The Environment Court of New Zealand Notice of Mediation THE ENVIRONMENT COURT OF NEW ZEALAND NOTICE OF MEDIATION The parties to these proceedings in the attached schedule have been directed to attend court­ assisted mediation. The prerogative for setting a date for the mediation lies solely with the Registrar and is made first and foremost in terms of the availability of an Environment Commissioner. Accordingly this matter has been set down for mediation at the date, time and at the venue specified below: DATE/TIME Friday 28 August 2020 -9:30 AM See the attached schedule VENUE: REMOTE connection via TEAMS So the Environment Court connect you all parties are to supply the names, email addresses and telephone numbers of all proposed participants by Monday 17 August 2020 This material is to be sent to the Court and copied to all parties as per the attached list of parties. Note To Participants: Participation in the mediation process is mandatory, and each party must participate in person or by a representative unless leave is granted by the Court not to attend. Any application for leave to be excused must be made in writing to the Registrar, giving reasons and be served upon all other participants to the proceedings. The number of parties involved and the need to schedule the mediation topics in a logical order means that there is no flexibility to change the dates. If you are unable to attend on the scheduled date you should consider appointing a representative to attend on your behalf. The Court has released a Practice Note on Alternative Dispute Resolution, which may assist parties in the protocols around the Mediation Process. A copy of this Practice Note can be obtained through this Environment Court Registry. Information on the Environment Court and the Court's Practice Notes which serve as a guide, are available at www.justice.govt.nz/courts/environment-court.     Pro Bono Practices and Opportunities in New Zealand1 INTRODUCTION New Zealand’s population of approximately 4.4 million residents is served by approximately 12,480 lawyers, amongst which just under 12,000 lawyers practise locally, with a further 550 based overseas holding a practising certificate issued by the New Zealand Law Society (“NZLS”).2 Two thirds of law firms spend 1-5% of practice time on pro bono work, and the value of pro bono work in New Zealand is estimated to be between approximately $13 million and $68 million annually.3 Community Law Centres (“CLCs”) provide certain categories of legal services at no cost to people who are unable to meet the cost of a private lawyer or do not have access to legal aid. Direct pro bono work undertaken by CLCs equates to almost $1.4 million annually.4 OVERVIEW OF THE LEGAL SYSTEM The Jusctice System Constitution and Governing Laws New Zealand is an independent state. It is a democracy and a constitutional monarchy, meaning that the Queen of England, as head of state, is the source of legal authority in New Zealand, but that she and her representative, the Governor-General, act on the advice of the democratically elected government, in all but the most exceptional circumstances. It has inherited a Westminster system of government, maintaining a separation of powers between the legislature, the executive and the judiciary. New Zealand does not have a full and entrenched written constitution, and the sources of its constitution include various statutes with constitutional significance (e.g. the Constitution Act 1986, the Electoral Act 1993, the New Zealand Bill of Rights Act 1990), British laws adopted by New Zealand through the Imperial Laws Application Act 1988, such as the Magna Carta, court decisions, constitutional conventions, the Treaty of Waitangi and the prerogative powers of the Queen.5 The Courts Court system New Zealand has a hierarchical court system.

Some aspects of the plaintiff’s claim rested on propositions that were novel, and without relevant authorities to which counsel were able to refer, and I indicated that I would take time to consider the position. In the meantime, the defendant undertook not to proceed with the intended appointment of receivers pending the delivery of this judgment.
