Ms. Brenneman provided a brief overview of the antitrust statement. Chairman Ellis and Mr. Fithian welcomed Don Fox on his election to the NATO Executive Board. Public Messaging: The Board agreed to reduce the CinemaSafe national campaign remaining $1.2 Million to $500,000 concentrating on the New York and Los Angeles markets instead. The remaining $700,000 will be used in late November as needed. Chairman Ellis noted there was no new business and the next meeting will be via Zoom on Wednesday, 7 October 2020 at 1:30 pm Eastern. It was moved and seconded to adjourn the meeting. A vote was taken and the meeting was adjourned. Depew Assistant United States Attorneys One Courthouse Way, Suite 9200 Boston, MA 02210 (617) 748-3100 Dated: July 15, 2002 INTRODUCTION The United States opposes the defendants’ motions for summary judgment for a single, simple reason: the central factual issues raised by this case – whether the defendants’ stadium-style movie theaters provide people with disabilities with (i) “comparable” “lines of sight,” (ii) in locations that are an “integral part” of the fixed seating plan – are vigorously disputed. The government contends that the lines of sight are not comparable, based on facts demonstrating that a large number of the defendants’ theaters fail to provide wheelchair access to the elevated sight lines of the auditoriums’ full stadium risers. Instead, wheelchair users frequently are relegated to the inferior sight lines in the frontmost rows, much lower and closer to the screen. The government further contends that the wheelchair areas are segregated, in some instances due to walls and railings that physically separate them from other seats but also because of the de facto segregation that results from putting the wheelchair areas in inferior locations where most people choose not to sit. The defendants disagree with both of the foregoing assertions. Despite the parties’ material dispute over these core facts, the defendants have moved for summary judgment. -

D-BOX is the owner of certain software, known as D-BOX Motion Simulator and/or D-BOX Motion Code software (as further defined below, the “D-BOX Motion Code”) that is used to enable the D-BOX Equipment that, when conformed to and coupled with a motion picture or movie clip, creates a motion simulation system that is synchronized with onscreen action and sound for an enhanced end user experience. B. In connection with the theatrical release of the Films during the Term of this Agreement and as described herein, D-BOX shall, at no cost to Sony, license to Sony the D-BOX Motion Code created for each Film, and perform certain services in connection with each Film, in each case in accordance with the terms and conditions of this Agreement. -

The minimum wage legislation, Annual NATO of Michigan Legislative Reception, Michigan Association of Theatre Owners Treasurer PAC, NATO of Michigan Scholarship, and exploring a new NATO of Michigan insurance Rusty Belcher National Amusements services program were some of the highlights for 2006. All in all, it was a very successful year for NATO of Michigan, and we look forward to building on those successes in the Secretary coming year. Joe Chabot Moore Theatres As for the Michigan Legislature, the 93rd legislative session has just concluded it’s two-year Directors session. There was much activity impacting NATO of Michigan members during this two- Terrell Falk year session. There was legislation to ban violent video games with harsh penalties for Cinemark USA, Inc. violators, which was expanded to include motion pictures. We were successful in amending Paul Glantz motion pictures out of the legislation before it went to the Governor for her signature. Then Emagine Entertainment, Inc. there was the Governor’s proposed 6% Film Rental Tax which NATO of Michigan vigorously opposed. We countered with a summer long ad campaign in our theaters Bob Goodrich Goodrich Quality Theaters throughout the state and when the state budget was finally completed the film rental tax was not included.
