FOREWORD At the outset, we thank the Forex Fraternity for their unstinted co-operation in all endeavours of Forex Association of India. We are delighted to bring out the “Dealing Room Directory - 2018.” The earlier edition of the directory was brought out in 2015. The Directory contains among other things, present address of the dealing rooms, names of the dealers, the telephone numbers etc. We place the directory in the hands of the “Forex Dealers”, who are associated with movement of “Foreign Exchange” of the country day in and day out. We hope the directory will be of immense help to all the Forex Dealers. While we have made all out efforts to provide error free and updated details of the member banks and dealers, members are requested to bring to the notice of the Managing Committee any errors/printing mistakes which could be communicated to the members through e-mail. What now for enforcement against cum-ex traders? The issue of cum-ex trading has returned to the spotlight after Denmark's £1.5 billion claim against hedge funder Sanjay Shah, expected to become one of Britain's longest and most expensive trials, was yesterday dismissed by the English High Court. The claim alleged that Shah, through his fund Solo Capital Partners, masterminded a cum-ex trading scheme that defrauded the Danish tax authority, SKAT, of vast sums of money between 2012 and 2015, naming 114 defendants. The English High Court's dismissal of the case, on a point of policy rather than merit, was a narrow escape for Shah, who has emerged as a central figure in the trades and remains subject to investigation and prosecution in other jurisdictions. Shah maintains that his actions were lawful. In a four-day trial covering preliminary matters, Shah's lawyers argued that the Court did not have the jurisdiction to hear the case, as it is "governmental in nature" and attempts to utilise the English court to enforce foreign revenue laws, forbidden under what is known as the 'Revenue Rule'. In his judgment released yesterday, Judge Baker agreed; holding that the claim was an attempt by the Danish authority to recover lost tax revenue, which is inadmissible in an English court. SKAT has stated its intention to appeal; arguing that it is seeking to recoup the proceeds of fraud rather than enforce its revenue laws.

Every jurisdiction - more or less - imposes them; some shareholders are entitled to refunds on those taxes depending on where they are based in the world. Historically owners of dividends, companies whether it’s banks or hedge funds or asset managers, when they received dividends and when they pay taxes on those dividends they would often seek ways of reducing that tax burden, such as lending out their stocks around the time of the dividend and then getting them back a week later.

EU Horizon 2020 Project The Cum-cum and Cum-Ex Schemes Executive Summary This COFFERS case study explores the biggest tax robbery in history. The Cum-Cum and Cum-Ex schemes cost European treasuries a combined sum over €50 billion. The case outlines a range of transaction types involved. These sit on a spectrum between the legal, which transgresses the spirit of the law, and the outright criminal. With a focus on Germany and Denmark, the case explores both the conditions of possibility for the trades prolonged persistence without regulatory intervention, and regulatory reactions to it. A key conclusion is the transactions themselves were not overly complex and indecipherable. Rather, elementary weaknesses in Europe’s and member state regulatory apparatus are at fault. Integration across financial and fiscal regulation, greater levels of international information exchange and cooperation, and higher levels of capacity in regulatory authorities are in consequence required. The Cum-Cum and Cum-Ex schemes also make the case for a pan-European economic crimes unit. Introduction The Cum-Cum and Cum-Ex scandals provide a rare glimpse into a largescale ‘tax-extraction market’ and the interface between financial market and tax regulation. The Cum-Cum and Cum-Ex transactions enabled perpetrators to claim and receive one or multiple tax dividend rebates when none was strictly due. ‘Tax extraction’ is the appropriation of fiscal resources using tax laws in both legal ways, that transgress the spirit of the law, and illegal ways, that break the law.
