Consequently, the Board provides no opinion on the contemplated use of any machine a licensee is considering purchasing. The Barbering and Cosmetology Act (Act) defines the scope of practice of cosmetology and its specialty branch of skin care. (California Business and Professions Code, section 7316 (b) and (c).) A person licensed as a cosmetologist or esthetician is required to limit their practice and services rendered to the public to only those areas for which they are licensed. (California Business and Professions Code, section 7317.) The Act confers no authority to practice medicine or surgery. (California Business and Professions Code, section 7320.) The Board’s regulations specifically prohibit invasive procedures which results in the removal, destruction, incision, or piercing of a client’s skin beyond the epidermis or the application of electricity which visibly contracts the muscle (Title 16, California Code of Regulations, section 991.) Licensed cosmetologists and estheticians are cautioned not to engage in any invasive procedures. The use of electrical stimulation in providing skin care services falls within the practice of an esthetician under certain conditions. So long as the machines providing the electrical stimulation do not deliver an electrical current that will visibly contract the muscle of the body or face and/or result in the destruction or removal of the skin below the client’s epidermis.

Roxie has served as a community college cosmetology instructor for 27 years. For 23 of those years she served in the Cosmetology Department of the San Jose Community College District. Starting as a substitute, she became an instructional aide at San Jose City College where she helped implement the Esthetics Program.     ARIZONA REVISED STATUTES TITLE 32 – PROFESSIONS & OCCUPATIONS CHAPTER 5 – COSMETOLOGY ARTICLE 1 32-501. Definitions In this chapter, unless the context otherwise requires: 1. "Aesthetician" means a person who is licensed to practice skin care pursuant to this chapter. 2. "Aesthetics" means any one or a combination of the following practices if they are performed for cosmetic purposes: (a) Massaging, cleansing, stimulating, manipulating, exercising, beautifying or applying oils, creams, antiseptics, clays, lotions or other preparations, either by hand or by mechanical or electrical appliances. (b) Arching eyebrows or tinting eyebrows and eyelashes. (c) Removing superfluous hair by means other than electrolysis or threading. 3. "Board" means the board of cosmetology. 4. "Cosmetic purposes" means for the purpose of beautifying, preserving or conferring comeliness, excluding therapeutic massage and manipulations. 5. "Cosmetologist" means a person who is licensed to practice cosmetology pursuant to this chapter. 6. "Cosmetology" means any one or a combination of the following practices if they are performed for cosmetic purposes: (a) Cutting, clipping or trimming hair. (b) Massaging, cleansing, stimulating, manipulating, exercising, beautifying or applying oils, creams, antiseptics, clays, lotions or other preparations, either by hand or by mechanical or electrical appliances. (c) Styling, arranging, dressing, curling, waving, permanent waving, straightening, cleansing, singeing, bleaching, dyeing, tinting, coloring or similarly treating hair. (d) Arching eyebrows or tinting eyebrows and eyelashes. (e) Removing superfluous hair by means other than electrolysis or threading. (f) Nail technology. 7. "Electrical appliances" means devices that use electrical current and includes lasers and IPL devices as defined in section 32-516. 8. "Instructor" means a person who is licensed to teach cosmetology, aesthetics or nail technology, or any combination thereof, pursuant to this chapter.

    TITLE 175. STATE BOARD OF COSMETOLOGY AND BARBERING CHAPTER 1. ADMINISTRATIVE OPERATIONS 175:1-1-2. Definitions The terms and phrases defined in the Oklahoma Cosmetology Act shall have the same meaning when applied in the rules which are herein set forth in this Chapter to substantiate the Cosmetology and Barbering Law. The following rules and terms shall have the same meaning, unless the context clearly indicates otherwise: “Act” means the Oklahoma Cosmetology and Barbering Act. “Apprentice” means a person who is engaged in learning the practice of cosmetology or barbering in a cosmetology or barber establishment. [Title 59 O.S. Section 199.1] “Assigned practice or clinic work” means demonstrations and lesson practice in which services may be performed on patron, student or model on clinic floor in classroom for the benefit of student observation, notes, etc. The practice or demonstration shall be assigned by or with approval of the instructor in charge and materials/supplies used for the education demonstration are the responsibility of the school. “Barber/Barber Stylist” means any person who engages in the practice of barbering. “Barber Establishment” means an Establishment or place of business where one or more persons are engaged in the practice of barbering but shall not include barber schools or colleges. “Barbering” means any one or combination of practices done upon the upper part of the human body for cosmetic purposes and when done for payment either directly or indirectly for the general public, constitutes the practice of barbering, to wit: shaving or trimming the beard or cutting the hair; giving facial or scalp massages or treatment with oils, creams, lotions or other preparations, either by hand or mechanical appliances; singeing, shampooing or applying lighteners or color to the hair, applying hair tonics; applying cosmetic preparations, antiseptics, powders, oils, clays or lotions to scalp, face, neck or upper part of the body; and removing superfluous hair from the face, neck or upper part of the body.

Whenever application is made for a certificate or registration for a newly organized school, evidence must be furnished as to the responsibility, financial and othel'wise, of the persons interested in the school. H 12.02 Limitations of instructor. Any person who acts as an instructor in a school of cosmetology shall not practice cosmetology in any school except to demonstrate for students. Changes in instruc­ tors must be reported promptly to the board. H 12.03 Ratio of instructors to students. (1) A full-time instructor is an instructor who teaches a minimum of 32 hours a week. (2) A part-time instructor is an instructor who teaches less than 32 hours a week. (3) There shall be at least one full-time instructor, as defined in subsection H 12.03 (1) for each 16 students 01' fraction thereof receiv­ ing training in a school of cosmetology. (4) Only full-time instructors can be counted for the PUl'pose of enrollment to maintain a ratio of one instructor to each 16 students or fraction thereof receiving training. Part-time instructors are not considered for the purposes of enrollment.

INSTRUCTIONS Use this application for new salons, a salon changing location or a salon completely changing ownership. If you are applying for more than one type of license (i.e. esthetics and nail technology), you must complete an application for each license type. To add or remove one or more owners do not use this application; use the Change of Ownership Form. SALON LOCATION If there is an active salon license at the location where you would like to open your salon, one of the following requirements must be met: Option 1: The owner of the active salon license returns the license to the Board marked “closed.” You may not send the active salon license to the Board with this application. Only the current owner may send the license to the Board. Option 2: The owner of the active salon license signs this application and authorizes you to operate the salon under their salon license; or Option 3: The owner/manager of the building where the salon is located signs this application and states that the owner of the active salon license has vacated the premises and has no right to occupy it. You may operate the salon prior to the compliance inspection only if the current owner has signed this application. The Barber Pole • Symbol of the barber surgeon – Has its roots in a medical procedure called bloodletting that was once thought to strengthen the immune system. • What the pole represents – Pole – staff that patients held tightly to make the veins in their arms stand out during the procedure. – Bottom-end cap – the basin used to catch the blood. – Red and White stripes – the white bandages that stopped the bleeding were hung on the pole to dry. • As the wind blew these bandages would become twisted around the pole, forming a red-and-white pattern. • Up until the 19 th century, many barbers also performed minor surgeries and practiced dentistry. – White- bandages – Red – blood – Blue - veins Egyptians • 1st to cultivate beauty and to use cosmetics as their personal beautification habits, religious ceremonies , and preparing the deceased for burial. • Used minerals, insects and berries to create makeup. • Used henna to stain their hair and nails . • 1st to infuse essential oils from leaves, bark and blossoms of plants for use as perfumes and purification purposes.
