Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of October 11, 2005, following the Public Meetings of September 20, 2005 and August 16, 2005 and the Public Hearing of July 26, 2005, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forth in your application completed June 30, 2005. This permit will expire on October 11, 2011.

The proposal, as approved, consists of the installation of planting beds in front of the Fifth Avenue facade, the removal of an existing one-story rooftop addition and mechanical equipment, and the construction of a new two-story rooftop addition, including a cooling tower and mechanical equipment. The proposal, as initially presented, included a different design of the east elevation of the rooftop addition. The proposal was shown in photographs and drawings labeled LPC-0 through LPC-27, LPC-29, LPC-8A, LPC-11 (revised), LPC-12 (revised), LPC-12A, LPC-12A (revised), LPC-15A, LPC-15A (revised), LPC-16 (revised), LPC-16A, LPC-16A (revised), LPC-17 (revised), LPC-20A, LPC-20B, LPC-20C and LCP-21A dated August 1, 2005 and LPC-32 dated September 13, 2005 prepared by Cetra/Ruddy, submitted as components of the application and presented at the Public Hearing and Public Meetings.

In reviewing the proposal, the Commission noted that the Metropolitan Museum Historic District Designation Report describes 995 Fifth Avenue as a hotel building designed by and built in 1925-26; and that in terms of its style, scale, materials and details, the building contributes to the special architectural and historic character for which the Metropolitan Museum Historic District was designated.

With regard to this proposal, the Commission found that planting beds in front of apartment buildings are typical features found on Fifth Avenue in this historic district; that the size and placement of the planting beds are in keeping with other planting beds in front of large apartment buildings on the Avenue; that the demolition of the existing rooftop addition will not damage or destroy any significant architectural features of the building; that the presence of a penthouse addition on this building has precedent, and is in keeping with the tradition of penthouses constructed on buildings of this age, type and style in this historic district; that the proposed two-story rooftop addition will only be minimally more visible than the existing one-story rooftop addition from Fifth Avenue and over the primary facades of the building; that the proposed two-story rooftop addition will be most visible from East 81st Street but only over the undeveloped rear facade of the building and therefore, will not detract from any significant architectural features; that the visibility of the proposed addition from the east will be in keeping with the rear facades of other Fifth Avenue apartment buildings as viewed from the east; that extending the coping and adding the brick cladding and decorative panel to the east elevation of the proposed addition will help break up the mass of the addition; that the proposed addition will be constructed with brick cladding, which will help the addition blend with the east facade of the building, and which will be consistent with the treatment of other visible additions on Fifth Avenue buildings as seen from the east; that visible mechanical equipment on secondary facades is a typical feature in this historic district; and that the proposed work will not diminish the special architectural and historic character of the building and the Metropolitan Museum Historic District. Based on these findings, the Commission determined the work to be appropriate to the building and to the Metropolitan Museum Historic District and voted to approve it. The Commission authorized the issuance upon receipt, review and approval of two sets of final Department of Buildings filing drawings A001, A002, A003, A005, A006, A006.1, A-007.1, A210, A220, A221, A222, A223, A400, A401, A402, A410, A411, A412, A413, A413.1, A414, A415, A416 and A420 dated revised September 30, 2005, A100, A101, A102, A102.1, A103, A103.1, A104, A105, A106, A201, A203, A204 and A205 dated revised October 11, 2005 and A-007 and A202 dated revised October 18, 2005, prepared by John Cetra, R.A. Subsequently, staff reviewed these drawings and found that the proposal approved by the Commission had been maintained, therefore the drawings have been marked approved with a perforated seal and this Certificate of Appropriateness 06-2900 is being issued.

Please note that this Certificate of Appropriateness is being issued in conjunction with Certificate of No Effect 06-3135 approving interior alterations, the removal of through-the-wall air conditioners, the installation of louvers, the replacement of windows and doors, and the creation of new window openings at non-visible facades.

This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines. This letter constitutes the permit; a copy must be prominently displayed at the site while work is in progress. Please direct inquiries to Cynthia Danza.
