CM01/0620 Apologies The Cathaoirleach welcomed all members and staff to the meeting and offered apologies on behalf of Councillor McEvoy. He thanked staff for their co-operation and help since the start of the Covid-19 pandemic and the Cathaoirleach, Councillor Suzanne Doyle, for the ongoing information she provided to all the members following the business continuity meetings which regularly took place over the past number of months.

CM02/0620 Minutes and Progress Report The members considered the minutes of the monthly Clane-Maynooth Municipal District meeting held on Friday, 06 March 2020 together with the progress report. Resolved on the proposal of Councillor Feeney seconded by Councillor Hamilton that the minutes of the monthly meeting of the Clane-Maynooth Municipal District held on Friday, 06 March 2020 be taken as read. The progress report was noted.

CM03/0620 Matters Arising

CM03/0220, CM02/1219, CM02/1119, CM02/1019, CM15/0719 Part 8 for Cycle lane and Footpath, Road, Maynooth. Councillor Durkan queried if a designated cycle design officer, which LPT funding had been allocated to, was in place yet. The District Engineer stated that the update was as outlined in the agenda report on the same matter confirming that a post had been offered.

CM22/0220 Maynooth Orbital Route Councillor Durkan queried if there had been any progress on this matter since the March meeting.

Councillor Ó’Cearúil noted that due to the pandemic the timeframe of the project would be extended and asked if the council were aware of how long it would be extended for.

Mr Halton confirmed that he did not know how long it would be extended for.

The District Manager stated that contracts were usually extended for the length of time of the closure.

CM04/0620 Municipal District Road Works The District Engineer updated the members on the Municipal District Road Works referring to the written update provided in advance of the meeting. He stated that crash barrier repairs were carried out in and confirmed that work would commence on contract 3 the following week. In relation to works on the L70042 Allenwood South – Nursery Road and L5026 Canal Bank Killina the District Engineer stated that they were awaiting surface dressing.

With regard to restoration maintenance, the District Engineer stated that the Restoration Maintenance programme was due to commence on 09 June, weather permitting.

He made reference to the report previously circulated which outlined the status of the identified LPT funded projects.

Councillor Weld criticised the Irish Water works due to the lack of appropriate signage directing drivers and asked the District Engineer to request the use of suitable signage when liaising with Irish Water. The District Engineer agreed that the signage was confusing and informed the members that a decision was made to have three crews working instead of one to speed up the works.

Councillor Durkan queried a timeframe for the replacement of the speed ramps outside St Joseph’s Hall, . The District Engineer stated these works would be included in Contract 6.

Councillor Farrelly asked if works in Clane were continuing to operate 24 hours a day, the District Engineer confirmed that they were.

The members thanked the District Engineer for his help and availability over the past number of months.

CM05/0620 Corona Virus (COVID-19) The District Manager provided an update to the members in relation to Covid-19. She stated that the council had been maintaining essential services and had put staff working on rosters since the announcement was made to close schools, libraries and public buildings. She confirmed that it was at this point, meetings were postponed. The District Manager informed the members that the Cathaoirleach had been involved in the business continuity meetings and kept the members up to date with information. She stated that the Community Hub helpline was implemented and outlined its purpose and how it operated. The District Manager confirmed that the

She informed the members that other services were working towards a managed opening so members of the public and staff could be assured that re-opening would be carried out in a safe manner. In relation to meetings, she stated that the Clane-Maynooth Municipal District meeting today was the first meeting to take place since they were postponed and confirmed that procedures were being put in place for the plenary council meeting for the use of Newbridge Town Hall. She concluded by advising the members that the council would continue to provide essential services in line with Government recommendations.

The members expressed their dissatisfaction in relation to the increase in fly tipping in recent months. They thanked the Environment Department for their help and co- operation on this matter. The members also thanked the Community Response Groups, Crisis Management Team, the public and the Cathaoirleach for their work in the past few months.

Mr Kavanagh stated that the council had been monitoring bottlebanks confirming that the bottlebanks had been very busy and noting that the contractor had been suffering with the same issue of staff resources as the council. He confirmed that the two civic amenity centres were increasing their opening times, stating that the Civic Amenity Centre would re-open this Saturday and Silliot Hill would re-open next Saturday.

CM06/0620 Clane-Maynooth Municipal District Annual Meeting The Meetings Administrator informed the members that the annual meeting would take place at 10.00 am on 03 July 2020 prior to the monthly meeting confirming that standing orders would be suspended until 10.30am. Resolved on the proposal of Councillor Weld, seconded by Councillor Durkan and agreed by all the members present that the annual meeting of the Clane-Maynooth Municipal District would take place at 10.00 am on 03 July 2020.

CM07/0620 Taking in Charge at Elizabeth’s Way, Cappagh, Kilcock The members considered the taking in charge of a public road at Elizabeth’s Way, Cappagh, Kilcock. Resolved on the proposal of Councillor Ward, seconded by Councillor Durkan and agreed by all the members present that the taking in charge of a public road at Elizabeth’s Way, Cappagh, Kilcock to proceed.

CM08/0620 Greenway Mr Halton asked that this item be adjourned until the next Clane-Maynooth Municipal District Meeting.

CM09/0620 Plans for the Hospitality Industry

The committee agreed to consider items number 7 and 16 of the agenda together.

Item number 7 – Question Councillor Durkan Can the council confirm what plans can or will be put in place for the hospitality industry to facilitate on street tables and chairs to comply with social distancing measures in preparation for businesses reopening once government restrictions are lifted?

Item number 16 – Question Councillor Feeney Can the council confirm if it has considered supporting local cafés and restaurants by allowing them, as a temporary measure, to make appropriate use of public squares to accommodate customers within current restrictions and guidelines, given the ongoing challenges due to COVID-19?

A report was received from the District Manager and the District Engineer informing the members that numerous queries and representations had been received from elected members and the public in relation to this matter. Essentially it was a

Minutes Clane-Maynooth Municipal District 05 June 2020 Page 5 of 22 Kildare County Council licencing matter and would have to be considered on a case by case basis by the Planning & Roads Departments.

Businesses who were looking for permission to use the public footpath/public space should fill out a Section 254 licence application. Kildare County Council were prepared to waive the Section 254 fee considering the current Covid-19 context.

The licence application would be lodged with the Planning Department and then sent to the Municipal Engineer who had confirmed he would consider each application on its own merits and as long as it was accompanied by the required insurance and drawings showing what was proposed, he would endeavour to make a prompt decision. The Municipal District Engineer had compiled some further guidance in completing the Section 254 application form which would be made available to the elected members and the business community also.

If the application was for a semi-permanent or permanent structure, there may be a need for planning permission which would have to be considered by the Planning Department.

Kildare County Council was very anxious to support the business community during this exceptionally difficult time; however, the council also have to consider public safety and ensure that each proposal that comes in does not interfere with the free flow of pedestrian traffic and does not represent a hazard for those using the footpaths.

The District Engineer informed the members that this was on a trial basis to the 01 of September. The report was noted.

CM10/0620 Review of Disabled Parking Spaces The members considered the following question in the name of Councillor Feeney.

Can the council confirm if it will be carrying out a review of the disabled parking spaces in Maynooth in the near future?

A report was received from the Roads, Transportation and Public Safety Department informing the members that the proposed public realm urban regeneration development would look at all parking in the Maynooth town centre. This would include disabled parking spaces.

A further report was received from the Roads, Transportation and Public Safety Department informing the members that all parking bye-laws as adopted by the elected members provide for suspension of parking bays at the rate of €25.00 per bay per day or €125.00 per week. Below is an extract from the bye-laws.

CM11/0620 Cycle Design Officer The members considered the following question in the name of Councillor Hamilton. Can the council provide an update on the plan to appoint the cycle design officer supported by Clane-Maynooth and Athy LPT funds, and support for the LPT funded cycle design improvement in the municipal district in light of any changes or restrictions due to the pandemic response to-date?

A report was received from the Roads, Transportation and Public Safety Department informing the members that the council had offered a post, and the issue of a contract was imminent. The Municipal District Office would liaise with Councillor Hamilton with regard to the cycle design improvement, in Quarter 3 of 2020. The report was noted.

CM12/0620 Meeting with Bord na Móna The members considered the following motion in the name of Councillor Wyse. That this council write to Bord na Móna asking them to attend a meeting of the Clane- Maynooth Municipal District to discuss the current situation regarding security in the area surrounding the Drehid Waste Management Facility and other peatlands under their ownership and to outline progress made, and future plans, for the rehabilitation of peatlands that are located in the Clane-Maynooth Municipal District.

The motion was proposed by Councillor Wyse and seconded by Councillor Durkan.

A report was received from the Meetings Administrator informing the members that this was a matter for the members to agree.

Councillor Wyse stated that it would be a good opportunity for Bord na Móna to advise the members on the work being undertaken and the future plans they had, noting that the members should be made aware of these plans.

Resolved on the proposal of Councillor Wyse, seconded by Councillor Durkan that an invitation issue to Bord na Móna to meet with a delegation of members from the Clane-Maynooth Municipal District after their monthly meeting in September 2020.

CM13/0620 Strategic Housing Development at Commons West, Boycetown, Kilcock Mr Lynch outlined the three stages of the strategic housing development process and the application details stating that the application was for 345 residential units - 69 duplex type units, 182 houses and 94 apartments ranging from 2 to 5 storeys and a 2 storey crèche facility and associated works. He informed the members of potential zoning conflicts and layout and urban design issues.

Mr Lynch outlined the timelines and next steps and stated that the purpose of presentation was to seek the members views in relation to the proposed development.

The members raised the following concerns:

- Sufficient number of parking spaces - Objection to 5 storeys – too high - Objection to vehicular entrance through Brayton Park - Density of the entire development - Playground Facilities - Open Spaces - Electric charging points - Increase in number of properties permission being sought for from 220 to 345 - Provision of balconies and if they are included in open spaces in terms of size - Accuracy of the drawings - Open spaces on lands zoned for education and community use - Link between Brayton Park and proposed development - Proposed pedestrian link along the railway track - Crèche facilities - Preservation of hedgerow

- Appropriate use of buffer space - Creche and school space - General lack of infrastructure

Mr Lynch made the following points:

- 650 car parking space were to be provided - The set back from the motorway is 92 metres - Density is within standard guidelines however regard should be given to the location – the distance from the centre of the site to the train station is 1km - The council had no input in the increase of number of properties being sought from pre-planning stage to application stage - Open spaces on the balcony is part of private open space and does not contribute to public open spaces - Accuracy of drawings may affect validity of application. This is a matter for An Bord Pleanála - Creche is shown in Phase one and therefore must be taken that it will be provided in phase one

Mr Lynch confirmed that the members views expressed at the meeting would form part of the report that issues to An Bord Pleanála.

CM14/0620 Community Heritage Grant Scheme 2020 The members considered the Community Heritage Grant Scheme 2020 (see appendix A attached).

Ms Loughlin stated that a total number of 54 applications were received under the Community Heritage Grant Scheme 2020, 49 of which were eligible, 5 did not receive funding, 1 application did not meet the criteria, 3 were double applications for the same organisation therefore only 1 was deemed eligible and 1 applicant was ineligible due to lack of information. 3 applications would not now proceed due to

Covid–19 restrictions. She informed the members that 8 applications were received in the Clane – Maynooth Municipal District.

The District Manager informed the members that when considering grants they must declare if they had any conflicts of interest. Resolved on the proposal of Councillor Ward, seconded by Councillor Feeney and agreed by all the members, that the Community Heritage Grant Scheme 2020 for the Clane-Maynooth Municipal District be approved.

CM15/0620 Public Realm Funding Application for Maynooth The members considered the following question in the name of Councillor Durkan. Can the council confirm if the following locations (details provided) will be included in the public realm funding application for Maynooth?

A report was received from the Strategic Projects & Public Realm Team informing the members that the Maynooth URDF application submitted on 29 May included all those areas listed in the councillor’s question i.e. Main Street Maynooth, Street, Mill Street, Parson Street, Court House Square, The Harbour, The Harbour Field, Carton Avenue, , , , St. Patrick’s College Maynooth, St. Mary’s , Kildare County Council yard off Leinster Street. The report was noted.

CM16/0620 Quarterly Update on Strategic Projects and Public Realm A report was provided to the members in advance of the meeting. Councillor Weld had a query in relation to the town park in Prosperous. Ms Hunt stated that a contractor was appointed and a commencement date was awaited. The report was noted.

CM17/0620 Tidy Towns Grants 2020 The members considered the Tidy Towns grant allocation for 2020 (see appendix B attached).

Mr Kavanagh stated that there were 12 Tidy Towns groups in the Clane-Maynooth Municipal District which now included Allenwood and Robertstown. He informed the members that there was a proposed budget allocation of €19,620 and LPT allocation of €26,500.

Mr Kavanagh confirmed that there would be no 2020 Tidy Towns competition and groups would have to submit details of what the allocated money was used for. Resolved on the proposal of Councillor Durkan, seconded by Councillor Wyse and agreed by all the members present that the Tidy Towns Grants 2020 for the Clane- Maynooth Municipal District be approved.

CM18/0620 Grant Awards Under Various Grant Scheme 2020 Mr Dunne explained that the report was broken into three areas and stated that LPT which was agreed by the members, was the core funding for the community grants. He stated that following the assessment, the total was €41,785 to be paid out directly with the members agreement (see appendix C attached).

In relation to the applicants whose project was unlikely/unsuitable to proceed due to Covid-19, the members stated that these grants should still be paid to cover costs that may have already been incurred in preparation for events that had to be cancelled or to prepare for future events and that all valid applications should be assessed.

The District Manager stated that the Community Department could revert to these groups and that confirmation would have to be provided that money was spent on materials.

Resolved on the proposal of Councillor Durkan, seconded by Councillor Feeney and agreed by all the members present that the grant awards under the various grant schemes 2020 for the Clane-Maynooth Municipal District be approved and the Community Department revert to the groups that had not received funding due to Covid-19 to establish if they had incurred expenses.
