Volume 34| No. 1 The Journal of the Southern Aerosol Technical Association Winter 2018 A MESSAGE FROM THE PRESIDENT SATA Fall meeting at the Clearwater Beach Marriott on Sand Key, September 18-20 Dear SATA Members, Here we are at the beginning of a new year! We have a lot of upcoming events that I’d like you to take a look at on our website. The first meeting this year will be the Joint Aerosol Summit Meeting in Nashville on March 12-14 at the Sheraton Grand Nashville Downtown. If you have not registered for a room or for the meeting itself, please do so as quickly as possible. Rooms in the block are running out quickly. Registering for the meeting helps the planning committee keep track of the number of attendees. There are a number of speakers that I’m sure you will find both interesting and informative. The Pierce Pillon, ITW Techspray agenda theme for this conference is “Common Ground”. SATA will follow up with our Fall meeting at the Clearwater Beach Marriott on Sand Key. This is a new venue for us and promises to be very entertaining. I have listened to some members’ comments that they are afraid that the association will lose its identity in joining the other aerosol associations to find areas of strengths and weaknesses that we have in common and how to address these. Let me say that SATA will not fall under the umbrella of a common organization nor will we lose contact with our members. As each regional is individual in how they provide benefits to their membership, SATA will continue to operate independently of the others, as it should. We only exist for the benefit of our members and operating separately is the best way to do this. Nobody knows our members like we do and it would be unfair to you for an umbrella organization to drive this. What we are going to do is to honestly discuss our strengths and weaknesses and look at each other’s means to focus on the challenges. We can always work together in this way and learn from each other yet operate separately. [email protected] 3 www.southernaerosol.com 2018 WINTER EDITION REGULATORY UPDATE CARB Date Code Product Dating/Date coding It is that time of year again. Remember date code information needs to be reported to CARB every year by your company if you do not use CARB's standard date coding. For California Section 94512 (b) product dating, specifically requires all consumer products to be sold into the state to display the day, month and year the products were manufactured or a code indicating the date. CARB has been increasing their activity on investigating and levying fines for non-compliance of this section. The date or date-code information shall be located on the container or inside the cover/cap so that it Doug Raymond is readily observable or obtainable (by simply removing the cap/cover) without irreversibly 3R disassembling any part of the container or packaging. Information may be displayed on the bottom of a container as long as it is clearly legible without removing any product packaging. CARB's standard code that has to be represented separately from other codes on the product container so that it is easily recognizable is the following: YY DDD = Year Year Day Day Day. A manufacturer who uses this standard CARB code to indicate the date of manufacture does not have to report this code. Failure to register a date code is subject to a fine. Every year the fines seem to go up. Your date code explanation needs to be submitted to CARB Enforcement on an annual basis, on or before January 31st of each year. If you have any questions regarding your date code report you may contact Sherry Bercu, (916) 229-0343 or by email to [email protected] Remember that the date code information is not treated as confidential business information so when providing the written explanation be sure to only provide an explanation of the portion of the code that represents the date of manufacture. Upcoming CARB Workshop CARB Multi-purpose lubricants CARB will hold their second public workshop on proposed amendments to the Consumer Products regulation. These amendments include an alternative compliance measure for Multi-purpose lubricants (MPL). Currently, MPL is regulated at 25% VOC with a future effective limit of 10% VOC. CARB is proposing to add an optional Reactivity limit of 0.45 MIR to be met by MPL in place of having to meet 10% VOC limit. The 10% VOC limit will stay in place for manufacturers that have met this limit or plan to meet the 10% VOC limit. The regulatory language has been proposed. Any MPL manufacturer should review this language and comment to CARB with any changes. The use of Reactivity to reduce ozone is a good scientific approach, because a reduction in the Reactivity of a product always provides a reduction in ozone creation. In mass base limits, ozone creation is not always lowered when a mass base limit is lowered due to the reactivity of VOC compounds used in the reformulation. The public workshop will be held on January 17, 2018 in Sacramento starting at 8:30 am. The notice along with the proposed regulatory language can be found at https://www.arb.ca.gov/consprod/regact/2018ra/mplwn2.pdf. This will likely be the last workshop on these amendments. Comments are due by February 1, 2018. Next step will be for a 45- day notice sent out before the May Board hearing to adopt these amendments.
