This was the second by-election during the term of the 50th Parliament and the 374th for the Queensland Parliament since 1860. There were eight candidates registered for the election and Mr C (Chris) Foley was elected on the sixth preference count. On 19 April 2002 the Electoral Act 1992 was amended to provide for the lodgement by candidates and registered political parties of “how-to-vote” cards intended for distribution on polling day. The Maryborough by-election was the first election to be subject to the new legislation. The deadline for the lodgement of how-to-vote cards is 5.00pm on the Friday that is seven (7) days before polling day. For the by-election the deadline was 5.00pm on Thursday 17 April due to the Good Friday public holiday. How-to-vote cards that have not been lodged in accordance with the Act can not be distributed on polling day. By the deadline, cards had been lodged in respect of six of the eight candidates and an additional two how-to-vote cards were lodged by the Australian Labor Party. The remaining two candidates did not distribute how-to-vote cards on polling day.
