FREE SPEECH AND CIVIL LIBERTIES IN THE SECOND CIRCUIT Floyd Abrams* INTRODUCTION Much of the development of First Amendment law in the United States has occurred as a result of American courts rejecting well-established principles of English law. The U.S. Supreme Court has frequently rejected English law, permitting far more public criticism of the judiciary than would be countenanced in England, rejecting English libel law as being insufficiently protective of freedom of expression1 and holding that even hateful speech directed at minorities receives the highest level of constitutional protection.2 The Second Circuit has played a major role in the movement away from the strictures of the law as it existed in the mother country. In some areas, dealing with the clash between claims of national security and freedom of expression, the Second Circuit predated the Supreme Court’s protective First Amendment rulings.

The Federalist Society for Law and Public Policy Studies 2009 Annual Report “The Courts must declare the sense of the law; and if they should be disposed to exercise will instead of JUDGMENT, the consequences would be the substitution of their pleasure for that of the legislative body.” The Federalist 78 THE FEDERALIST SOCIETY aw schools and the legal profession are currently strongly dominated by a L form of orthodox liberal ideology which advocates a centralized and uniform society. While some members of the academic community have dissented from these views, by and large they are taught simultaneously with (and indeed as if they were) the law. The Federalist Society for Law and Public Policy Studies is a group of conservatives and libertarians interested in the current state of the legal order. It is founded on the principles that the state exists to preserve freedom, that the separation of governmental powers is central to our Constitution, and that it is emphatically the province and duty of the judiciary to say what the law is, not what it should be. The Society seeks both to promote an awareness of these principles and to further their application through its activities. This entails reordering priorities within the legal system to place a premium on individual liberty, traditional values, and the rule of law. It also requires restoring the recognition of the importance of these norms among lawyers, judges, law students and professors. In working to achieve these goals, the Society has created a conservative intellectual network that extends to all levels of the legal community.

  • Hon. Dennis Jacobs Chief Judge, U.S. Court of Appeals for the Second Circuit
Judicial Profile PHILIP R. SCHATZ Hon. Dennis Jacobs Chief Judge, U.S. Court of Appeals for the Second Circuit TO DENNIS JACOBS, chief judge of the U.S. Court of Ap- peals for the Second Circuit, a lawyer’s obligation to his or her client is paramount. The greatest honor of the chief judge’s long career as teacher, lawyer, and judge is the honor of having clients. “One thing that really irritates me is when lawyers apologize for representing their clients. Once a lawyer takes a representation, he has a duty to represent the client zealously.” His hero in this regard is Chrétien Guillaume de Lamoignon de Malesherbes (1721–1794), a liberal French minister of state who campaigned for the civil rights of religious minorities and prisoners and who, during his long career, repeat- edly fought against the excesses of the monarchy. During the French Revolution, at great personal risk, Malesherbes voluntarily came out of a well-earned retirement in 1792 to represent Louis XVI in his trial before the French Convention, because when he was liked my adversaries,” he says. “When you butt heads king, Louis had been Malesherbes’ client. Louis’ con- with people, you really get to know them.” viction was, of course, preordained. Two years later, Becoming a judge never entered his mind. “I was during the Reign of Terror, Malesherbes himself was quite happy practicing law,” he says. “I loved my executed, along with his daughter and grandchildren. job. I loved my firm.” In the 1980s, as an apparent “Now, that’s a lawyer,” says Chief Judge Jacobs.

  • Texas Law Judicial Clerks List
Texas Law Judicial Clerks List This list includes Texas Law alumni who reported their clerkships to the Judicial Clerkship Program – or whose names were published in the Judicial Yellow Book or Martindale Hubbell – and includes those who clerked during the recent past for judges who are currently active. There are some judges and courts for which few Texas Law alumni have clerked – in these cases we have listed alumni who clerked further back or who clerked for judges who are no longer active. Dates following a law clerk or judge’s name indicate year of graduation from the University of Texas School of Law. Retired or deceased judges, or those who has been appointed to another court, are listed at the end of each court section and denoted (*).
