Background 1.1. This note provides a review of the policies of Northampton’s Development Plan to inform the preparation of a Neighbourhood Plan for Spring Boroughs. This note identifies those strategic policies with which the Neighbourhood Plan must achieve “general conformity”. In addition, the relationship between the Neighbourhood Plan and other documents which comprise Northampton’s Development Plan is explored. 1.2. It is intended that this report will assist Spring Boroughs Voice in preparing the Basic Conditions Statement in advance of submission of the Neighbourhood Plan. 2. Relationship to Development Plan Meeting the Basic Conditions 2.1. Neighbourhood planning was introduced through the Localism Act 2011 giving rights and powers to local communities to shape development in their local area through preparing a Neighbourhood Plan. 2.2. The Localism Act 2011 (paragraph 8(2)1) sets out the basic conditions which a Neighbourhood Plan must meet. The basic conditions are summarised as follows: a) Having regard to national policies and advice contained in guidance issued by the Secretary of State. b) Having special regard to the desirability of preserving any listed building or its setting or any features of special architectural or historic interest that it possesses. c) Having special regard to the desirability of preserving or enhancing the character or appearance of any conservation area. d) The making of the order (or neighbourhood plan) contributes to the achievement of sustainable development. e) The making of the order (or neighbourhood plan) is in general conformity with the strategic policies contained in the development plan. f) The making of the order (or neighbourhood plan) does not breach, and is otherwise compatible with, EU obligations. 1 inserted as Schedule 4B to the Town and Country Planning Act 1990 as applied to neighbourhood plans by section 38 A of the Planning Compulsory Purchase Act 2004 3 Spring Boroughs Voice Neighbourhood Plan: Evidence Base g) Prescribed conditions are met in relation to the Order (or plan) and prescribed matters have been complied with in connection with the proposal for the order (or neighbourhood plan). 2.3. This review of Northampton’s Development Plan is intended to assist Spring Boroughs Voice in meeting the basic conditions through: Having regard to national guidance including the National Planning Policy Framework (NPPF); and Achieving general conformity with the strategic policies of Northampton’s Development Plan. 3. National Policy National Planning Policy Framework (NPPF) Presumption in favour of sustainable development 3.1. For plan-making and decision-making, the primary source of national planning guidance is the NPPF. The NPPF sets out the government’s core planning principles and planning policies for England, and provides guidance as to how these are expected to be applied. 3.2. Planning law requires that applications for planning permission must be determined in accordance with the Development Plan unless material considerations indicate otherwise. At the heart of the NPPF (para.14) is a presumption in favour of sustainable development, for decision-taking this means: Development proposals which accord with the Development Plan should be approved without
