1. INTRODUCTION2.5 - Hazardous Waste Management:

Hon’ble National Green Tribunal in O.A. No. 710-713 / 2017 dated 15.07.2019 ordered regarding constitution of District Committee (as a part of District Planning Committee under Article 243 ZD) under Articles 243 G, 243 W, 243 ZD read with Schedules 11 and 12 and Rule 15 of the Solid Waste Management Rules, 2016.

In the above said order, it is stated that among others

‘Chief Secretaries may personally monitor compliance of environmental norms (including BMW Rules) with the District Magistrate once every month. The District Magistrates may conduct such monitoring twice every month. We find it necessary to add that in view of Constitutional provisions under Articles 243 G, 243 W, 243 ZD read with Schedules 11 and 12 and Rule 15 of the Solid Waste Management Rules,2016 it is necessary to have a District Environment Plan to be operated by a District committee (as a part of District Planning Committee under Article 243 ZD)’

In this regard, Principal Secretary to Government / Chairman (FAC) vide D.O. letter dated 26.07.2019 requested District Collectors to prepare District Environmental plans by constituting District Committee (as a part of District Planning Committee under Article 243 ZD) with representatives from Panchayats, Local Bodies, Regional Officerss, State PCB and a suitable officer representing the administration, which may in turn be chaired and monitored by the District Collector / District Magistrate twice every month and shall host the same in the website for a period of one year on or before 01.08.2019 & furnish monthly progress report to Chief Secretary to Government every month and copy of the same earmarked to GPC Board accordingly.

As per the directions, District committee was formed in the comprising of following members to evolve and execute District Environmental Plan.

The District Environment Plans cover the following environmental issues:

2.5 - Hazardous Waste Management: The Ministry of Environment, Forest and Climate Change, Government of has notified the Solid Waste Management Rules, 2016. As per the Rules, the role of local body has been specified as per Rule 15 of Solid Waste Management Rules, 2016 and as per Rule16 of the said Rules, Pollution Control Board shall enforce these Rules through local bodies.

With respect to effective implementation of Solid Waste Management Rules, 2016,Hon’ble NGT had laid down several orders, of which, Hon’ble National Green Tribunal, Principal Bench on 22nd December 2016 has passed judgment in Original Application No.199 of 2014 filed by Mrs. Almitra Patel with regard to solid waste management.

Further, for effective implementation of the said Rules, the Hon’ble NGT in its orders dated 31.08.2018 had constituted Apex Committee, Regional Committee and State Committee.

Solid Wastes generation in Valsad District:

In Valsad District, there are 5 Nagarpalikas (Namely Valsad, Dharampur, , and ) and other Gram Panchayats. The solid waste generated from the said local bodies is being collected separately through various methods (Dry & Wet Waste ). The wet solid waste is either composted or micro composted and Dry solid waste & inert material is being partially treated/recycle/dumped at designated site. In Valsad district, scientific solid waste disposal land fill site is yet not developed by any nagarpalika.

As per Hon’ble NGT order dated 15.07.2019 in O.A. No. 710-713/2017, the detailed guidelines to be followed in respect of Solid Waste Management Rules, 2016 are illustrated below:

2.2 Plastic Waste Management: 2.5 - Hazardous Waste Management:

In Valsad District, there are 5 Nagarpalikas and other Taluka Panchayats, and Gram Panchayat. As per Plastic Waste Management Rules – 2016 the local bodies are directed to ensure that the plastic waste generated from the all the local bodies are to be segregated and recyclable plastic waste are sold to the recyclers, low value plastic are utilized for road laying and the non-recyclable plastic waste is sent to co- processing in Cement Plant and the remaining inert are disposed for landfill.

In order to give thrust on plastic waste minimization, source segregation, recycling, involving waste pickers, recyclers and waste processors in collection of plastic waste fraction either from households or any other source of its generation or intermediate material recovery facility (MRF) and adopt polluters pay principle for the sustainability of the Waste Management system, MoEF&CC has notified Plastic Waste Management Rules, 2018 as amended. At present total 55 (25+30) numbers of plastic waste recycler & total 41 (22+19) plastic raw material (Plastic granules) manufacturers having valid registration under plastic waste management rules 2016.

These rules shall apply to every waste generator, local body, Village Panchayat, manufacturer, Importers and producers.

With respect to effective implementation of Plastic Waste Management Rules, 2018,Hon’ble NGT had laid down several orders, of which, Hon’ble NGT in its order dated12.03.2019 in Original Application No. 247/2017 among other things has directed all the States to prepare respective action plans for compliance of Rules and the same was submitted to the CPCB on 01.05.2019.

2.5 - Hazardous Waste Management: 2.2 Construction and Debris (C & D) Waste Management:

In Valsad district, Nagarpalika and taluka panchayats are advised to ensure that the Construction and Demolition wastes are disposed without affecting the Environment. Currently all nagarpalika are use Construction and Demolition wastes for the filling of low laying area & port holes. Most of ULBs have identified the spots for Disposal within their jurisdiction.

2.3 Biomedical Waste Management : 2.5 - Hazardous Waste Management:

In Valsad District, the Biomedical waste generated from the government and private health care facilities is partially treated on site and disposed at the Common Bio Medical Waste Facility owned by M/s. En-Cler Biomedical Waste Pvt. Ltd. It is having common biomedical waste incineration facility located at , District: Surat. M/s. En-Cler Biomedical Waste Pvt. Ltd. is also setting up common incineration facility in GIDC – Vapi area and have obtained CTE & CCA permission of the GPC Board. “Hazardous waste” means any waste which by reason of characteristics such as physical, chemical, biological, reactive, toxic, flammable, explosive or corrosive, causes danger or is likely to cause danger to health or environment, whether alone or in contact with other wastes or substances.

Hazardous waste generated from industries located in Valsad district are collected separately and disposed for land filing / incineration / Co-processing / Reuse & recycling at TSDF site located within state. At present Valsad district has one TSDF site own by M/S. Vapi Waste Effluent Mag.Co.Ltd, Plot No.4807, GIDC, Vapi. Generated Hazardous waste is being disposed as per guideline mention in Hazardous and Other Wastes (Management and Transboundary Movement) Rules 2016 and as amended.

Electronic waste or e-waste describes discarded electrical or electronic devices. Used electronics which are destined for refurbishment, reuse, resale, salvage recycling through material recovery, or disposal are also considered e-waste. 3 Water Quality Management Plan

Central Pollution Control Board in association with State Pollution Control Boards monitors the water quality of major Rivers and Lakes under the Global Environmental Monitoring System (GEMS) and Monitoring of Indian National Aquatic Resources System (MINARS) programme.

Based on the consolidated reports of GEMS and MINARS during the year 2005 to 2011,the CPCB has identified 351 polluted river stretches in the country.

Polluted River Stretches in Valsad:

 For Gujarat, CPCB has identified 20 numbers of Polluted River Stretches based on the Bio-Chemical Oxygen Demand (BOD) values including stretches of various River like Kolak & Damanganga of Valsad district.  About 5.5 KM stretch of river Damangaanga from Vapi to Kachigam is identified as river polluted stretches as Priority 4 and this stretch was passes through the Valsad district.  About 4.5 KM stretch of river Kolak from Salvav to Kikarla is identified as river polluted stretches as Priority 4 and this stretch was passes through the Valsad district.  Hon’ble NGT (PB) has directed all the States and Union Territories to prepare action plans within 31.01.2019 for bringing all the polluted river stretches to be fit at least for bathing purposes (i.e., BOD < 3mg/l & FC < 500 MPN/100ml) within six months from the date of finalisation of the action plans and subsequently the time limit extended for two years ie., within 31.03.2021 vide its order dated 08.04.2019.  Rejuvenation of Rivers as per action plan of Rejuvenation of Rivers committee (RCC)

At present in Valsad district total 5 Nos. Of nagarpalika(Vapi, Valsad, Pardi, Dharampur, Umargam) located, From that Vapi and Valsad nagarpalika fall in to A-Category, Pardi fall in C-Category and Umargam and Dharampur nagarpalika fall in to D-Category. Currently domestic w/w generated from the each ULB is discharge in to river/ Nala /Soak pit without treatment. No any domestic w/w treatment facility in operation in jurisdiction of Valsad district. Construction work of 20.02 MLD STP is going on at Valsad nagarpalika & 14 MLDSTP is going on at Vapi Nagarpalika. Underground drainage network is @ 80% completed in Vapi, Valsad, Dharampur & Pardi nagarpalika.

(5) 55 MLD treated w/w is discharge in to tidal zone of river Damanganga by common effluent treatment plant CETP-VGEL, Vapi. RO-Sarigam:- 14.8 MLD (1)12.5 MLD treated w/w is discharge in to deep sea (Arabian Sea-Tadgam) by common effluent treatment plant- CETP, Sarigam. Other Industrial units are operating on "Zero Liquid discharge" Condition hence there is no w/w discharge from the industries. Generated w/w is Recycle/Reuse/Evaporate/Send to common facility. Around 40 paper mill located in Valsad district and generated w/w is mostly reuse/recycle after partially treatment.

The details of Industries obtained consent of GPCB are given as follows:

Main Source of air pollution in the district are Industrial estate, Road traffic, Pollution due to vehicles, Open burning activity by scrap traders. In Valsad district 6 Nos. Of manual air quality monitoring station & 1 Nos. Of automatic CAAQMS are in operation. Control of air pollution by the installation of adequate air pollution control devices in industries like dust collator, cyclone separator, bag filter, ESP, Water scrubber, alkali scrubber etc. SOP is available with forest department for the control of forest fir. 8 Noise Pollution Management Plan

Noise can be defined as unwanted or undesired sound and Noise pollution simply means when there is a lot of noise in the environment which is consequentially harming the environment. Like smoking, noise pollution affects active and passive recipients when noise levels cross certain safe boundaries. Noise pollution affects both human health and behaviour. Noise pollution also impacts the health and well-being of wildlife.

Most activities that cause pollution are essential to meet the needs of the growing population and development. Therefore, preventive measures to minimize pollutants are more practical than their elimination.
