Senator Tyson nominated Representative Hoffman. The nomination was seconded by Senator Pittman and passed unanimously. Representative Hoffman assumed the chairpersonship. Draft After brief discussion regarding the differences between the House and Senate rules for allowing remote voting, a motion was made by Senator Pittman, and seconded by Representative Xu, to allow Committee members to vote remotely if they are located in the Capitol building. The motion passed. Chairperson Hoffman invited members to nominate a member for Vice-chairperson for calendar year 2021. Representative Curtis nominated Senator Petersen for Vice-chairperson. The nomination was seconded by Senator Pittman and passed unanimously. The Chairperson invited members to nominate a member for Ranking Minority Member. Senator Pittman nominated Representative Curtis for Ranking Minority Member. The nomination was seconded by Representative Xu and passed unanimously. Informational Hearing on 2021 HB 2188 Chairperson Hoffman explained that HB 2188 was introduced in the House Committee on Appropriations and has provisions that need clarification, specifically those provisions that ensure the Joint Committee on Information Technology (JCIT) has an opportunity to assess agency information technology (IT) prior to the issuance of a request for proposal. The Chairperson also noted the JCIT would have time to consider the legislation since it was introduced in an exempt committee. Senator Pittman referenced two bills being prepared for introduction in the Senate Committee on Ways and Means. Matt Sterling, Office of Revisor of Statutes, identified the bills as SB 249 and SB 250. Mr. Sterling provided an overview of the provisions of HB 2188 (Attachment 1). He explained that under current law, an agency develops an IT project and submits it to the Kansas Information Technology Office (KITO) for approval. HB 2188 would require an agency to submit the project to the JCIT for evaluation and recommendations before the project is sent to KITO. Committee members discussed the implications of the bill and expressed concerns, which included: ● Additional legislative oversight of agency projects is needed; ● Current law allows the Committee to meet anywhere on call of the Chairperson; ● The bill would require the Committee to meet more frequently; and ● The Legislative Coordinating Council must approve the meeting days to ensure legislators are compensated. Alan Weis, Legislative Chief Information Technology Officer, commented SB 249 would create additional reporting requirements for all state agencies for certain IT projects. He noted Kansas Legislative Research Department 2 Joint Committee on Information Technology – Minutes for February 23, 2021 Draft SB 249 would replace the current $250,000 project cost threshold with a risk-based assessment and SB 249 should be considered when discussing HB 2188.     Community Bankers Association of Kansas July Legislative & Policy Update July 29, 2021 Overview As usual, the conclusion of the 2021 legislative session results in a lull before legislative activities pick up. Except for on-going COVID-related activities, little has taken place as August approaches. There has not yet been a large volume of interim committee meetings, but those will likely begin in the coming weeks now that the Legislative Coordinating Council has approved interim committees. Despite a slow start to the summer legislative activities, there have been several changes over the last few weeks, including the expiration of the state of disaster declaration and its related impacts; a couple of new legislators, as well as the resumption of the SPARK Task Force. Big Picture Disaster Declaration Ends • The disaster declaration expired June 15th, and several provisions associated with it also went away, including the ability for parents to file grievances against school districts related to mask mandates or other measures a district may have taken to combat COVID- 19. • Additionally, just last week, a Johnson County district court judge ruled unconstitutional the new law passed last Session, SB 40, that made significant changes to the state’s emergency management act. The Court found the new law favored opponents of COVID restrictions, restrained and limited local governments’ response to action, and unduly burdened the judicial process. • More on the issue here: https://kansasreflector.com/2021/07/15/kansas-judge-strikes- down-new-law-allowing-challenges-to-mask-mandates-in-schools/ • The State solicitor general is appealing the decision and seeking a stay to keep the law in place.

    Community Bankers Association of Kansas Legislative Update January 6, 2017 Overview The 2017 session begins on Monday, January 9th; the Governor’s State of the State will occur on Tuesday, January 10th, and the Governor’s budget recommendations will be presented sometime later that week. The session should begin quickly with a mid-session break scheduled for February 25-March 6 and the regular session concludes on April 7th. The veto session begins May 1. A 90-day session should conclude on May 14th. There is much work to be done and this session will likely be the longest and most difficult in memory. New Leadership House of Representative In the House of Representatives, Democrats increased their numbers by twelve seats and a fair number of more conservative Republicans lost in the primary and general elections. The chamber has again elected a more conservative Speaker but the other leadership positions are fairly balanced between conservatives and moderate Republicans The 2017 House will have 85 Republicans and 40 Democrats, a change from the 2016 division of 97-28. Republicans: • House Speaker: Ron Ryckman Jr., (R-Olathe). • House Majority Leader: Rep. Don Hineman, (R-Dighton) • Assistant Majority Leader: Rep. Scott Schwab, (R-Olathe). • Assistant Majority Leader: Rep. Tom Phillips, (R-Manhattan). Democrats • Minority Leader: Rep. Jim Ward, (D-Wichita). • Assistant Minority: Leader: Rep. Stan Frownfelter, (D- Kansas City). Senate The Senate partisan split will be 31-9, with the Republican majority. The Democrat gain of one seat actually under-represents the amount of change in the Senate because fourteen incumbent conservative Republicans either chose not to run or were defeated.
