This notice may be cited as the Taking of Easement Notice (No. 822) 2004. Easement to be taken [s.9(7) of the Acquisition of Land Act 1967] 2. The easement is taken over land described in Schedule 2 by the Chief Executive, Department of Main Roads, as constructing authority for the State of Queensland for a purpose incidental to the purpose of transport (road), in particular, drainage purposes as from 30 July 2004 and vests in the Chief Executive, Department of Main Roads, as constructing authority for the State of Queensland. Terms and Conditions of Easement 3. The terms and conditions of the easement are set out in Schedule 1. SCHEDULE 1 Terms of Easement The following terms and conditions shall apply to the Easement for drainage purposes over land described in Schedule 2:- The State of Queensland acting through the Department of Main Roads, the department's servants and authorised agents shall have full free and uninterrupted rights and liberty to:- (a) from time to time as needed, construct and thereafter to use and maintain such open or closed drains and/or pipelines as are necessary for the passage or conveyance of storm water and for any other purpose connected with road drainage on, over, through or under the proposed easement areas. (b) at all times thereafter, obtain access to the proposed easement area and to the above proposed drainage works. (c) at all times and from time to time as is reasonably necessary, with or without all necessary materials, plant, machinery, personnel and others to enter upon and to go, pass and repass over, along, upon or under the surface of the proposed easement area. (d) generally do and perform all such other acts and things on, over, through or under the proposed easement area as are reasonably necessary to construct, install, use, inspect, service and maintain, repair or replace the above proposed drainage works.
