While a breach in fiduciary duty will give rise to a lawsuit, it may also be grounds for the DRE to pursue a disciplinary matter against the breaching agent or broker. See Part One here (page 8). DUNNAGAN ATTORNEY Fiduciary duty encompasses more than just an overall obligation to their client; real estate agents owe several duties, including the duty of loyalty, obedience, confidentiality, reasonable care and diligence, and record keeping. With loyalty, agents must always act with their client’s interests in mind. An agent must act in the best interests of their clients, even if that means not acting in the best interest of the agent. For example, buying a client’s property and then immediately re-selling the property for a profit does not act upon the client’s best interests; this kind of transaction is self-dealing and will open the agent up for a breach in their fiduciary duty. Agents must be obedient with regards to obeying all lawful instructions that conform to the purpose of the relationship. Obedience includes speed and efficiency in carrying out instructions from their clients, however it does not include obeying www.creia.org unlawful instructions, i.e., the seller who does not want to disclose the leaky roof. Agents may not go against the instructions from the clients because agents play a helping role in the transaction and are not the owners of the transaction. Fair Housing: NAR Frontrunner for Change

In April we will celebrate the 51st Anniversary of the Fair Housing Act (FHA) in the United States. Passed in 1968, the Fair Housing Act: Makes illegal any discrimination in the sale, , or rental of housing, or making housing otherwise unavailable, due to race, color, religion, sex, handicap, familial status, or national origin. Supreme Court decisions such as Shelley v. Kraemer (1948) and Jones v. Mayer Co.

CAYLYN WRIGHT (1968) outlawed the exclusion of minorities from certain parts of cities, yet race-based housing patterns were still prominent by the late 1960s. Those who challenged them were often met with resistance, animosity and violence. At this same time, an increasing number of African American and Hispanic soldiers were fighting and dying in the Vietnam War. This left their families back home continuously struggling to rent or purchase housing in many residential areas due to their race or national origin. This prompted groups like the National Association for the Advancement of Colored People (NAACP), the National Committee Against Discrimination in Housing (NCDH), and the G.I. Forum to lobby for new fair housing legislation, which incited the Fair Housing bill. Initially there was hesitation by Congress, and an expectation that the House of Representatives, which was becoming more wary of racial integration, would weaken the bill. On April 4, Martin Luther King Jr. was assassinated in Tennessee. Riots broke out across the nation, prompting President Johnson to put pressure on Congress to pass the bill as a testament to King’s legacy. The Fair Housing Act was passed on April 10, 1968 and signed into law the next day, April 11, 1968. Originally the Fair Housing Act offered protection to five classes: race, color, religion, sex, and national origin. In 1988, it was amended to include handicap and familial status to the protected classes. Today, the FHA covers seven federally defined “protected classes”: race, color, religion, national origin, sex, disability, and familial status. 9

Unfortunately, the Fair Housing Act does not protect the LGBTQ community for discrimination based specially on sexual orientation. It is prohibited for any or housing provider who receives U.S. Department of Housing and Urban Development (HUD) or FHA funds to discriminate against a tenant on the basis of real or perceived sexual orientation, gender identity or marital status. It is also prohibited for a lender to deny an FHA- insured mortgage to any qualified applicant based on their sexual orientation, gender identity, or marital status. Although the LGBTQ community is not safeguarded nationwide on this issue, half of the states in the United States do offer specific protections covering both sexual orientation and gender identity securities. NAR is on the front line of change regarding fair housing, requiring their members to consider sexual orientation and gender identity protected classes. NAR authorizes sanctions in response to a finding that a member violated any fair housing law, including local and state laws that prohibit discrimination based on sexual orientation or gender identity. In both 2010, and 2014, NAR amended its Code of Ethics to safeguard equal housing opportunities for those facing discrimination for sexual orientation and gender identity. NAR also supported legislation in Congress to add those same protections to the Fair Housing Act. The Board of Directors of NAR voted last year to continuously bolster the LGBTQ community and to defend their rights to fair housing. Earlier this month that promise was continued as NAR President John Smaby voiced NAR’s support of H.R. 5, “The Equality Act,” particularly its inclusion of fair housing rights based on sexual orientation and gender identity. We have come a long way in advocating for marginalized communities, but we still have a way to go. NAR is dedicated to espouse for marginalized and underserved groups, with the overarching goal that, as President Johnson said when the FHA originally passed, “fair housing for all—all human beings who live in this country— is now a part of the American way of life.” As an organization, REALTORS® strive to provide the guarantee that all aspects of housing will be fair to all people and as leaders in the housing industry, REALTORS® have the responsibility to set the tone and spear-head these efforts in their work every day to make the American Dream a reality for everyone.

Fair Housing requirements are codified in both federal and CA law. Last year we celebrated to 50th anniversary of the federal Fair Housing Act of 1968. This year is the 60th Anniversary of the CA Unruh Civil Rights Act which was the basis for barring discrimination in CA. Since that time both laws have been amended on several occasions to expand the scope of coverage and increase the number of designated protected classes. But fair housing is not just a law, it is a concept. While the laws establish protected DAVE TANNER classes, that does not mean that it is ok to deny equal services to others because they are not a member of a protected class. The true scope of fair housing requires that we provide quality service to everyone seeking our assistance. I think too often people make judgement calls about others from their appearance without ever finding out anything about the person. About 15 years ago Michelle and I got to put this to the test. A client called and said they had been referred to us. He was from Los Angeles, but his wife just loved the look and feel of the Fab Forties so he wanted to look at houses there. He was flying in that night and wanted to look at houses the next day. He was staying at the Hyatt. We had just placed the new local manager of a national investment firm in a home in American River Canyon a few weeks earlier so we kind of knew what to expect. We went to meet them in the hotel lobby. They had seen a picture on Michelle so they knew who we were and they walked over to greet us. Oh my gosh, what had we gotten into. They were young, probably late 20’s. He had spiked blond hair about four inches long. She had black hair on one side, bright blue on the other side, and several visible piercings. I was wondering how they could afford to stay at the Hyatt. But we took them out to look at property in the 40’s. As we spent the day with them we found they were really great people. He was the leader of a very successful punk rock band and had flown to Sacramento in their private jet. He not only was the lead singer and guitarist but also owned the record label and produced other groups. They felt they had to play the role when they were in L.A. But he would take off and tour for weeks at a time and she did not want to have to play the role while he was gone, so she wanted the house in Sacramento to get away. When he took off to tour she grabbed three or four of her girlfriends, none of whom were in the business, and would come to spend a few quiet weeks in the Fab Forties. We found all this out by driving them around. But apparently we made a splash in the 40’s. By the time we got back to the office we had several calls from owners that had our cards from the showings and said that their neighbors that were home called and told them they better not sell to “those people.” They did buy a home here and kept it for several years before their tastes changed and they sold it and bought a beachfront home in La Jolla. I am so glad I did not give in to my initial reaction as they were walking across the lobby toward us. Not only would we have missed out on a couple transactions, but even more important we would have missed out on the opportunity to know some really nice people. So always keep an open mind and provide the full concept of fair housing in everything you do. Update On Class Action Antitrust Lawsuit

Hello all,

I am reaching out to provide an update on the class action lawsuit that was filed on March 6, 2019, in US District Court in Illinois against NAR, Realogy, Keller Williams, RE/Max and HomeServices of America. First, let me reiterate, we strongly believe that the lawsuit is baseless and we (and our members) will prevail.

Katie Johnson The complaint centers around an allegation that just isn’t true. It asserts that NAR rules prohibit seller and buyer brokers from negotiating over the amount of commission that will be paid to the buyer broker. However, NAR’s Handbook on Multiple Listing Policy and the Code of Ethics and Standard of Practice both explicitly state that buyer and seller brokers can negotiate over commissions.

In addition, several state and federal courts have considered challenges to multiple listing services, and they have overwhelmingly concluded that MLSs benefit consumers because they encourage brokers to share listing information and cooperate when serving the interests of their clients. MLSs are inherently good for consumers, not bad for them. Nothing in this complaint calls this well-established doctrine into question.

We will keep you updated and let you know when NAR files a response to the complaint. In the meantime, I want to let you know that NAR has been fielding a number of media requests about the case. These include, CNN, FOX News and other high-profile top tier news organizations. Our strategy is to respond in a timely fashion to all media request as we strongly defend our industry. While we suspect the plaintiff is employing an aggressive media outreach strategy, know that NAR will be there every step of the way to counter any misinformation and to set the record straight. Please be cautious about discussing the case online and please direct all media inquiries to NAR’s VP of Media Communications, Mantill Williams ([email protected]). 1. How long have you been working with SAR? What is your job title and duties? It’s been a fast 2 months – Director of Member Services, maintaining the MLS database along with SAR’s database. A big part of my responsibilities are coaching and development of the member services team along with providing “World Class” customer service to our members.

2. What did you do before you were hired on at SAR?

3. What are some of the things you like about working at SAR? I respect the level of loyalty this team has. It’s nice to see a team of people working together to meet the needs of our members.

4. How long have you lived in the Sacramento area? Where have you lived before? I moved back to the Sacramento area in 1988 after serving 7 years in the US Army. I spent most of my time in Colorado at Ft. Carson. I was born and raised in Placerville, Ca.

5. What do you like/dislike about Sacramento? I love that Sacramento is right between San Francisco and Lake Tahoe, it a perfect place for me to call home.

6. What are some of your hobbies or interests? I love to ski! I started back when I was 4 years old. I also enjoy paddle boarding, mountain biking, hiking around Lake Tahoe, and woodworking.

7. Have you watched any good movies or read any good books lately? I just finished Extreme Ownership and Good to Great.

8. Do you have any favorite vacation spots? Anywhere with snow or sand. I’m always up for a trip to Vail or Saint Kitts!

9. What’s your favorite restaurant(s) in the Sacramento area? Hands down – Mikuni’s! Pepper Fin, Japanese Mafia, and a Black and White.

10. What would people be surprised to learn about you? I hold a PSIA license (Professional Ski Instructors of America) with endorsements to teach visually impaired skiers and skiers with spinal cord injuries. 18

The Sacramento Association of REALTORS® focuses on more than just real estate, it also focuses on investing in the community. You’ve likely heard of the annual Christmas CanTree, which raises tens of thousands of dollars for the local chapter of the Salvation Army every year. In addition to these great donation drives and fundraisers, SAR also offers Members the opportunity to get their hands dirty and touch the lives of those in the community who need a little help. One such opportunity lies in the Rebuild Day coming up on Saturday, April 27th. SAR has been partnering with Rebuilding Together Sacramento for years by becoming a House Sponsor. At this sponsorship level, SAR not only sponsors the rehabilitation of the home through a monetary donation, but also provides the volunteer power needed to complete the Rebuild. Our House Captain, REALTOR® Sara Henderson of McKiernan Realty, has been taking on the project management aspect of this day and our Volunteer Coordinator, Patsy Tyre of Envoy Mortgage, is going to manage volunteer communication on the day of. This day could not go on without their selfless dedication and willingness to donate many hours of their time to this project. Thank you both! The one other thing we need is VOLUNTEERS! We are looking for both skilled and un-skilled volunteers. Have DIY experience fixing projects around your house? Great! We’re looking for you! Compared to the same month last year (1,131), the current figure is down 10.3%. Of the 1,015 sales this month, 128 (12.6%) used cash financing, 617 (61%) used conventional, 185 (18.2%) used FHA, 64 (6.3%) used VA and 21 (2.1%) used Other† types of financing. The median sales price increased 2.2% from $352,250 to $360,000. Compared to February 2018 ($349,900), the current figure is up 2.9%. The Active Listing Inventory decreased, falling 4.8% from 2,095 to 1,994 units. The Months of Inventory decreased 13% from 2.3 to 2 Months. This figure represents the amount of time (in months) it would take for the current rate of sales to deplete the total active listing inventory. The chart to the left reflects the Months of Inventory in each price range. Pending sales for the month increased 15.5% from 773 to 893. The Average DOM (days on market) increased again, rising from 40 to 43. The Median DOM remained at 27. “Days on market” represents the days between the initial listing of the home as “active” and the day it goes “pending.” Of the 1,015 sales this month, 53.7% (545) were on the market for 30 days or less and 71.1% (722) were on the market for 60 days or less.
