The Restatement and our text books on Agency deal haphazardly with the formal power, treating it with such topics as apparent or ostensible authority and generally confusing the bilateral relationship of agency with the unilaterality of the act that is the characteristic of the formal power.2 The same confusion is to be found in the earlier foreign codes.'
