The writ petitioner being the proprietor of M/s Harimurat Rice Mill, Bihta, has preferred the present writ application for quashing the Memo No.49 dated 6.7.2019 as contained in Annexure 12 issued by the Certificate Officer, Danapur in Case No. 13/2014-15 whereby a notice has been issued under Rule 53 of the Public Demands Recovery Rules (hereinafter referred to as the Rules) to the effect that if the certificate amount of Rs.2,39,313/- is not deposited by the petitioner, the Certificate Officer will issue attachment order of his property and will also put the land and building of the petitioner on auction. The relief prayed for in paragraph 1 of the writ application reads as follows: “(i) For issuance of writ in the nature of certiorari for quashing of memo No.49 dated 6.7.2019 issued by the Certificate, Danapur in Case No. 13/2014-15 whereby a notice has been issued under Section -53 of the PDR Act that if the amount of Rs.2,39,313.00 is not deposited by the 2 petitioner, he will issue attachment order of his property and also put the property on auction. -

The state government has given consent for mining for five years to Mineral Development Officer, District Mining office, Patna via letter no- 3880 A/M, dated 11-11-2019. This project falls under Category- “B1” as per EIA Notification 2006 (amended till date) of the Ministry of Environment and Forests & Climate Change, New Delhi. The proposed cost of the project is 0.39 carore. The proposed project activity will be carried out in inactive channel of riverbed of Son River. Since long back, this state has been a centre of education. Presently, a huge gap got created in between the demand of education and supply. This gap between the school education and higher education has brought the literacy rate of the state a bit down. This signifies the importance of establishment of more schools in the field of modern education. This craving for higher education among the general population of Bihar has led to a migration of the student community from the state. This has led to a flooding of students to seek educational opportunities in other state, even for graduation level college education. Patna has become an educational hub for the Eastern India. It is an important centre for preparation of exam like IIT, IAS, Engineering and Medical entrance. The quality education of schools is better in Patna than New Delhi. But Bihar still lacks behind in Higher Education. We need an initiative from educational ministry of Bihar to take proper step in opening technical institutes for students of Bihar which will help them to stay in their state and also attracts students from different states. If we all work toward these steps, we will see a rise in education system of Bihar which will be very fruitful for betterment of Bihar and its people. -

SHRI KAUSHALENDRA KUMAR: Will the Minister of RAILWAYS be pleased to state: (a) whether tenders for two Foot Over Bridges (FOBs) in Patna City and Rajendra Nagar and six FOBs in Gulzarbagh, Danapur and Neura under Danapur zone were issued in 2016 itself; (b) if so, the time by which work on these FOBs is likely to be started; (c) whether these FOBs have been sanctioned keeping in view the inconvenience being faced by the people while moving across the railway line; and (d) if so, the details thereof and the reasons for delay? ANSWER MINISTER OF STATE IN THE MINISTRY OF RAILWAYS (SHRI RAJEN GOHAIN) (a) Yes, Madam. Tenders for 06 Foot Over Bridges (FOBs) (1) Patna City - Bakhtiyarpur, (2) Rajendra Nagar - Gulzarbagh (3) Patna Jn.- Rajendra Nagar, (4) Patna Jn. Sachivalaya (5) Danapur – Neaora and (6) Neaora - Bihta were issued in the year 2016. (b) Work has already started and FOBs at Didarganj (Patna City - Bakhtiyarpur), Rajendra Nagar (Rajendra Nagar – Gulzarbagh) and Rajendra Nagar (Patna Jn.- Rajendra Nagar) have already been completed and commissioned. Work for construction of FOB at R-Block (Patna Jn.- Sachivalaya) is in progress. Work for construction of FOBs at Danapur - Neaora and Neaora – Bihta is yet to be started. (c) These FOBs have been sanctioned keeping in view the inconvenience being faced by the people while moving across the Railway line. From April, 2018 FOBs are included in minimum essential amenities for all category of stations on broad gauge. -

This appeal takes exception to the judgment and order dated 27.8.2019 passed by the High Court of Judicature at Patna (for short, `the High Court'), thereby setting aside the order of the learned single Judge, dated 6.3.2019 and orders passed by the Court of Civil Judge (Junior Division)-cum-Election Tribunal, Danapur, District Patna, Bihar (for short, `the Election Tribunal'), dated 11.10.2018 and 11.4.2019 in Election Case No. 08/2016. Consequently, the above numbered election case filed by the appellant challenging the election of respondent No. 1 as returned candidate for the post of Mukhia, 2 Artyapur Gram Panchayat No. 8 under Naubatpur Block, came to be dismissed. 3. Briefly stated, the election for the post of Mukhia, Artyapur Gram Panchayat No. 8 under Naubatpur Block was held on 6.5.2016, in which the appellant and respondent No. 1 alongwith 11 others had contested as candidates and after counting of votes on 4.6.2016, the respondent No. 1 was declared elected. During the counting, however, the appellant had noticed that number of valid votes cast in his favour were being rejected, while even invalid votes in favour of respondent No. 1 were being accepted and counted.
