STAATSKOERANT, 1 DESEMBER 2010 No.33810 3 GENERAL NOTICE NOTICE 1087 OF 2010 PinmW Farrn, "164 f{athorinf;) Street, Sandton Private Bag Xi 0002, Sandton, 2146 INDEPENDENT COMMUI\IICATIONS AUTHORITY OF SOUTH AFRICA GENERAL NOTiCE - UNRESERVED POSTAL SERVICE AUDIT (1) In January 2010, the Authority sent letters to registrants in the unreserved postal service, requesting them to provide a written report outlining compliance with Section 22 (d) of the Postal Services Amendment Act No.3 of 2006 (" the Act"). (2) Section 22 (d) provides that" A person may not be registered to provide a courier service in terms of this section unless that person undertakes: (i) to receive, collect and deliver items contemplated in item l(b) ofschedule 22 (ii) to track and trace the whereabouts ofany item received or collected for delivery by such person's business undertaking, (iii) to deliver items within a definite time, in the case ofdeliveries across international borders, (iv) to deliver items within the Republic at the latest by 13:00 of the first working day after receipt thereof, and (v) to clear items through customs, where applicoble". (3) The information was requested from the unreserved postal services in order to allow the Authority to ensure compliance and update the eXisting database. A template was sent to all registrants to submit documentary proof confirming their compliance with the legislation. Registrants were given 30 working days within which to submit the documentation and/or requisite proof. The Authority received responses from some and not all of the registrants to whom letters were sent. However, the information submitted did not sufficiently demonstrate compliance with the legislation. 4 No. 33810 GOVERNMENT GAZETTE, 1 DECEMBER 2010 (4) Council of the Authority has approved the publication of the attached table in order to allow registrants to verify the details contained therein and/or to submit updated contact details where such are missing /incorrect as reflected in the table. (S) The Authority requires that registrants who are shown as not having complied, to submit such information /documentation that will enable the Authority to verify compliance with said section 22, The information must include the following: a. Invoices/receipts/proof of delivery or collection (eg Waybill Dispatch note, Express envelopes); b. Client lists (Customer register); c. Track and trace lists (eg Account copy); d. Proof of time of delivery and lor collection (eg Waybill, Dispatch note, Express envelopes) e. Proof that goods are cleared through customs (eg Collection forms); and f.
