In what appears to be the first-ever case of its kind, Nielsen Audio has sued Bubba The Love Sponge in federal court over alleged ratings tampering. Filed Thursday in U.S. District Court in the Middle District of Florida in Tampa, the civil action accuses the host (Todd Clem) and his Bubba Radio Network of fraud, conspiracy to defraud, violating the Florida Deceptive and Unfair Practices Act and interfering with business and contractual relations between Nielsen and Beasley Media Group, which airs his syndicated show in Tampa. It seeks at least $1 million. In the suit, Nielsen claims Clem met with the “cooperating panelist” multiple times in July and August, offering to pay $300 per month if the listener helped increase his ratings, up to $400 if a target ratings threshold was achieved. According to the Tampa Tribune, Clem sent texts to the panelist including one that read, “U have to PROMISE NOT TO SAY A WORD ... This could ruin me.” The suit describes the lengths Clem went to in an effort to artificially boost his ratings. He bought radios on Amazon.com and had them shipped to the panelist’s house, it claims, and advised the panelist on how to circumvent the PPM’s motion-sensing technology. “He described that by using certain tricks the Cooperating Panelist could make it appear that he was listening to Bubba Clem’s show even when the Cooperating Panelist was not carrying the PPM device,” the complaint states.

Introduction Out of concern that common ownership of media may stifle diversity of voices and viewpoints, the Federal Communications Commission (“FCC”) has historically placed limits on the degree of common ownership of local radio stations, as well as on cross-ownership among radio stations, television stations, and newspapers serving the same local area. The 1996 Telecommunications Act loosened local radio station ownership restrictions, to different degrees across markets of different sizes, and it lifted all limits on radio station ownership at the national level. Subsequent FCC rule changes permitted common ownership of television and radio stations in the same market and also permitted a certain degree of cross-ownership between radio stations and newspapers. These changes have resulted in a wave of radio station mergers as well as a number of cross-media acquisitions, shifting control over programming content to fewer hands. For example, the number of radio stations owned or operated by Clear Channel Communications increased from about 196 stations in 1997 to 1,183 stations in 2005; the number of stations owned or operated by CBS (formerly known as Infinity) increased from 160 in 1997 to 178 in 2005; and the number of stations owned or operated by ABC increased from 29 in 1997 to 71 in 2005.

    ESPN XDS Network Content and Internal Website This guide will serve as a general view of the internal vs receiver website and how to navigate around. The connection to the website will require entering your IP address of the ESPN XDS receiver in the browser address bar and entering your password. Example would be http://172.19.7.136, and it will be unique to your facility. Please note that this website is not available externally. You will have to login from a computer located on the same network as your XDS receiver. Shown below is the main login page. To login, enter your user name: “tech”, followed by: *your friendly password* in the password field. The friendsly password is the one you created from the ESPN XDS Affiliate Webpage. You also have the option to use the daily password retrieved from the front panel of the receiver. There are three tabs located on the top of the page. General - Programming - Content Your General tab will have the following: Status – Tuner – Setup – Relays – Opto Inputs - Logs ESPN XDS Network Content Page 1 Starting with the main “General” tab and the sub tabs under it.
