These Writ Petitions are filed under Articles 226 and 227 of the Constitution of praying to issue direction restraining the respondents from evicting the petitioners from their homes behind Kundalahalli gate, Thubarahalli, Whitefield, Bangalore – 560 087, Karnataka ETC.,

These Writ Petitions coming on for preliminary hearing this day, the Court made the following:

O R D E R

At the outset, learned counsel for both sides submit that the matter could be disposed of in the same terms as in W.P.No.54215/2018, as facts and issues involved are identical.

2. The petitioners claiming to be in possession of properties in Sy.Nos.55/1, 42/3 and 42/4 situated behind

Kundalahalli gate, Thurubarahalli, Whitefield, Bengaluru, have approached this Court seeking for the following reliefs:

“a) Issue an appropriate Writ, order or direction restraining the respondents from evicting the petitioners from their homes behind Kundalahalli gate, Thubarahalli, Whitefield, Bengaluru, Karnataka-560 087, the Schedule Property.

b) Direct the respondent corporation BBMP to provide basic amenities including sanitation and other necessary amenities to the Schedule property.

c) Grant such or other reliefs as this Hon’ble Court deems fit in the facts and circumstances of the above case as also compensation for their losses and costs in the above in the interests of justice and equity.”

3. The learned counsel for the respondent-BBMP submits that they do not have any claim over the property referred to above as the same is private property. He states that the petitioners are chiefly responsible for the un-hygienic environment in the local area which has resulted in causing civic problems to the neighborhood.

Despite several requests, no action has been taken by the petitioners or owners of the above mentioned properties to maintain hygiene.

4. Learned counsel for the BBMP states that the grievance as regards non-maintenance of hygiene in the area is to be addressed by the petitioners which would solve the problem on hand.

The main grievance as regards non- maintenance of hygiene and lack of proper waste management in the said land is arising mainly due to the action of the petitioners to ensure that solid waste and dry waste is to be disposed of in an appropriate manner in accordance with a method of solid waste management that has to be overseen by the BBMP.

6. Though the petitioners have sought for other reliefs, it is stated for the present that they would restrict their prayer as regards non-eviction. The learned counsel for the petitioners states that they reserve liberty to seek redressal and grant of the other prayer sought for if the need arises, as the respondent- BBMP has assured to look into the petitioners’ grievances.

7. Learned counsel for the BBMP states that as regards violation of bye-laws of BBMP, they are at liberty to initiate necessary action against the owners in accordance with law.

The learned counsel for the respondent-BBMP states that as regards the present petitioners, suitable direction is to be issued to ensure that petitioners co-operate in disposal of the solid waste and dry waste and for maintenance of the area in hygienic manner so as to ensure that no civic issues as such arise.

10. In light of the clarification of the learned counsel for the BBMP that the primary concern is one of maintenance of hygiene and that the threat to possession is ill-founded, the petitions could be disposed of.

11. The petitioners on the other hand undertake that they would for their part ensure maintenance of hygiene and that disposal of solid waste (wet and dry waste) would be done in accordance with the BBMP guidelines. Towards this end the BBMP Authorities to co-operate.

12. The petitioners also undertake that wherever dry waste is stored for the purpose of disposal, care would be taken to see that it is not set fire. It is also submitted that miscreants are setting fire to stored dry waste. The

Police Authorities are directed to co-operate in the event of complaints by the petitioners in this regard.

13. It is made clear that action for dispossession by

State and BBMP Authorities would be in accordance with

law. Liberty as sought for is reserved to the Authorities to take necessary action against the owners.

In the light of the observations made above, the petitions are disposed of requiring no further orders.
