Previous minutes 1. The minutes of 19 January 2021 were agreed. Matters arising 2. The Presiding Officer provided an update on issues that arose in relation to the Bluejeans platform during Decision Time on Thursday 21 January. The Bureau noted that the question on the General Principles of the Dogs (Protection of Livestock) (Amendment) (Scotland) Bill would be put at Decision Time on Wednesday 27 January 2021. Future business programme 3. The Bureau agreed a revised programme of business for the week commencing 25 January and a programme of business for the weeks commencing 1 and 8 February 2021.

4. The Bureau agreed that Members Business on Thursday 4 February 2021 would be S5M-23310: - Plantation Slavery and Landownership in the West Highlands and Islands: Legacies and Lessons, and S5M-23806: Miles Briggs - Princess Alexandra Eye Pavilion. Timetabling of Bills at Stage 1 5. The Bureau agreed to recommend to the Parliament that consideration of the European Charter of Local Self-Government (Incorporation) (Scotland) Bill at Stage 1 be extended to Friday 12 February 2021.

Timetabling of Bills at Stage 2 6. The Bureau agreed to refer the Redress for Survivors (Historical Child Abuse in Care) (Scotland) Bill back to the Education and Skills Committee for consideration at Stage 2 and to recommend to the Parliament that consideration of the Bill at Stage 2 be completed by Friday 26 February 2021.

7. The Bureau agreed to refer the Hate Crime and Public Order (Scotland) Bill back to the Justice Committee for consideration at Stage 2.

Approval of SSIs 8. The Bureau agreed to recommend to the Parliament that the following SSIs be approved—

 Criminal Legal Aid and Advice and Assistance (Counter-Terrorism and Border Security) (Scotland) Regulations 2021 [draft]  Victims and Witnesses (Scotland) Act 2014 (Supplementary Provisions) Order 2021 [draft]  Restitution Fund (Scotland) Order 2021 [draft].

9. The Bureau noted that the Health and Sport Committee was considering the Health Protection (Coronavirus) (International Travel and Public Health Information) (Scotland) (No. 2) Regulations 2020 (SSI 2020/444) at its meeting on Tuesday 26 January and that, subject to that Committee’s recommendation on the instrument, a bureau motion recommending approval would be taken in the Chamber on Thursday 28 January 2021.

10. The Bureau agreed to recommend to the Parliament that the Single Use Carrier Bags Charge (Coronavirus) (Scotland) Amendment Regulations 2021 [draft] be considered by the Parliament.

Referral of an LCM 11. The Bureau agreed to recommend to the Parliament that the Justice Committee be designated as lead committee in consideration of the LCM on the Financial Services Bill. Committee request to meet at the same time as the Parliament 12. The Bureau agreed to a request from the Committee on the Scottish Government Handling of Harassment Complaints to meet, if required, at the same time as a meeting of the Parliament on Tuesday 2 February and Tuesday 9 February from 3.30 pm until Decision Time.

13. In agreeing to the request, the Bureau agreed to remind the committee of the expectation that committees should only meet at the same time as Parliament where all other options have been exhausted. Removal of motions 14. The Bureau agreed that all motions lodged on or before 24 November be removed from the Business Bulletin with the exception of the following—

Scottish General Election (Coronavirus) Bill: implications for the Parliament 15. The Bureau discussed the implications for the Parliament of the Scottish General Election (Coronavirus) Bill. The Bureau agreed—

 to recommend that the Parliament goes into recess for the campaign period until the date of dissolution and that the office of the clerk is also closed during this period,  to note that the Presiding Officer would, if required, recall the Parliament where necessary during this period, in consultation with the Parliamentary Bureau (as well as the statutory consultees set out in the Bill),  to recommend to the Parliament that rules 12.3.3 in relation to committee meetings, and rule 13.3.4A in relation to written answers be varied  to note that, subject to agreement of the measures set out above, updated information about procedural issues will be included in the next iteration of the election guidance.

Publication scheme 16. It was agreed that all papers considered at the meeting should be published.

Date of next meeting 17. The next meeting of the Bureau would be at 12 noon on Tuesday 2 February 2021.

FUTURE BUSINESS PROGRAMME: POSSIBLE MOTIONS FOR MEMBERS’ BUSINESS

1. Bureau Members will be aware that under Rule 5.6.1(c) the Bureau has a duty to ensure that there is a period of time available for Members’ Business at each meeting of the Parliament. In light of the ongoing response to COVID-19, the Parliament has agreed to a temporary suspension of this requirement. On 19 January 2021 the Bureau agreed to include Members’ Business in future business programmes, and that it should take place wholly virtually, with effect from Thursday 4 February 2021.

S5M-23991: Maurice Corry: Scotland’s Men’s Sheds Movement - That the Parliament recognises the role of the Men’s Sheds Movement in encouraging health and wellbeing; understands that since 2013, Men’s Sheds have provided the opportunity to learn new skills through a variety of activities and offers a social, safe and welcoming space to meet people and find information on local projects within the community, including those in the West of Scotland; notes with regret the impact of COVID-19 on the Men’s Sheds Movement, which has led to the temporary closure of all Men’s Sheds in keeping with lockdown restrictions, amid a sharp increase in the number of people experiencing feelings of loneliness and social isolation; appreciates that despite the challenges this has presented, the Scottish Men’s Sheds Association has continued its work to assist and support men’s shedders to forge social connections virtually and in April 2020 welcomed Sir Harry Burns as its new patron to promote and represent the movement; welcomes the £30,000 funding from the Scottish Government to help those Sheds whose fundraising has been most severely affected by the pandemic, and notes calls for all MSPs to share in celebrating the work of Scottish Men’s Sheds and to continue to protect its place in communities through this pandemic and for many years to come.

S5M-23822: John Mason: COVID-19 and the Gambling Epidemic - That the Parliament acknowledges a report by the University of Sheffield, which says that gambling is a serious public health issue and one that must be treated with the same fervour as alcoholism and drug use; understands that previous studies have shown it to be an addiction that afflicts all age groups, even children as young as 11; further understands that researchers have found that the COVID-19 pandemic and the resulting social isolation has fuelled an epidemic of addiction to online gambling and that services aimed at gambling rehabilitation have struggled to move online, leaving many, including in Shettleston, with problematic addictions without access to help, and notes the view that, in line with the recommendations in the university report, a public health strategy must be devised with national and local interventions.

S5M-23806: Miles Briggs: Princess Alexandra Eye Pavilion - That the Parliament finds it regrettable that the Scottish Government has reportedly said that it is not in a position to fund a new eye hospital in the foreseeable future; is concerned that the removal of £45 million of funding for the replacement Princess Alexandra Eye Pavilion in Edinburgh, which is over 50 years old, has implications for the care received by patients in Lothian; understands that waiting times for routine treatments, such as for glaucoma, can be extremely long; believes that NHS Lothian has been consistently underfunded by the NRAC funding model, and notes calls both for clarity from the health secretary regarding infrastructure funding in the NHS Lothian area and for that NHS board to be fairly funded when the budget is set out in January 2021.

S5M-23765: George Adam: The Never More Needed Campaign - That the Parliament welcomes the launch of the SCVO campaign, #NeverMoreNeeded, which aims to underscore the critical role that voluntary sector plays as society navigates, and rebuilds from, the COVID-19 pandemic; believes that charities and voluntary organisations make communities stronger and provide unique support, services and guidance; commends the voluntary sector, including the many organisations in Paisley, for the ways it has mobilised to respond to the immediate challenges exposed by the virus and the ensuing lockdown; recognises that it played a critical role in helping people to survive this period through a panoply of ways, including by delivering food security, tackling rough sleeping, helping to alleviate loneliness, improving digital connectivity and finding safe places for people experiencing domestic abuse; appreciates that, even in the best of times, everyone needs strong community and voluntary sector services to thrive; believes that, when the country begins to emerge from the pandemic, voluntary organisations will continue to play a vital role as society adjusts to a "new normal" and seeks to rebuild and recover; understands with concern that the pandemic has had a significant impact on the sector itself, with 75% of organisations reporting an adverse impact on their finances, two-fifths seeing an increase in demand for their services and half of charities believing that they will run out cash reserves within six months and be forced to cease operation; congratulates SCVO on taking forward this important campaign, which celebrates the impact of the voluntary sector, and notes that the campaign encourages MSPs, businesses and people to

consider how they can all recognise and support the sector at a time when it is never more needed.

S5M-23756: Gillian Martin: Impact of COVID-19 on Women in the Economy - That the Parliament recognises the impact of COVID-19 on women in the economy; understands that women in the Aberdeenshire East constituency and across the country have been more adversely affected economically by the pandemic, with the Gender Equality Index showing that they spent more time on housework and caring than men; notes the view that women should be supported as part of the economic recovery, and pays tribute to the work that has already been carried out by Women’s Enterprise Scotland, Engender and Close the Gap to make sure women’s voices are heard in the strive for a more equal wellbeing economy.

S5M-23746: Jackie Baillie: Support for People with Learning Disabilities During the COVID-19 Pandemic - That the Parliament notes with concern issues relating to support for people who have learning disabilities in the COVID-19 pandemic; believes that sufficient data on infection and mortality rates of people who have learning disabilities has not been made available despite repeated calls for this to be collated and published, and given that similar data exists for England; understands that, in its recent research on general mortality rates for people who have learning disabilities, the Scottish Learning Disabilities Observatory found that people who have a learning disability die 20 years younger than their peers, and children who have a learning disability are 12 times more likely to die than their peers; understands that routine COVID-19 testing for staff who support people who have learning disabilities outwith care home settings remains unavailable; further notes concerns that it understands have been raised by the Mental Welfare Commission over a lack of clarity in guardian awareness of do-not-resuscitate forms, given further evidence from England suggesting a rise in blanket do-not-resuscitate forms for people who have learning disabilities, and notes the belief that people who have a learning disability in Dumbarton and across Scotland must be treated as a priority group in terms of the COVID-19 vaccination programme in order to support and protect this group of citizens and their family carers.

S5M-23628: Christine Grahame: Citizens Advice Scotland Helps More People - That the Parliament recognises the vital work that Citizens Advice Scotland does for those in Midlothian South, Tweeddale and Lauderdale and across Scotland; notes the publication of new statistics that show that, in 2019-20, the Citizens Advice Service network helped over 188,000 clients resident in Scotland, dealt with almost 675,000 advice issues, including assisting clients to complete over 53,000 benefit forms, and recording over 4,700 tribunal and court outcomes, with 90% of the cases won or upheld; understands that during this period it helped clients gain over £170 million, representing £16 in client gains for every £1 funded to cover the core advice service, and thanks all volunteers and staff at Citizens Advice Scotland for their ongoing hard work to support people on a range of issues, particularly during the COVID-19 pandemic.

S5M-23618: : Stories of Hope Report, Scottish Churches Provide Support in Lockdown - That the Parliament welcomes the publication of the report,

Stories of Hope, produced by the Evangelical Alliance and Serve Scotland, which has calculated that churches across Scotland have provided 212,214 acts of support during lockdown; understands that these acts were delivered by over 3,000 volunteers and impacted over 55,000 beneficiaries; acknowledges that churches in 180 locations across Scotland worked in partnership with key stakeholders, including supermarkets, community councils, NHS boards, food banks, voluntary support groups and charities, to deliver services to support vulnerable groups, including older, homeless and young people; recognises the important role that it considers churches and charities play in communities across Scotland, including in the Lothian region, and praises all those involved in delivering these services during the pandemic.

S5M-23612: Joan McAlpine: Reductions to Day Services and Support Packages for Learning Disabled Adults - That the Parliament understands with concern that care packages for learning disabled (LD) adults have been reduced during the COVID- 19 pandemic across the country, including in the South Scotland region; believes that government assurance was given to health and social care partnerships (HSCPs) that any extra costs relating to providing these care packages would be reimbursed; regrets that, notwithstanding this, many LD people have reportedly had their support hours reduced significantly; believes that this has seriously impacted on their physical and mental wellbeing as well as adversely impacting on their carers and families; welcomes government guidance on the importance of reopening adult day centres (ARC), but understands that, in most areas, these have been closed since March 2020 and those that have reopened have done so with significantly restricted numbers; believes with regret that, in many parts of the country, ARC workers have not been redeployed to fully support LD people with in other ways, such as providing social activity; understands that third sector providers have often been more flexible and creative in redesigning their support services for LD people than HSCPs and that alternatives to face to face services offered by HSCPs, such as virtual services and activity packs, can be unsuitable for many adults with LD and do not compensate for social isolation; believes that much alternative provision is not person-centred and can often comprise a one- hour walk around a shopping centre in cold weather; welcomes the government guidance allowing self-directed support (SDS) to be used more flexibly during the pandemic; believes that people with a learning disability and their families require support to access SDS, particularly for the first time; is concerned that some HSCPs have reportedly suggested that families who use SDS to compensate for the closure or reduced capacity at adult day centres could lose hours at the day centre permanently; regrets reports that re-assessments of care packages due to the pandemic could also be used to permanently reduce the amount of support offered; understands that many of these reassessments are conducted remotely by professionals who do not know the families and people involved; notes the view that LD people urgently need this support, not just for basic needs such as feeding, washing and dressing, but also to enjoy meaningful activities and social opportunities, and considers that depriving them of this support is a human rights matter.

S5M-23310: Alasdair Allan: Plantation Slavery and Landownership in the West Highlands and Islands: Legacies and Lessons - That the Parliament welcomes the

publication by Community Land Scotland of an independent research report, Plantation slavery and landownership in the west Highlands and Islands: Legacies and Lessons, by Dr Iain Mackinnon of the University of Coventry and Dr Andrew Mackillop of the University of Glasgow as part of Community Land Scotland’s discussion paper series, Land and the Common Good; notes the conclusion that the proceeds of slave ownership, slavery-derived wealth and slave compensation payments coincided with the purchase of Highlands and Islands estates or otherwise helped maintain existing estate holdings among many established landed families; welcomes the greater understanding that it believes the report brings of the impact of slavery on patterns of Scottish land ownership history; notes the evidence that specific estate purchases have direct links to slave-related income; regrets that land purchased from the proceeds of slavery rests on the misery of breaches to the human rights of dispossessed peoples; notes that slavery-derived wealth has contributed to historic patterns of land markets that have left legacies of monopoly land ownership, depopulation and an emphasis on extractive estate management that continue to operate today, and notes the calls for a discussion of an appropriate permanent memorial for these historic connections and their impact on peoples in Africa, the Caribbean and the Highlands and Islands.

Purpose 9. To introduce a new scheme requiring international travellers arriving in Scotland to obtain a negative test before departure.

Agricultural Holdings (Relinquishment and Assignation) (Application to Relevant Partnerships) (Scotland) Regulations 2021 [draft]

11. Under Rule 10.6.5, the Bureau is required to lodge the following motion—

Graeme Dey on behalf of the Parliamentary Bureau: That the Parliament agrees that the Agricultural Holdings (Relinquishment and Assignation) (Application to Relevant Partnerships) (Scotland) Regulations 2021 [draft] be approved.

Purpose 12. To enable certain tenant farmers to relinquish the tenancy to their landlord for a sum, and prevent eligible tenant farmers from assigning the tenancy.

Consideration by committee 13. At its meeting on 27 January 2021, the Rural Economy and Connectivity Committee agreed to recommend that the regulations be approved. The Committee report was published on 28 January 2021.

Provision of Early Learning and Childcare (Specified Children) (Scotland) Amendment Order 2020 [draft]

PARLIAMENTARY BUREAU

COVID-19 COMMITTEE: REQUEST TO EXTEND ADVISERS’ CONTRACTED HOURS

Covid-19 Scrutiny

Background

1. At its meeting on 24 November 2020, the Bureau agreed to the appointment of two advisers to support the Covid-19 Committee. The advisers are experts in epidemiology and in wider health policy respectively. Their role is to support the Committee’s scrutiny of the Scottish Government’s COVID-19 response.

2. The Committee scrutinises the Scottish Government’s weekly Covid-19 statements and changes to health protection measures, which cover wide- ranging policy areas. The Scottish Government’s response to Covid-19 is informed by the latest figures on Covid-19 and other factors, including the risk to public health. The advisers attend weekly committee pre-briefs to advise on the latest Covid-19 developments.

3. In order to provide this advice, the advisers are required to review the latest evidence, as well as statements by the Scottish Government. On occasion, the Committee has also requested further information in writing from its advisers or requested them to source specific evidence. This level of expert advice is not available from within SPICe and has greatly assisted the Committee in its work.

4. The appointment of each adviser was initially made on the basis that the advisers would provide the equivalent of up to 4 days’ worth of contracted services. At its meeting on 28 January 2021, the Covid-19 Committee considered its work programme and agreed to seek the Bureau’s approval to extend the contracted hours for each adviser for up to 15 days’ worth of services.

Adviser Specification – Time Commitment

5. It is envisaged that each adviser will spend the equivalent of up to 15 days supporting the Committee from the time of their appointment up until the start of the pre-election period. This includes attendance at weekly meetings for pre- briefs, preparation time to review the latest available evidence and any requests for further information from the Committee.

Work plan

6. It is estimated that the role and workload of the adviser should be completed within 15 days during the period up until 31 March 2021. This request can therefore be encompassed within the 15 days allowed for by the fast-track procedure.

Decision

7. The Bureau is invited to approve the extension of contracted hours for each adviser to assist the Covid-19 Committee’s scrutiny of the Scottish Government’s COVID-19 response.

PARLIAMENTARY BUREAU

SESSION 6: ELECTION OF PRESIDING OFFICER AND DEPUTY PRESIDING OFFICERS

Purpose

1. This paper invites the Bureau to consider arrangements for the election of the Presiding Officer and Deputy Presiding Officers at the start of session 6. In particular, whether additional measures are required in light of any restrictions imposed in response to the pandemic.

Background

2. Members will be aware that the SPPA Committee is currently conducting an inquiry into the resilience of the rules in response to the COVID pandemic. All members have been invited to comment on the various proposed rule changes.

3. As part of this inquiry, the Committee is considering the rules governing the election of the Presiding Officer and Deputy Presiding Officer and whether any revisions are required in light of the pandemic.

4. The Bureau is invited to consider these issues as part of the consultation process.

Election process

5. Members will be aware that the rules require the Parliament to elect a Presiding Officer and two Deputy Presiding Officers at the start of every new session. These elections must be conducted by secret ballot.

6. The votes are cast using ballot papers and the result is determined by a manual count of the votes. The results are announced from the podium by the outgoing Presiding Officer. Rounds of voting continue until there is an outright winner.

7. The same process applies for the election of the Deputy Presiding Officers, the exception being that proceedings are chaired by the newly elected Presiding Officer.

Issues

8. Members are expected to participate in the election in person. However, it is possible that some members may be unable to attend in person if they are self-isolating or shielding. Although no provision has been made in the past to allow any absent members to vote, in these extenuating circumstances consideration should be given to whether an adjustment to the rules should be made to avoid disenfranchising any member in this position.

9. In terms of a voting process, Bureau Members will recall that, in response to the pandemic, the electronic voting system was used to elect an additional Deputy Presiding Officer. This was an unusual step which was taken in light of the particular

circumstances which required a quick process. It was also an uncontested election with only one candidate.

10. However, the situation is different in the case of the PO/DPO elections at the start of new session. In particular, given the role and responsibilities of the Presiding Officer, Members will agree that the integrity of the process will need to be preserved. In considering any alternative provision, steps should therefore be taken to allow the process as set out in standing orders to be followed as far as possible. In particular provision should be made for the secrecy of the ballot to be maintained.

11. In which case, there would be difficulties for members participating remotely to the use the remote voting app as this would require verification of the results. The Bureau is therefore invited to consider alternative provision.

12. One option would be to identify an impartial third party to administer the vote on behalf of the member who is self-isolating or shielding on their instruction. That person could be an internal official in a trusted position, such as the Clerk of the Parliament.

13. Assuming the Bureau agrees that provision should be made for remote participation in the PO/DPO elections, Members are invited to consider whether this approach would be acceptable in principle.

Practical arrangements

14. In terms of practical arrangements, the whole election process normally takes place in the chamber. However, the area that would normally be used at the back of the chamber is currently set up with seating for members. More space will be required in any case to allow for social distancing during the conduct of the elections. Work is ongoing in the context of Session 6 planning being carried out by the Election Programme Board as to how multiple locations could be set up throughout the building to allow more room for members to collect their ballot papers and cast their votes. Areas such as the Garden Lobby, Members’ Lobby or the Main Hall could be used for this purpose.

15. In addition, not all members can currently be accommodated in the chamber at any one time due to social distancing measures. Although members will not be expected to speak during the election, there are still only capacity to accommodate 117 members in total (including in the public gallery). Arrangements will therefore be required to allow members to view proceedings from other parts of the building.

Conclusion

16. As noted, the SPPA Committee is considering the PO/DPO election process as part of its inquiry into the resilience of the rules in response to the COVID pandemic. The Bureau’s views will inform this inquiry. Members are therefore invited to consider and comment on the issues set out in this paper.

17. Any change to the process would require temporary adjustment to the rules and so the SPPA Committee would need to bring forward the necessary changes to the rules for the Parliament to consider.

Recommendation

18. The Bureau is invited to consider the proposed arrangements for the conduct of the elections of the Presiding Officer and the Deputy Presiding Officers at the start of session 6.
