The Orissa G a Z E T T E The Orissa G a z e t t e EXTRAORDINARY PUBLISHED BY AUTHORITY No. 1306 CUTTACK, SATURDAY, SEPTEMBER 5, 2009/BHADRA 14, 1931 STATE ELECTION COMMISSION, ORISSA TOSHALI PLAZA, B-2, 1ST FLOOR, SATYA NAGAR, BHUBANESWAR-751007 ORDER The 2nd September 2009 No. 3956—Ele.(G.P.)-39/2009-SEC.—Whereas Collectors and Sub-Collectors of different districts have submitted proposals for by-elections to the Offices of Zilla Parishad Member, Panchayat Samit Member, Sarpanch and Ward Member as per Orissa Zilla Parishad Election Rules, 1994, Orissa Panchayat Samiti Election Rules, 1991 and Orissa Gram Panchayat Election Rules, 1965, respectively; Whereas Commission has decided to revise the Electoral Roll for the concerned Zilla Parishad, Panchayat Samiti and Gram Panchayat on the basis of Assembly Electoral Roll published by Election Commission of India during January, 2009; And whereas, it is necessary to prepare Wardwise Electoral Rolls for Gram Panchayat as per the list of vacancies appended at Annexure-III for conduct of by-election. Now, therefore, the State Election Commission in exercise of powers conferred under Article 243-K of Constitution of India, read with relevant provisions of Orissa Gram Panchayat Act, 1964, Orissa Panchayat Samiti Act, 1959 and Orissa Zilla Parishad Act, 1991 and Election Rules framed thereunder directs that Wardwise Electoral Roll of Gram Panchayats shall be prepared as per schedule detailed in Annexure-I according to the procedure prescribed in the Annexure-II of this order. The final Electoral Roll of Gram Panchayat prepared under Orissa Gram Panchayat Election Rules, 1965 comprised within the Samiti Constituency as well as Parishad Constituency including revision or addition or alteration, if any, shall together form the final Electoral Roll of Samiti and Parishad Constituency. ANNEXURE-II 1. The Collector as Electoral Registration Officer will be in overall charges of preparation and finalisation of Electoral Roll of the concerned Gram Panchayat. 2. Ordinarily the Collector may authorise the B.D.O. to function as Electoral Registration Officer in respect of concerned Gram Panchayats as per Rule 2 (d-1) of O.G.P.E. Rules, 1965. He may also authorise concerned Sub-Collector and Tahasildar as a standby measure. 3. The Electoral Roll of Assembly Constituency prepared and published by the Election Commission of India during January, 2009 and currently in force shall be the basis of preparation of the preliminary Wardwise Electoral Roll. For conduct of by-election to Zilla Parishad Member, the Electoral Roll of the entire district shall be updated. For the purpose, the Electoral Roll of concerned Assembly Constituencies have to be split 3 into separate Electoral Roll for every Gram Panchayat Wardwise. For conduct of by- election to P.S. Member, Electoral Roll of concerned Panchayat Samiti shall be updated. For the purpose, the Electoral Roll of Assembly Constituency relating to concerned Panchayat Samiti have to be split into separate Electoral Roll for every Gram Panchayat under the Panchayat Samiti Wardwise. For the purpose of by-election to Sarpanch the Electoral Roll of Assembly Constituency relating to the concerned Gram Panchayat and for by-election to Ward Member, the Electoral Roll of Assembly Constituency relating to the concerned Wards have to be split into separate Electoral Rolls for every Ward as per Rule 5 (1) of O.G.P.E. Rules, 1965. The preliminary Electoral Roll shall be prepared in Form No. 1 prescribed by the Commission under the seal and signature of the Electoral Registration Officer. The Electoral Rolls revised after 2009 for by-election to P.R.Is. shall not be done, only printing will be made for these Constituencies. 4. The preliminary Electoral Roll of the Ward prepared in accordance with Rule 5 (1) of O.G.P.E. Rules shall be published by the E.R.O. at a conspicuous place at the headquarters of the Gram Sasan together with a notice in Form No. 2 in accordance with the provision under Rule 5 (3). Such notice shall also be published in the notice- board of the office of the concerned Panchayat Samiti, Sub-Collector and Collector. It should be ensured that copies of preliminary Electoral Roll is kept open at Gram Panchayat Office for inspection by the public for entire period prescribed during filing of objections or claims. 5. Only the claims of persons whose name finds place in the Assembly Electoral Roll but does not find place in the Electoral Roll of the Ward now prepared shall be entertained. No new claims for enrolment shall be entertained. 6. After completion of enquiry into all claims and objections in the manner prescribed above, the Electoral Registration Officer shall prepare the final Electoral Roll. 7. Electoral Roll of concerned Ward and Gram Panchayat and Zilla Parishad Constituency where by-election is proposed as per Annexure-III shall only be printed.
