Order Sri. Nadir Ali, H. No. 5-6-818/4, Khitte Saleheen, Darusalam, Aghapura, Hyderabad has filed a appeal dated NIL which was received by this Commission on 07-04-2017 for not getting the information sought by him from the PIO / O/o Telangana State Waqf Board, Haj House, Nampally, Hyderabad and First Appellate Authority / O/o Telangana State Waqf Board, Haj House, Nampally, Hyderabad.

The brief facts of the case as per the appeal and other records received along with it are that the appellant herein filed an application dated 17-01-2017 u/s 6(1) of the RTI Act, before the PIO / O/o Telangana State Waqf Board, Haj House, Nampally, Hyderabad requesting to furnish the information on the following points.

The PIO / Superintendent, O/o Telangana State Waqf Board, Haj House, Nampally, Hyderabad through letter no: R/1Gen/2017 dated 08-03-2017 informed the appellant that he did not mention the file number and requested to specify the file number.

Aggrieved with the reply from the PIO, the appellant filed 1st appeal dated 06-03-2017 u/s 19(1) of the RTI Act, before the 1st Appellate Authority requesting him to furnish the information sought by him. Stating that the appellant did not receive any information from the PIO / 1st Appellate Authority, he preferred this 2nd appeal u/s 19(3) of the RTI Act before this Commission requesting to arrange to furnish the information sought by him.

The case is called on 19-02-2018. The appellant is present. The PIO / Sri. Sameen Arif, Superintendent, O/o the Telangana State Wakf Board, Haj House, Nampally, Hyderabad is present. The First Appellate Authority / Sri. Syed Mateen Ahmed, O/o the Telangana State Wakf Board, Haj House, Nampally, Hyderabad is present.

The appellant filed an affidavit dated 19-02-2018 complaining that the information was not furnished and impose penalty.

The PIO through affidavit dated 19-02-2018 stated that the appellant did not indicate the file number. The appellant says that he did not know the file number.

After prolonged discussion, the PIO stated that the details of the House no: 5-6-818/1, Darausalam, Agapura, Hyderabad may be available with the Greater Hyderabad Municipal Corporation, Hyderabad and the appellant is advised to approach the PIO / Greater Hyderabad Municipal Corporation, Hyderabad

Hence in view of the above position, the appellant is advised to file an application under RTI Act before the Municipality for further information and after receipt of the details, file the same before the PIO / Telangana State Wakf Board, Haj House, Nampally, Hyderabad.

On receipt of the details from the appellant, the PIO / Telangana State Wakf Board, Haj House, Nampally, Hyderabad is directed to furnish the information sought by the appellant within 7 days and submit the compliance report before the Commission.

With the above directions, the appeal is closed.
