • At a Turning Point USA event, Rep.

Purvis* Since the inauguration of President Trump, most of his Administration’s actions have been sharply conservative: notably, his efforts to ban transgender Americans from military service. There have been exceptions, however, such as proposals to create support for paid parental leave, an issue previously championed by Democrats. This seeming contradiction of progressive and regressive policies can be reconciled by viewing the Trump Administration through the lens of masculinities theory. Hegemonic masculinity depends upon sharp differentiation between “real” men and everyone else, the latter occupying places in a hierarchy far below men. In this reading, Trump’s version of parental support makes sense: it focuses support solely on women, who in the view of hegemonic masculinity are the only proper caregivers for children. Similarly, masculinities analysis helps to explain targeting transgender Americans, as this group directly challenges a central tenet of hegemonic masculinity—that gender is binary and immutable.

Progressive Foreign Policy Debrief Intel for Advocacy TOPLINE TAKEAWAY ● The world showed us this week just how isolated the U.S. is on Iran. TRUMP AT THE UN: MAKING REGIME CHANGE GREAT AGAIN As Supreme Court nominee Brett Kavanaugh’s sexual assault hearing mired Washington, DC in domestic controversy this week, international affairs took center stage in New York City when world leaders gathered for the annual United Nations General Assembly. While literally laughable at times, Trump’s performance at the UN this week was also dangerous, as his administration’s inflammatory rhetoric put us further along the path to war with Iran. While the U.S. withdrew from the Iran nuclear deal earlier this year, the deal has persisted with European, Chinese, and Russian support and continued Iranian compliance. So during the week, Trump escalated his efforts to finally dismantle the deal. In his speech to the General Assembly, Trump lambasted the deal as a “windfall” for Iran and asked all countries to isolate the regime. While chairing a UN Security Council meeting, Trump reiterated U.S. commitment to re-imposing nuclear-related sanctions in full force, in addition to pursuing more sanctions, “tougher than ever before.” He declared that any countries refusing to comply with U.S. sanctions would “face severe consequences.” Trump also made his administration's policy of regime change particularly transparent this week. At the General Assembly, Trump asked nations “to support Iran’s people as they struggle to reclaim their religious and righteous destiny” – ignoring the fact that his policies do the opposite. Iran’s president Hassan Rouhani recognized this and responded, remarking that “it is ironic that the U.S.

de•C ARDOZOnovo L AW R EVIEW WHAT KIND OF JUDGE IS BRETT KAVANAUGH? A Quantitative Analysis Elliott Ash† & Daniel L. Chen† This article reports the results of a series of data analyses of how recent Supreme Court nominee Brett Kavanaugh compares to other potential Supreme Court nominees and current Supreme Court Justices in his judging style. The analyses reveal a number of ways in which Judge Kavanaugh differs systematically from his colleagues. First, Kavanaugh dissents and is dissented against along partisan lines. More than other Judges and Justices, Kavanaugh dissents at a higher rate during the lead-up to elections, suggesting that he feels personally invested in national politics. Far more often than his colleagues, he justifies his decisions with conservative doctrines, including politicized precedents that tend to be favored by Republican-appointed judges, the original Articles of the Constitution, and the language of economics and free markets. These findings demonstrate the usefulness of quantitative analysis in the evaluation of judicial nominees. Foot Adrienne Russell Program Authorized to Offer Degree: Communication University of Washington Abstract The Political Logic of the Radical Right Media Sphere in the United States Yunkang Yang Chair of the Supervisory Committee: W. Lance Bennett Department of Communication Democracy in America is threatened by an increased level of false information circulating through online media networks. Previous research has found that radical right media such as Fox News and Breitbart are the principal incubators and distributors of online disinformation. In this dissertation, I draw attention to their political mobilizing logic and propose a new theoretical framework to analyze major radical right media in the U.S. Contrasted with the old partisan media literature that regarded radical right media as partisan news organizations, I argue that media outlets such as Fox News and Breitbart are better understood as hybrid network organizations. This means that many radical right media can function as partisan journalism producers, disinformation distributors, and in many cases political organizations at the same time. They not only provide partisan news reporting but also engage in a variety of political activities such as spreading disinformation, conducting opposition research, contacting voters, and campaigning and fundraising for politicians. In addition, many radical right media are also capable of forming emerging political organization networks that can mobilize resources, coordinate actions, and pursue tangible political goals at strategic moments in response to the changing political environment.
