Under Cutcliffe’s direction, the 20th-ranked Blue Devils have set a school record with 10 victories and earned their first-ever berth in the Dr. Pepper ACC Championship Game. Duke clinched the Coastal Division title and championship game berth with a 27-25 victory over in-state rival North Carolina on November 30. Duke (10-2, 6-2 in the Coastal Division) will face top-ranked Florida State (12-0) on Saturday, December 7 in Charlotte, N.C. The Blue Devils enter the game with an eight-game winning streak – the program’s longest since 1941. • Rich Rodriguez – Jumping Has Legal Consequences
deference to state high school athletic associations and educational institutions regardless of the adverse effects on students who are deemed ineligible to participate in interscholastic athletics, reflects the judiciary’s strong desire to avoid interfering with and micromanaging the high school educational process.69 In a forthcoming article Professor Timothy Davis and I have proposed that a high school or college athlete should be denied an opportunity to participate in a sport only if doing so actually furthers a legitimate objective of the governing body or a school such as ensuring academic integrity, maintaining competitive balance and fair play, or promoting appropriate standards of conduct.70 In summary, United States law does not establish any constitutionally protected or fundamental right to participate in sports. Nevertheless, Olympic and professional athletes are provided a means to seek independent de novo review of eligibility decisions, usually through a system of private arbitration. In contrast, despite the significant benefits of participation in intercollegiate or interscholastic sports competition, U.S. courts almost uniformly refuse to recognize a legally protected interest in interscholastic or intercollegiate athletic participation or apply more than very limited rational basis scrutiny of student-athlete eligibility determinations unless there is exclusion or discrimination prohibited on constitutional or statutory grounds. ___________ 69. Mo. 2000); Jones, 197 Cal.App.3d 751, 757 (1988) (Stating “schools themselves are far the better agencies to devise rules and restrictions governing extracurricular activities. Judicial intervention into school policy should always be reduced to a minimum”).

The rewards have never been greater. As for job security, let’s just say it’s best to have a real estate agent on speed dial. But even if it’s only for a few years, the chance to run a major college football program is an opportunity just about any coach would take. “It’s tougher because we’re being held accountable and responsible for these young men 24 hours a day,” said South Florida’s Skip Holtz, the son of Hall of Fame coach Lou Holtz who is entering his 14th year as a head coach. “We’re held to a higher standard academically. We’re being asked to win. And win now. We’re not quite as patient as we once were. So I think it’s changed a little bit. I don’t think it’s for the bad. I think if you’re the head coach, you should be held responsible for those things.” This season, 28 of the 124 schools that play in the Football Bowl Subdivision will have a new man being held responsible for the program, including Penn State, where Bill O’Brien takes a job the late Joe Paterno held for 46 years and then lost in the Jerry Sandusky scandal. That list also includes some big names returning to the sideline, such as Urban Meyer at Ohio State, Rich Rodriguez at Arizona and Mike Leach at Washington State.

  • The Bombshell Newsweek Cover Story, Blowing up the HBO “Paterno” Movie, That Was Spiked at the Last Moment
EXCLUSIVE: The Bombshell Newsweek Cover Story, Blowing Up the HBO “Paterno” Movie, That Was Spiked At The Last Moment Submitted by jzadmin Thu, 03/29/2018 - 10:18 Editor’s Note: What follows is one of the last full versions of a massive Newsweek cover story which was scheduled for their April 6th, 2018 edition. It is over 20,000 words, and almost all of it was going to be posted on their website, with at least 15,000 words in the actual magazine. This version was meticulously vetted by multiple top Newsweek editors and something very close to it was approved for final vetting for their lawyer, which is normally a formality. In fact, the editor in charge of the story at that stage, Ross Schneiderman, specifically told me that he couldn’t imagine that their lawyer would have any serious issues. This piece began in the fall of 2017 when Newsweek’s then top editor Bob Roe hired reporter Ralph Cipriano to do a story on the Penn State saga from the perspective that everything we think we know may be false. Ralph had been leaked a huge cache of documents related to the Penn State settlements and the Louis Freeh investigation. Bob had long ago worked the infamous “McMartin Pre-School Sex Abuse Case,” which turned out to be a fraud, so he understood how this kind of scenario could have easily happened in the midst of a moral panic. Ralph, realizing that I have knowledge and information about the case which no one else does, including that of a purposely fake Sandusky accuser who had run a “sting” operation on the most important lawyer and therapist in the case for over three years, agreed to bring me on as his co-writer.
