525 LEGISLATIVE ASSEMBLY 2019-20 FIRST SESSION OF THE FIFTY-SEVENTH PARLIAMENT VOTES AND PROCEEDINGS No. 42 THURSDAY 6 FEBRUARY 2020 1 MEETING OF THE HOUSE The House met at 9.30 am pursuant to adjournment. The Speaker took the Chair, read the prayer and acknowledged the traditional owners, thanking them for their custodianship of country. 2 NOTICES OF MOTIONS (GENERAL NOTICES) 3 CONDOLENCE MOTION—2019 - 2020 BUSHFIRE SEASON The order of the day was read for the resumption of the adjourned debate, on the motion of Ms Gladys Berejiklian, That this House: (1) Expresses its deepest condolences to the families, communities and loved ones of the 25 men and women who have tragically lost their lives during the catastrophic and unprecedented 2019-2020 bushfire season. (2) Honours the extraordinary sacrifice of Geoffrey Keaton, Andrew O'Dwyer and Samuel McPaul, Rural Fire Service volunteers who tragically lost their lives while protecting the lives and property of others. (3) Places on the record its gratitude for the courage of Captain Ian McBeth, First Officer Paul Hudson and Flight Engineer Rick DeMorgan Jr. of Coulson Aviation and the United States of America, who died in service to New South Wales. (4) Offers its sympathy to those who have been affected by the fires whether through injury or the loss of or damage to their homes or livelihoods. (5) Acknowledges the devastation caused by this season's bushfires, which have already seen 2,400 homes destroyed, over 11,000 buildings lost or damaged, 5.5 million hectares burnt, countless local businesses affected and hundreds of millions of animals killed. Question again proposed and debate resumed. 526 VOTES AND PROCEEDINGS OF THE NEW SOUTH WALES LEGISLATIVE ASSEMBLY Thursday 6 February 2020 The motion was also supported by Mr James Griffin, Ms Prue Car, Mr Stephen Bromhead, Ms Sonia Hornery, Mrs Tanya Davies, Ms Julia Finn, Mr Lee Evans, Mr Philip Donato, Mr John Sidoti, Mr Guy Zangari, Ms Felicity Wilson, Mr Jihad Dib, Mr Stuart Ayres and Ms Tamara Smith. Mr Stephen Bromhead, Mrs Tanya Davies, Mr Lee Evans and Mr Jihad Dib obtained extensions of time. It being 1.15 pm, debate interrupted. Ordered, That the resumption of the debate stand an order of the day for a later hour. The Temporary Speaker (Ms Felicity Wilson) left the Chair at 1.15 pm. The Speaker resumed the Chair at 2.15 pm. 4 MINISTERIAL ARRANGEMENTS Mr Brad Hazzard, on behalf of Ms Gladys Berejiklian, informed the House that: (1) The Minister for Planning and Public Spaces would answer questions today in the absence of the Minister for Local Government. (2) The Minister for Regional Transport and Roads would answer questions today in the absence of the Minister for Transport and Roads. 5 MINISTERIAL ANNOUNCEMENT Mr Brad Hazzard, on behalf of Ms Gladys Berejiklian, informed the House that on 20 December 2019, Adam Sibery Crouch MP was appointed Parliamentary Secretary for the Central Coast. 6 PUBLIC ACCOUNTS COMMITTEE Mr Brad Hazzard moved, That pursuant to section 54 of the Public Finance and Audit Act 1983, Justin Paul Clancy be appointed to serve on the Public Accounts Committee in place of Adam Sibery Crouch. Question put and passed. 7 SUSPENSION OF STANDING AND SESSIONAL ORDERS—ROUTINE OF BUSINESS Mr Brad Hazzard moved, That standing and sessional orders be suspended to provide for the following routine of business for the remainder of this sitting after the placing and disposal of business: (1) Consideration of the motion of condolence for the victims of the bushfires; (2) At 4.00 pm, Petition Debate; (3) Consideration of the motion of condolence for the victims of the bushfires; and (4) The House to adjourn without motion moved at the conclusion of the motion of condolence. Question put and passed. 527 VOTES AND PROCEEDINGS OF THE NEW SOUTH WALES LEGISLATIVE ASSEMBLY Thursday 6 February 2020 8 QUESTION TIME (1) Following a request from Mr Stephen Bromhead pursuant to standing order 131 (3), the Premier provided additional information. (2) Following a request from Mr Christopher Gulaptis pursuant to standing order 131 (3), the Minister for Regional Transport and Roads provided additional information. (3) Following a request from Mr Justin Clancy pursuant to standing order 131 (3), the Minister for Health and Medical Research provided additional information. (4) Following a request from Mr Lee Evans pursuant to standing order 131 (3), the Minister for Energy and Environment provided additional information. (5) Following a request from Mrs Wendy Tuckerman pursuant to standing order 131 (3), the Minister for Jobs, Investment, Tourism and Western Sydney provided additional information. 9 PETITION SIGNED BY 10,000 OR MORE PERSONS The Speaker announced that the following member had lodged a petition for presentation signed by 10,000 or more persons: Mr Chris Minns—from certain citizens requesting the Legislative Assembly oppose bus privatisation and deliver improved bus services. 10 PETITIONS The Clerk announced that the following member had lodged petitions for presentation: Ms Jo Haylen—from certain citizens asking the Legislative Assembly to call on the Government to conduct a commission of inquiry into the mismanagement of the Barwon-Darling River system, restore low-and- medium flows to the Darling River, reinstate the 'Cease to Pump' rule, ensure compliance checks on water users, halt the decommissioning project at Menindee and increase the number of outreach officers from Fisheries NSW to work with communities in addressing the health of river systems and increasing the fish population. Ms Jo Haylen—from certain citizens requesting the Legislative Assembly direct the Minister for Primary Industries to support amateur beekeepers by abandoning a registration fee and allocating more resources to maintain a disease free and sustainable network of hives. Ms Jo Haylen—from certain citizens requesting the banning of single use plastic bags in New South Wales. Ms Jo Haylen—from certain citizens requesting the Legislative Assembly improve Ashbury bus services by adding services to the 413 bus route. Ms Jo Haylen—from certain citizens asking the Legislative Assembly to direct the Government to renovate Yasmar Estate and for it to be maintained by Crown Lands to protect the estate and encourage community access and use. Ms Jo Haylen—from certain citizens requesting improved pedestrian safety at West Street and Railway Terrace, Petersham. 528 VOTES AND PROCEEDINGS OF THE NEW SOUTH WALES LEGISLATIVE ASSEMBLY Thursday 6 February 2020 Ms Jo Haylen—from certain citizens requesting the Government convene a drug summit to investigate alternative methods of drug detection at music festivals. Ms Jo Haylen—from certain citizens calling on the Government to immediately end no-fault eviction and to act to make tenancies more secure. Ms Jo Haylen—from certain citizens requesting the introduction of a Climate Change Act which would mandate renewable energy sources. Ordered, That the resumption of the debate stand an order of the day for a later hour. 12 INSPECTOR OF THE LAW ENFORCEMENT CONDUCT COMMISSION (1) The Deputy Speaker, in accordance with Standing order 265, tabled: Letter from Mr Bruce McClintock, Inspector of the Independent Commission Against Corruption, to the Presiding Officers, regarding his report in his capacity as the Assistant Inspector of the Law Enforcement Conduct Commission on dealing with a complaint by the Commissioner for Oversight of the Law Enforcement Conduct Commission against the Chief Commissioner, dated 6 February 2020. 529 VOTES AND PROCEEDINGS OF THE NEW SOUTH WALES LEGISLATIVE ASSEMBLY Thursday 6 February 2020 (2) The Deputy Speaker, in accordance with Standing order 265, tabled: Report of the Inspector of the Law Enforcement Conduct Commission entitled 'A report dealing with a complaint by the Commissioner for Oversight of the Law Enforcement Conduct Commission against the Chief Commissioner (Special Report 20/01)', dated 3 December 2019. Ordered to be printed. 13 DEBATE ON PETITION SIGNED BY 10,000 OR MORE PERSONS—PUBLIC INQUIRY INTO COMMERCIAL FISHING The order of the day was read for the debate of the petition signed by 10,000 or more persons presented by Mr Philip Donato, namely: From certain citizens requesting an immediate full independent public inquiry into various aspects of the New South Wales commercial fishing industry.
